[1:12] [Sounding gavel]
[1:12] >>Mayor Pachota: all right.
[1:14] Let's call this meeting to
[1:14] order.
[1:15] MADAM Clerk, a roll call,
[1:17] please.
[1:18] >>Kevin Engelke: here.
[1:20] >>Rachel Frank: here.
[1:21] >>Rick Howard: here.
[1:23] >>Ron Smith: here.
[1:24] >>Lloyd Weed: here.
[1:26] >>Vice Mayor Boldt: here.
[1:27] >>Mayor Pachota: and I'm here as
[1:27] well.
[1:29] We will stand for the invocation
[1:36] and today's pledge can be led by
[1:37] captain hill.
[1:38] >>Kelly Michaels: lord father,
[1:39] we pray for our mayor, city
[1:41] council and all who serve our
[1:41] community.
[1:43] Strengthen us with wisdom and
[1:44] grace for the work that we do
[1:45] every day.
[1:47] MAY our duties be carried out
[1:48] with respect and care, keeping
[1:50] our hearts pure as we work
[1:51] towards the best interests of
[1:52] all of our residents.
[1:56] Amen.
[2:13] [Pledge of allegiance]
[2:14] >>Mayor Pachota: okay.
[2:17] Let's have some fun.
[2:19] If we could get the police chief
[2:22] to join me up front, and we will
[2:23] start with james browning and
[2:52] family.
[2:53] >> good morning, everybody.
[2:56] This is a great day for the
[2:56] police department.
[2:59] We get to have three promotions
[3:02] that we're celebrating.
[3:04] First, I just want to thank city
[3:05] council for kind of helping us
[3:07] over the recent months to
[3:09] reorganize our department,
[3:10] creating some new positions as
[3:12] well and helping us to move
[3:12] forward.
[3:15] thank you for that and for
[3:16] celebrating these moments with
[3:18] us.
[3:21] The supervisors will be taking
[3:22] the oath of office.
[3:23] When you start as a police
[3:26] officer, you take this oath and
[3:27] during these milestones where
[3:28] they take on new
[3:30] responsibilities, it's a good
[3:31] opportunity to publicly renew
[3:32] that oath.
[3:35] That oath is to uphold the
[3:38] constitution and the laws of the
[3:40] state of florida and the trust
[3:43] that the community puts in them.
[3:44] Then we have pinning of the
[3:47] badge, which is part of the
[3:49] ceremony where, in this case,
[3:53] the badge elevates them to a new
[3:53] role.
[3:57] If anyone has a business, you
[3:59] know that your line-level
[4:01] supervisors are some of the most
[4:01] important.
[4:02] James browning here is moving
[4:04] into that critical role.
[4:06] He will be a role model for the
[4:06] officers.
[4:10] A lot of them you see here.
[4:13] And really as a supervisor sets
[4:14] the tone for the organization.
[4:16] So we're looking forward to him
[4:18] taking on this new
[4:18] responsibility.
[4:21] And then we incorporate family,
[4:23] his wife jessica is here, into
[4:25] this moment because these
[4:27] achievements are not their own.
[4:29] It's shared achievements because
[4:31] their family is with them during
[4:32] all the hard times and all the
[4:34] good times as well.
[4:35] We're glad to have her here with
[4:36] us.
[5:06] Let's go ahead and get started.
[5:11] >> I james browning, do solemnly
[5:12] swear, that I will support,
[5:16] protect, and defend the
[5:19] constitution and government of
[5:21] the united states and of the
[5:22] state of florida.
[5:26] That I am duly qualified to hold
[5:28] my position under the
[5:31] constitution of the state.
[5:35] That I will well and faithfully
[5:40] perform the duties of sergeant
[5:42] of which I am now about to
[5:42] enter.
[5:44] So help me GOD.
[6:01] [Applause]
[6:46] [Applause]
[6:51] >> when we swear in the new
[6:52] officers, I usually don't make
[6:53] them say anything.
[6:55] As a supervisor, I feel like
[6:56] it's only appropriate.
[7:00] [Laughter]
[7:03] >> thank you, chief.
[7:04] First, I want to say I'm
[7:06] grateful and thankful for GOD
[7:09] for giving me this point.
[7:15] Also, I want to thank my wife --
[7:16] >> yep.
[7:19] [Laughter]
[7:20] >> -- my family, my kids who
[7:23] have been my support system and
[7:25] have sacrificed so much.
[7:26] Thank you guys.
[7:27] Thank you, chief, and the
[7:30] command staff for entrusting me
[7:33] with this new role and position.
[7:39] I don't take it lightly.
[7:44] The officers, my past
[7:45] supervisors, colleagues, thank
[7:47] you for getting me to this
[7:47] point.
[7:48] You guys have assisted me and
[7:50] helped me out so much.
[7:51] I really appreciate you.
[7:53] I'm thankful for this
[7:53] opportunity.
[7:55] Thank you.
[8:05] [Applause]
[8:10] >>Mayor Pachota: next, we'll get
[8:24] matt sauchinitz and family.
[8:31] >> this is another great
[8:36] promotion -- thank you.
[8:38] With the pinning of this badge,
[8:41] now we're moving to a higher
[8:44] level of authority and
[8:45] responsibility.
[8:47] Not only is he still being the
[8:48] model for the officers, but he's
[8:50] also running a division.
[8:51] He will be in charge of the
[8:53] patrol division as he takes on
[8:55] this new role as captain.
[8:58] So he will also be developing
[8:58] supervisors now.
[9:00] The sergeants and lieutenants
[9:02] that work under his command.
[9:04] And he's certainly shown over
[9:06] the years that he's prepared for
[9:08] this job with his dedication and
[9:13] his service.
[9:16] I've known matt a long time.
[9:18] Pretty cool for me, too, and
[9:18] jill.
[9:20] I might need a hug.
[9:21] Of course, jill has been there
[9:23] through all the difficult times
[9:24] and all the good times.
[9:27] And there's been many of both.
[9:28] I'm glad to see you here as
[9:29] well.
[9:38] Let's go ahead and do this.
[9:42] >> I, matthew sauchinitz, do
[9:43] solemnly swear that I will
[9:47] support, protect, and defend,
[9:49] the constitution and government
[9:53] of the united states and of the
[9:56] state of florida, that I am duly
[9:59] qualified to hold my position
[10:02] under the constitution of the
[10:04] state.
[10:06] That I will well and faithfully
[10:11] perform the duties of captain on
[10:12] which I am now about to enter,
[10:16] so help me GOD.
[10:22] [Applause]
[10:28] >> now the pinning of the badge.
[10:50] [Applause]
[10:57] >> all right, matt.
[11:01] It's your turn.
[11:02] >> first, thank you for
[11:04] everybody being here today,
[11:05] supporting me and my family in
[11:07] this ceremony, along with the
[11:09] other people getting promoted.
[11:11] it really means a lot to feel
[11:12] that support.
[11:14] First and foremost, I need to
[11:17] thank my beautiful wife here.
[11:17] Every law enforcement officer
[11:20] that comes up here, the first
[11:21] person they recognize and
[11:24] support is their wife, their
[11:24] husband, their significant
[11:25] other.
[11:27] And there is a reason for that.
[11:28] Law enforcement can be
[11:28] challenging.
[11:30] We have our ups and downs.
[11:33] I've been doing this for 18
[11:33] years.
[11:35] My beautiful wife has been by my
[11:37] side the whole time.
[11:40] She's been there to support me,
[11:42] listen to me, be with me.
[11:42] Thank you.
[11:44] I love you, sweetie.
[11:46] Next, you two.
[11:49] There is a common expression
[11:51] that some things in life are
[11:54] bigger than you.
[11:55] It's true.
[11:57] Thank you for allowing me to
[12:00] understand that and believe.
[12:02] Mom and I are so proud of you.
[12:04] We love you.
[12:05] I love both of you.
[12:08] Thank you.
[12:14] [Applause]
[12:15] My family, my parents and my
[12:18] brother, who are sitting here
[12:20] and many of you here today,
[12:21] thank you for the support.
[12:22] Some of you would find this hard
[12:23] to believe.
[12:23] It is true.
[12:27] I was the wild child growing up.
[12:30] I put my parents through quite a
[12:31] bit.
[12:34] Right after 2001, the terrorist
[12:35] attacks, I decided to join the
[12:36] military.
[12:38] I joined the marines.
[12:40] 24 years ago I was sitting at my
[12:42] dinner table and I told my mom
[12:44] and my dad, I said I'm going to
[12:44] join the marines.
[12:46] It was 2003.
[12:48] There was a lot going on in the
[12:48] world.
[12:50] My mom looked at me and said,
[12:52] "you know that is the hardest
[12:53] one, right?"
[12:55] I said, yes, I know.
[12:56] That was it.
[12:57] That's all she said.
[12:58] As mother and father, they
[12:59] supported me for everything I
[13:00] went through.
[13:02] When I came back to the world,
[13:04] they made sure that I was
[13:05] standing upright and supported
[13:07] me into the next path.
[13:08] Thank you and I love you.
[13:11] To my brother, hardest working
[13:12] guy I've ever met.
[13:13] Thank you for being that mentor
[13:15] and showing me what real work
[13:16] ethic is.
[13:17] Thank you.
[13:19] Finally, everybody in the back,
[13:21] you know, sworn, non-sworn,
[13:23] civilian, not just the police
[13:24] department, it's the city.
[13:25] We have so many great people
[13:26] that work here.
[13:28] Been privileged to see that for
[13:30] 18 years of everybody who really
[13:32] puts in time every day to make
[13:35] sure that the city is running to
[13:37] the best we can.
[13:38] Thank you for your public
[13:38] service.
[13:39] I really appreciate that.
[13:41] Thank you all.
[13:42] Have a good day.
[13:46] [Applause]
[13:52] >>Mayor Pachota: all right.
[13:54] That's it for promotional
[13:55] ceremonies today.
[13:57] [Laughter]
[13:59] If we could get alicia white to
[14:02] come up with the kids.
[14:03] Louis, you're going to be
[14:05] postponed to NOVEMBER 3rd when
[14:34] i'm not in office anymore.
[14:35] >> all right.
[14:37] Got to keep the mayor in line
[14:37] sometimes.
[14:43] It's not an easy job.
[14:46] For this next pinning and oath
[14:48] of office, again, I want to
[14:49] thank council, because this is a
[14:51] position that kind of went away
[14:53] from our department for a while.
[14:56] And it was much-needed, so I
[14:57] appreciate the opportunity to
[15:00] bring it back.
[15:02] Deputy chief white is certainly
[15:04] the right person for the job.
[15:06] This role certainly has the
[15:09] highest level of trust at our
[15:10] agency, but not only that, with
[15:12] the city as well being that it's
[15:15] with the police department.
[15:17] He's not only making sure our
[15:19] mission and vision is
[15:23] implemented, he now has a hand
[15:24] in shaping that.
[15:25] Very important role and he's
[15:27] proven time and time again that
[15:29] he's prepared for it through his
[15:31] efforts and dedication.
[15:33] Alicia, thank you for being
[15:35] here.
[15:36] Again, I know all the phone
[15:38] calls that I've made to him at
[15:39] night that you probably had to
[15:41] hear and all the good times, the
[15:43] bad times throughout his career
[15:46] and the sacrifices that he's
[15:48] made that you've stood behind
[15:48] him.
[15:49] Thank you for being there.
[15:58] Let's go ahead and get started.
[16:03] >> I, louis white, do solemnly
[16:04] swear that I will support,
[16:06] protect, and defend, the
[16:10] constitution and government of
[16:12] the united states and of the
[16:16] state of florida, that I am duly
[16:19] qualified to hold my position
[16:23] under the constitution of the
[16:25] state and that I will well and
[16:37] faithfully perform the duties of
[16:39] deputy chief of which I am now
[16:43] about to enter, so help me GOD.
[16:56] [Applause]
[17:02] >> the mayor is going to help
[17:05] out with the pinning today.
[17:08] He secretly fired him I think 22
[17:09] times.
[17:10] 2200 times.
[17:15] So this is redemption.
[17:19] [Applause]
[17:20] Congratulations.
[17:29] >> thank you to MR. Mayor for
[17:31] pinning me.
[17:33] Chief, for your dedication to
[17:35] kind of mentoring me in this
[17:36] role, preparing me with this
[17:39] role and trusting me with the
[17:39] role.
[17:42] To the city manager, appreciate
[17:43] it and venice city council for
[17:44] voting yes on the staffing
[17:46] changes and some of the things
[17:47] we have forthcoming.
[17:48] To my wife, I appreciate it.
[17:51] Thank you for being with me all
[17:51] these years.
[17:55] I know the late-night calls from
[17:56] lieutenant danaman often two,
[17:59] three times after 2 A.M., gets
[18:00] stressful.
[18:01] Usually she boots me to the
[18:03] couch after the second call.
[18:04] I do appreciate it.
[18:05] To my kids for understanding
[18:07] when daddy walks away with a
[18:09] phone call from the chief, from
[18:11] the mayor or whoever it MAY be.
[18:13] Love you guys.
[18:16] To the staff in the back,
[18:18] officers, I think the most
[18:19] important thing of the staffing
[18:21] study that came out of it in had
[18:23] my mind was we're running lean,
[18:24] right?
[18:25] You guys feel that day in and
[18:26] day out.
[18:29] What the staffing study vendors
[18:32] came to us with was, it's your
[18:35] effort, your daily effort and
[18:36] dedication, really, that make
[18:37] sure we uphold the standards
[18:39] that the citizens expect, that
[18:40] the council expects and that the
[18:41] chief expects.
[18:43] So hold that high.
[18:45] Hold your chin high as we move
[18:46] forward.
[18:47] There could be budget
[18:49] constraints coming up with the
[18:51] property tax amendment, but
[18:52] we'll shift stuff around, work
[18:53] lean if we have to, and we'll
[18:55] get it accomplished.
[18:56] Just trust us to move forward
[18:58] with that.
[19:00] That's all I have.
[19:02] I do appreciate the chief again
[19:04] for kind of mentoring me in this
[19:06] role and getting me ready and
[19:08] prepped for the future.
[19:14] [Applause]
[19:21] >>Mayor Pachota: with that, we
[19:22] will come back at 30 after.
[19:24] We'll go take photos out front
[20:19] [Sounding gavel]
[20:19] >>Mayor Pachota: okay.
[20:20] We are back.
[20:24] We are now on to audience
[20:26] participation.
[20:27] Audience participation will be
[20:29] limited to one hour for the
[20:32] first portion.
[20:33] MADAM Clerk, how many do you
[20:34] have signed up?
[20:35] >>Kelly Michaels: six.
[20:36] >>Mayor Pachota: six.
[20:36] Okay.
[20:38] Speakers are not to address
[20:39] council members individually.
[20:40] Any person making personal,
[20:42] impertinent or slanderous
[20:43] remarks or becomes disorderly
[20:44] MAY be barred from the meeting.
[20:46] This is an opportunity to
[20:46] provide the city council with
[20:47] your comments.
[20:48] City council will not respond to
[20:50] any questions or comments during
[20:52] this time per the city code.
[20:53] A member of city staff will
[20:55] follow up with you if it's
[20:55] appropriate.
[20:57] Any documents shown during
[20:58] audience participation or part
[20:59] of the meeting must be given to
[21:00] the clerk for the official
[21:01] record.
[21:03] MADAM Clerk, our first speaker.
[21:04] >>Kelly Michaels: our first
[21:08] speaker is steve ogle thorpe.
[21:13] He has five minutes.
[21:22] >>Mayor Pachota: good morning
[21:26] and welcome, sir.
[21:29] >> good morning, MR. Mayor,
[21:30] council members, and city of
[21:31] venice staff.
[21:34] My name is steve oglethorpe.
[21:37] I live here in venice.
[21:39] I believe that city employees
[21:41] are misleading the city council
[21:43] and the public about intentions
[21:45] for the airport.
[21:47] I believe this based on recent
[21:49] information presented by city
[21:51] employees.
[21:53] In a nutshell, they are telling
[21:55] the council and public one thing
[21:57] while telling the federal
[21:58] aviation administration the
[22:00] opposite.
[22:03] On JUNE 23rd, james clinch,
[22:05] the venice city manager, led a
[22:08] presentation to the council.
[22:09] That presentation included
[22:11] several statements.
[22:16] First, that venice is not
[22:18] working on increasing or
[22:20] decreasing operations at the
[22:21] airport.
[22:22] In the presentation the word
[22:27] "not" is in bold capitals.
[22:28] Second, venice is not working on
[22:30] what he called the t word.
[22:32] It is the airport administration
[22:32] building.
[22:34] In the presentation, the word
[22:37] "not" is in bold capitals.
[22:39] Yet in the JULY faa discussion
[22:43] briefing by nicholas dew mass,
[22:44] the airport director for the
[22:46] city, there is discussion of,
[22:48] first, a quote, new terminal
[22:49] project and control room
[22:51] timeline.
[22:55] Second, a budget for venice to
[22:58] hire five full-time staff to
[23:00] manage increased traffic.
[23:01] Third, planning to fund this
[23:03] through, quote, protecting and
[23:06] expanding the airport's existing
[23:08] revenue base.
[23:10] Fourth, quote, growth driven
[23:12] revenue through, quote, flight
[23:14] training expansion, corporate
[23:18] and business aviation, increased
[23:20] transit operations and new
[23:22] aviation business development.
[23:26] Fifth, a quote 29.8 percent
[23:27] projected revenue growth over
[23:29] the period fiscal year '26 to
[23:34] fiscal year '29.
[23:37] Finally, of a, quote, new
[23:39] terminal building, a two-story
[23:43] hurricane hardened terminal
[23:44] administration building at a
[23:46] projected cost of 7 to 9
[23:47] million.
[23:50] These recent presentations are
[23:51] directly contradictory.
[23:53] The public is being told one
[23:53] thing.
[23:55] The faa another.
[23:58] One position or the other is
[24:01] intentionally deceptive.
[24:02] MR. Mayor and council members, I
[24:05] request that the city end any
[24:07] and all current applications,
[24:09] negotiations, or plans underway
[24:13] with the federal aviation
[24:13] administration.
[24:18] Further, I request that venice
[24:21] scrap all vnc master planning to
[24:22] date and begin anew with a
[24:23] process characterized by honest
[24:25] and open communication among all
[24:26] stakeholders.
[24:33] Thank you very much.
[24:34] >>Kelly Michaels: the next
[24:35] speaker is amber jacob.
[24:43] She has five minutes.
[24:47] >>Mayor Pachota: good morning
[24:47] and welcome.
[24:49] >> good morning.
[24:50] Good morning, all.
[24:52] My name is amber jacob.
[24:55] I am with my favorite race
[24:55] events.
[24:57] We are a local company nonprofit
[25:01] that produces 5Ks, 10Ks and
[25:04] was planned to introduce our
[25:07] very first half marathon this
[25:07] year.
[25:09] Our largest event, megalodon
[25:10] weekend, is held the first
[25:11] weekend in MARCH.
[25:14] On topic with the airport,
[25:16] unfortunately, last spring we
[25:17] were sent an e-mail that said we
[25:20] could move forward with
[25:21] permitting our events but there
[25:22] was no guarantee that we would
[25:25] be allowed to have our event.
[25:27] That being said, we have about
[25:29] 1200 people that take place in
[25:30] our megalodon weekend.
[25:32] We bring in a lot of revenue.
[25:35] We bring in a lot of volunteers.
[25:36] We include the entire community
[25:39] in our events and we give back a
[25:41] ton of money to the community.
[25:43] We could not launch our event
[25:44] because we can't take thousands
[25:46] of dollars from people and then
[25:48] tell them, hey, sorry, by the
[25:51] way, the event is not happening.
[25:53] Luckily, darlene culpepper has
[25:54] worked tirelessly to get us kind
[25:55] of an answer.
[25:57] And we were just told maybe two
[25:58] weeks ago that we could move
[26:00] forward with permitting and
[26:02] housing our events at the
[26:06] airport ground through spring.
[26:10] I would love for myself, for our
[26:11] nonprofits and for all the other
[26:14] event holders in the town that
[26:17] there's got to be a more
[26:18] concrete date or there's got to
[26:19] be an answer somewhere.
[26:21] We keep being told that someone
[26:24] in the faa has a paper on her
[26:26] desk and that that answer is
[26:27] there but keeps getting piled
[26:29] under other more important
[26:31] things and events at the airport
[26:33] ground are just not important,
[26:35] so why figure out that date.
[26:36] Well, they are important because
[26:37] we all rely on that.
[26:39] You know, there is a ton of
[26:41] events that take place out
[26:41] there.
[26:42] I really think that someone has
[26:43] an answer.
[26:46] So can we work on getting a more
[26:46] concrete date?
[26:48] Can we house our events out at
[26:51] the airport ground through 2027
[26:54] or can we house them out there
[26:55] through 2029?
[26:56] Again, we were supposed to be
[26:58] including and introducing a half
[27:00] marathon this year, and that
[27:02] would have brought in a ton of
[27:02] revenue.
[27:04] We've been working closely with
[27:06] the gasparilla distance classic,
[27:08] if anyone is familiar with that.
[27:09] They bring in millions of
[27:10] dollars to the tampa area, and
[27:13] that was our hope for venice was
[27:15] to be a smaller version of the
[27:17] gasparilla distance classic and
[27:20] really grow that event to be a
[27:21] destination event for venice.
[27:25] So to have an answer of how long
[27:27] will we have to produce our
[27:29] events out at the airport ground
[27:31] would really help a lot of us
[27:33] event holders going forward with
[27:35] planning, but also not only
[27:36] having a date of how long we
[27:40] have to house our events out
[27:42] there, but there's a ton of
[27:42] property out there.
[27:44] Is the possibility of sharing
[27:47] that property even an option?
[27:50] Can faa keep part of it but also
[27:51] still allow the city of venice
[27:53] to have part of that property to
[27:55] continue with events?
[27:57] I mean, I'm not an architect and
[28:01] I'm not a surveyor, but having
[28:04] our events out there can
[28:05] visually see there is a ton of
[28:06] property left untouched.
[28:08] Could we please get a date and
[28:09] could we even maybe talk about
[28:12] sharing that property?
[28:12] That would be incredible.
[28:13] Thank you for your time.
[28:14] >>Mayor Pachota: thank you for
[28:15] your comments.
[28:17] MADAM Clerk, the next speaker.
[28:18] >>Kelly Michaels: the next
[28:20] speaker is bryce ferguson.
[28:28] He has five minutes.
[28:28] >>Mayor Pachota: good morning
[28:29] and welcome.
[28:30] >> good morning.
[28:32] Thank you, MR. Mayor and
[28:34] council, members of city staff.
[28:37] When I was a little boy, nine
[28:38] years old, one of the things I
[28:40] looked forward to most on
[28:41] weekends was meeting with my dad
[28:43] out at the venice airport and
[28:45] having a little cessna 172 and
[28:47] taking to the skies.
[28:48] Wasn't his plane.
[28:49] One he borrowed, rented,
[28:51] whatever the circumstances were,
[28:51] I don't know.
[28:53] I was a little kid and I got to
[28:55] go flying and I loved it.
[28:57] I would spend all week at venice
[28:58] elementary and go up in the air.
[29:00] Fly all over the area.
[29:02] Head south, go to the keys,
[29:04] north, to my grandma's house in
[29:04] lake city.
[29:06] We always had an adventure.
[29:08] This year, this spring, I took
[29:11] my dad for his final flight as
[29:12] his cremated remains were spread
[29:14] in the gulf three miles
[29:14] offshore.
[29:16] I tell you this because I want
[29:17] you to understand where I'm
[29:19] coming from, someone for whom
[29:21] this airport has always been
[29:23] very vital in my life as an
[29:23] airport.
[29:27] But when I look at the vision
[29:28] emblazoned on the back of the
[29:29] wall here in chambers, that
[29:32] airport ground is so much more
[29:34] than just aviation.
[29:35] And I understand, and this has
[29:37] been a public discourse for a
[29:39] while now, and a lot of back and
[29:41] forth and had many things to
[29:42] navigate.
[29:43] I as a member of our community
[29:45] appreciate your hard work and
[29:46] diligent effort on making sure
[29:49] we retain our vibrance and our
[29:50] historic value and understand
[29:52] that this is a historic year at
[29:54] a hundred years of being a
[29:56] municipality, the change has
[29:58] become inevitable through that
[29:58] process.
[29:59] But I am asking that you
[30:00] preserve a few of the great
[30:02] things about our community as
[30:05] you navigate all these
[30:06] complications.
[30:07] As previously mentioned, the use
[30:10] of the fairgrounds is so much
[30:11] more than a place for an event.
[30:13] These are places where annual
[30:15] events have happened over the
[30:16] years, where young people get
[30:18] volunteer hours, where
[30:19] nonprofits make enough revenue
[30:22] to continue to exist for the
[30:23] next 12 months.
[30:24] Where folks like myself take
[30:26] kids to the italian feast to
[30:27] have their first experiences of
[30:29] what a festival can be like,
[30:32] where I, as a kid, got to go
[30:34] spend mom and dad's $10 on
[30:37] tickets to ride rides and play
[30:39] carnival games, where the chalk
[30:41] festival helps local venice
[30:42] nokomis rotary raise funds for
[30:43] all of the great mission work
[30:44] they do.
[30:46] and so many other organizations.
[30:48] Public records show that between
[30:50] 80 and 100 thousand members of
[30:52] our community and surrounding
[30:54] communities participate in these
[30:56] events every year.
[30:58] Once there are unknowns,
[30:59] unknowing of the future where
[31:01] these events could be held, will
[31:02] they be held?
[31:05] Next year, three years from now?
[31:08] Whenever there is uncertainty,
[31:08] participation drops.
[31:10] People can't plan their
[31:11] vacations and travels around the
[31:13] great events if they don't know
[31:13] they'll happen.
[31:14] Clarity is kindness.
[31:16] I ask that as soon as you can,
[31:18] if we can have clarity on how we
[31:19] move forward as a community and
[31:21] hope that you will all continue
[31:23] to seek preservation of the
[31:24] grounds for the purposes that
[31:26] are much bigger than aviation
[31:28] use of the airport.
[31:29] It is publicly available that
[31:32] there are provisions within the
[31:34] faa handbook published FEBRUARY
[31:36] of this year to allow for
[31:37] community and municipal airports
[31:39] to use their spaces for
[31:40] non-aviation purposes.
[31:41] I know that you all are doing
[31:42] your due diligence.
[31:43] I appreciate it.
[31:44] Just hope that you guys can
[31:46] continue to find ways forward
[31:47] that will continue to include
[31:49] that vibrant portion of our
[31:50] community.
[31:51] Thank you for your time this
[31:51] morning.
[31:52] >>Mayor Pachota: thank you for
[31:53] your comments.
[31:54] >>Kelly Michaels: the next
[31:57] speaker is bonnie kivlan.
[32:14] She has five minutes.
[32:15] >>Mayor Pachota: good morning
[32:15] and welcome.
[32:16] >> good morning.
[32:18] Thank you for allowing me to
[32:21] speak.
[32:23] My issue is the proposal that
[32:26] was written by city manager
[32:29] clinch, and I think also airport
[32:31] director dumas.
[32:33] I'm not sure how he pronounces
[32:34] his name.
[32:35] The gentleman who preceded me,
[32:39] who was the first speaker, very
[32:41] clearly listed the reasons why
[32:44] we're having a problem with the
[32:47] proposal that was written by
[32:51] these two gentlemen.
[32:52] Interestingly, it was not
[32:54] brought up at a council meeting
[32:58] on JUNE 9, which would have at
[32:59] least given the community
[33:05] knowledge of what was going on.
[33:07] It's feeling from the
[33:08] neighborhood almost being
[33:10] totally dishonest.
[33:13] I've been involved or I've been
[33:14] active in going to the meetings
[33:15] that are talking about the
[33:18] future of the airport and
[33:19] planning for the airport.
[33:22] And each of those meetings, we
[33:25] were told that a remote tower,
[33:28] if anything, would be
[33:29] administration building, it
[33:31] would basically be technology in
[33:32] an administration building.
[33:35] This proposal is asking for a
[33:37] two-story tower, and we were
[33:41] also told that the tower was
[33:43] supposed to be mainly for
[33:45] safety, that it was not going to
[33:49] bring in increased jet activity.
[33:52] This proposal is saying that it
[33:54] is -- the building or the tower
[33:58] would be seven to eight million
[34:00] dollars or more, and it would be
[34:04] paid for by more activity from
[34:07] private jets and businesses.
[34:09] Interestingly, this proposal is
[34:12] out there right now in AUGUST,
[34:15] which you all know is before the
[34:17] snowbirds come down, the people
[34:23] who live near the airport.
[34:25] My main goal is not about just
[34:26] the people who live near the
[34:28] airport.
[34:31] I live near the airport and I
[34:34] see from NOVEMBER through MARCH,
[34:35] it's just lines of cars.
[34:36] It's about the beach.
[34:38] It's about sharky's.
[34:40] It's about our weather.
[34:43] It's about venice.
[34:47] I can't understand how more jet
[34:51] activity at the airport is going
[34:56] to benefit venice, florida.
[34:59] Let me just see if there's
[34:59] anything.
[35:01] I maybe have a minute.
[35:04] The proposal is exactly the
[35:05] opposite of what we've been told
[35:06] at the meetings.
[35:11] Exactly the opposite.
[35:13] We were told that it was for
[35:16] safety, that it would be maybe
[35:17] two years out.
[35:18] This is right now, and they have
[35:20] written it and they have done it
[35:24] at a time when nobody is here to
[35:24] notice.
[35:27] And I'm asking for this proposal
[35:29] to be withdrawn immediately
[35:32] before it gets put on a schedule
[35:34] for meetings in fall.
[35:35] Thank you.
[35:36] >>Mayor Pachota: thank you for
[35:36] your comments.
[35:38] MADAM Clerk, the next speaker.
[35:39] >>Kelly Michaels: the next
[35:43] speaker is brett spangler and he
[35:49] has five minutes.
[35:50] >>Mayor Pachota: MR. Spangler,
[35:51] good morning and welcome.
[35:52] >> good morning.
[35:53] Welcome back.
[35:58] Hope everybody had a good break.
[35:59] >>Kelly Michaels: sir, you want
[36:00] to pull up a video, is that
[36:02] correct?
[36:05] You're going to play it.
[36:06] Sit in that spot there.
[36:08] And then when you are ready, i
[36:11] will share the screen.
[36:12] >> thank you.
[36:13] In light of the deeply
[36:15] concerning faa grant proposal
[36:17] and slide deck briefing, I
[36:19] realize that nobody in
[36:21] particular is interested in
[36:23] hearing from me.
[36:25] What we all want is answers and
[36:26] accountability from you, the
[36:29] city staff and city council.
[36:32] In that same vein, I compiled
[36:34] video clips from the APRIL 8
[36:36] capital improvement plan
[36:38] workshop and the JUNE 23rd
[36:40] city council meeting regarding
[36:41] the airport.
[36:43] I want to preface that it is not
[36:45] my intent to make enemies here
[36:45] today.
[36:47] I've had the pleasure of
[36:49] speaking with many of you and my
[36:51] gut tells me that you are
[36:52] generally good people and want
[37:09] to do the right thing.
[37:11] >> video: when we say there is
[37:12] misinformation out there, every
[37:14] pr course I ever took or taught,
[37:18] if there's misinformation, it's
[37:19] your fault.
[37:22] Your job is to get out the
[37:22] correct --
[37:25] >> the city is not actively
[37:27] increasing or decreasing
[37:28] operations.
[37:30] >> the festival grounds, and
[37:33] that's actually where we're
[37:35] looking to concentrate where
[37:37] jets would be versus the rest of
[37:38] the airport.
[37:41] One of the plans that we have is
[37:42] to put in this taxiway which
[37:44] would then open that area for
[37:45] that type of development so that
[37:46] jets would be on that side of
[37:49] the airport.
[37:50] If we find the developer who is
[37:52] willing to work with us for a
[37:53] development over on that side of
[37:56] the airport, that we can give
[37:58] them rent credits if they
[38:00] provide the funding to build
[38:02] this taxiway.
[38:04] Currently, the faa and F.D.O.T.
[38:06] Will not participate in a
[38:07] project that is solely for
[38:11] economic development.
[38:12] They'll do it for safety,
[38:13] efficiency, and capacity issues,
[38:15] but they will not do it for an
[38:18] economic reason.
[38:19] Trying to put the creative hat
[38:21] on to find alternative funding.
[38:23] >> we are not actively working
[38:26] on a part 139 compliance.
[38:27] We're on the trajectory of
[38:29] becoming required by the faa to
[38:32] meet the part 139 standard.
[38:35] >> control tower for the airport
[38:37] and that's for fiscal '31.
[38:39] Any questions on the control
[38:44] tower?
[38:47] No questions on that one.
[38:49] >> there are several in
[38:50] operation across the country is
[38:52] my understanding referred to as
[38:53] remote towers.
[38:55] So it's not brick and mortar.
[38:57] They sit in a control room and
[38:58] they direct traffic no different
[39:02] than a tower, but they are not
[39:04] visible on the airport property
[39:06] in terms of brick and mortar.
[39:09] >> this is going to be a pole.
[39:11] >> but in functionality it
[39:12] performs the same function as
[39:15] having a 70-foot control tower.
[39:16] I think that's important.
[39:17] >> that's correct.
[39:20] >> none of us want to see a 75,
[39:21] 80-foot round tube sticking up
[39:23] out on the airport property.
[39:25] >> they don't generate a lot of
[39:26] capital investment revenue.
[39:28] They rely solely -- almost
[39:29] entirely on grants from the
[39:32] state and the faa.
[39:33] So expediting these projects,
[39:36] which is something that we are
[39:39] focused on, will have to happen
[39:40] through these public-private
[39:41] partnerships in order to have
[39:42] that funding available.
[39:45] The way they are programmed now
[39:46] is to make sure we get the state
[39:48] and federal funding that's
[39:48] available.
[39:51] But we are absolutely moving
[39:52] forward with the potential to
[39:53] move these projects up.
[39:54] >> they have different
[39:55] priorities in the community at
[39:56] times.
[39:57] Our priorities are always going
[40:00] to be safety first, period.
[40:01] Financial sustainability second.
[40:03] And working with the community
[40:05] is going to come third.
[40:07] It has to for the interest of
[40:09] the airport.
[40:13] >> after reviewing the faa grant
[40:14] proposal, I can't help but feel
[40:16] we are being misled about city
[40:17] staff's vision for the airport
[40:19] under the guise of promoting
[40:20] safety.
[40:22] My concern, along with hundreds
[40:24] who cannot attend today, is that
[40:25] the actual vision is to pursue
[40:28] as many government grants as
[40:30] possible, attract public-private
[40:32] partnerships to fuel further
[40:33] growth and ultimately generate
[40:36] profits to pay for all the new
[40:38] obligations we acquired with
[40:40] free faa money.
[40:42] The grant proposal and slides
[40:43] taken with the context of
[40:45] capital improvement, the master
[40:47] plan, the city council meetings,
[40:50] makes the vision abundantly
[40:51] clear.
[40:54] This council should rescind and
[40:55] postpone all grants until there
[40:57] is a vision that's voted on by
[41:00] elected officials and puts
[41:02] residents' concerns first, not
[41:04] last.
[41:05] >>Mayor Pachota: thank you for
[41:06] your comments.
[41:08] madam clerk, next speaker.
[41:09] >>Kelly Michaels: the last
[41:10] speaker is jonathan barrett.
[41:11] He has two minutes.
[41:12] >>Mayor Pachota: jonathan
[41:12] barrett.
[41:20] Two minutes.
[41:24] Good morning and welcome.
[41:25] >> good morning.
[41:27] My name is jonathan.
[41:29] This is my first time speaking
[41:30] before the council.
[41:33] I'm here because I care deeply
[41:34] about humphris park, south jetty
[41:36] and continued public access to
[41:37] our shorelines.
[41:39] I understand hurricanes helene
[41:41] and milton caused major damage.
[41:42] I understand the jetty itself is
[41:44] unsafe and I'm not asking the
[41:46] city to reopen damaged
[41:47] infrastructure before it is
[41:48] ready.
[41:49] Nearly two years later, the
[41:52] entire area remains close.
[41:53] With humphris park inaccessible,
[41:54] the next established public
[41:56] beach access south along the
[41:58] shoreline is roughly nine tenths
[41:59] of a mile.
[42:00] That means the closure affects
[42:02] much more than one damaged
[42:02] jetty.
[42:03] It removes access to a
[42:05] substantial stretch of public
[42:06] shoreline that people have used
[42:08] for generations for walking,
[42:10] fishing, surfing, biking and
[42:12] simply getting to the beach.
[42:14] We've seen elsewhere that access
[42:19] and construction can coexist,
[42:21] caspersen beach, repairs
[42:22] continued, county provided
[42:24] temporary bike racks, signage
[42:26] and defined closure.
[42:27] South jetty, controlled access
[42:28] has been possible for
[42:29] contractors and special events.
[42:31] There is historically used route
[42:34] along the gulf side of humphris
[42:36] park toward the sandy beach for
[42:37] access, and also appears to be
[42:39] an existing public access
[42:40] easement farther south that MAY
[42:41] provide another connection to
[42:42] the shoreline.
[42:44] I'm not asking council today to
[42:46] determine exactly where a fence
[42:47] should go or how the access
[42:49] should be configured.
[42:51] I'm asking to you direct staff
[42:53] to look at the existing access
[42:55] points and evaluate an
[42:56] bare-bones solution while the
[42:57] larger repairs continue.
[42:59] Instead of a completely closed
[43:00] space that has become a source
[43:01] of frustration, we have an
[43:02] opportunity to create a safe
[43:04] community driven area that
[43:06] reconnects venice with the
[43:06] shoreline.
[43:08] Humphris park is more than a
[43:08] jetty.
[43:10] Part of venice public shoreline.
[43:12] I believe we should make every
[43:13] reasonable effort to protect it.
[43:14] Thank you.
[43:14] >>Mayor Pachota: thank you for
[43:15] your comments.
[43:16] >>Kelly Michaels: that was the
[43:17] last one.
[43:18] >>Mayor Pachota: with that, we
[43:20] will move on to the consent
[43:24] section of the agenda.
[43:26] All matters listed under consent
[43:27] section are considered routine
[43:29] and enacted by one motion unless
[43:31] an item is removed by a council
[43:32] member.
[43:32] No separation discussion.
[43:34] If a discussion is desired, the
[43:35] item or items will be voted on
[43:37] at the end of the consent
[43:37] section.
[43:38] With that, any council members
[43:40] that would like to remove
[43:41] anything from consent?
[43:42] MR. Howard.
[43:44] >>Rick Howard: I would like to
[43:49] remove 26-0701.
[43:51] >>Mayor Pachota: any other items
[43:53] from any other council members?
[43:54] All right.
[43:55] With that, I will entertain a
[43:57] motion.
[43:58] >>Vice Mayor Boldt: MR. Mayor, I
[44:00] move to approve items on the
[44:01] consent section with the
[44:05] exception of 26-0701.
[44:07] >>Mayor Pachota: seconded by MR.
[44:07] Engelke.
[44:09] All in favor say aye.
[44:10] Anyone opposed?
[44:11] Passes unanimously.
[44:13] [Sounding gavel]
[44:17] We will move on to 26-0701, MR.
[44:19] Howard, you pulled this item, if
[44:20] you would like to briefly
[44:22] introduce it.
[44:23] >>Rick Howard: yeah.
[44:29] This item addresses vital, which
[44:31] I'm not opposed to, but I think
[44:32] in light of everything going on
[44:34] with the airport, we're hearing
[44:37] from residents that I think we
[44:40] need to have all hands on deck,
[44:41] and that includes our airport
[44:43] director, our city manager and
[44:45] staff and council to make sure
[44:48] that we're not getting
[44:52] distracted in focusing on
[44:53] electric flying apparatus from a
[44:55] to b.
[44:55] >>Mayor Pachota: do you have a
[44:57] motion?
[44:58] Hillsborough county hillsborough
[45:00] county I would move that we
[45:05] postpone this mou to a later
[45:12] date, and also that council be
[45:13] provided a more comprehensive
[45:15] understanding of how this would
[45:16] impact the airport itself and
[45:20] also our residents.
[45:21] >>Mayor Pachota: seconded by MR.
[45:21] Smith.
[45:23] MADAM Clerk, do you have anybody
[45:25] signed up to speak?
[45:27] >>Kelly Michaels: no.
[45:27] I don't.
[45:28] >>Mayor Pachota: then we'll move
[45:33] to council discussion.
[45:35] I've got three names on my list
[45:35] right now.
[45:36] MR. Howard, are you good?
[45:38] MR. Boldt?
[45:39] >>Vice Mayor Boldt: yes, thank
[45:41] you.
[45:44] I think I just want to put it on
[45:45] the record that I don't think
[45:47] that I can disagree with MR.
[45:48] Howard on this one.
[45:50] I think we heard enough in
[45:52] public comment already to say
[45:53] nothing of the e-mails that
[45:56] we've received that there's
[45:57] grave concern and there needs to
[45:58] be.
[46:00] So we need to keep our eye on
[46:01] the ball.
[46:03] However, having said that, I
[46:05] also believe it's really
[46:08] important as one of the major
[46:11] small airports in the area that
[46:14] we have a seat at this table
[46:15] ultimately because we don't want
[46:17] the faa coming back to us at
[46:19] some point and saying, okay,
[46:20] this is what we've decided.
[46:22] This is what it's going to be.
[46:25] I think ultimately while it is
[46:26] maybe really important to put
[46:29] this on hold for now, I do hope
[46:31] it will come back to us once
[46:32] things get cleared out a little
[46:34] bit and we have a better
[46:35] understanding, we get closer to
[46:36] the end of the year and our
[46:38] master plan being finished.
[46:40] So that we can make an
[46:41] intelligent decision as to
[46:44] whether we want a seat at this
[46:45] table or not.
[46:47] Firmly, I believe I would rather
[46:49] be at the table than away from
[46:49] the table.
[46:50] Thank you.
[46:51] >>Mayor Pachota: MR. City
[46:53] manager?
[46:54] >>James Clinch: thank you,
[46:54] mayor.
[46:56] Just wanted to kind of clarify
[46:59] what the intent of this mou is.
[47:01] So this is an emerging
[47:02] technology that is coming.
[47:04] Now, it's not coming tomorrow,
[47:06] probably, five, ten years down
[47:07] the road, but it is something
[47:10] that the faa is actively working
[47:11] on.
[47:12] What that means at some point in
[47:14] the future, the faa will be
[47:17] giving us guidance, directives,
[47:20] and eventually mandates on how
[47:21] we need to provide
[47:22] infrastructure for the
[47:22] technology.
[47:24] It is coming.
[47:27] We will be at some point in time
[47:29] mandated to participate in this
[47:32] synergistic across our state.
[47:34] So the purpose of the task force
[47:36] is to sit down with our
[47:40] colleagues at the county level,
[47:42] sarasota airport, our other
[47:43] cities and talk about the
[47:44] questions, because there are a
[47:45] lot of questions out there on
[47:47] how this would work, where the
[47:48] network would be and start
[47:50] getting answers to that
[47:50] question.
[47:52] It doesn't commit us to
[47:52] anything.
[47:53] Doesn't obligate the city to
[47:54] anything.
[47:55] It's just about getting the
[47:57] facts and researching for future
[47:58] planning purposes.
[47:59] Thank you.
[48:04] >>Mayor Pachota: MR. Smith.
[48:05] >>Ron Smith: thank you, mayor.
[48:10] I seconded this because I'm very
[48:11] disappointed.
[48:12] I thought we had the trust of
[48:14] the airport neighbors.
[48:17] Now I feel like we've lost it
[48:17] again.
[48:19] For that reason, I think we
[48:20] shouldn't have something like
[48:21] this on the consent agenda,
[48:22] which means there will be no
[48:23] discussion.
[48:25] So I'm happy for us to discuss
[48:26] it.
[48:27] I'd be happy to hear a
[48:31] presentation about it and
[48:34] perhaps it's something that we
[48:35] will wholeheartedly endorse.
[48:36] But I don't think we can afford
[48:39] to do things without being
[48:41] transparent, without having open
[48:43] discussions about them anymore
[48:44] on airport matters and the
[48:46] environment that we're in.
[48:47] So thank you.
[48:52] >>Mayor Pachota: MS. Frank.
[48:53] >>Rachel Frank: thank you.
[48:54] I agree that potentially this
[48:58] could be a great topic for the
[48:59] hopeful airport workshop that
[49:00] will be approved later on our
[49:01] agenda today.
[49:02] I do have significant concerns
[49:05] that if we do not eventually
[49:08] participate in this task force
[49:10] with the other partners in
[49:11] sarasota, manatee counties that
[49:12] we cannot advocate for the
[49:15] residents who have concerns, as
[49:17] obviously changes in the
[49:20] technology are coming down the
[49:20] pipe.
[49:21] So I would just hope that we
[49:22] would have a seat at the table.
[49:24] And I would hope we would be
[49:25] able to advocate for the
[49:25] residents.
[49:27] And when we are not able to have
[49:31] our staff on the task force to
[49:33] understand what's changing, it
[49:35] puts us at a disadvantage.
[49:36] I agree.
[49:39] As long as we can discuss this
[49:41] in the near future and hopefully
[49:43] give staff's blessing to proceed
[49:48] to be a part of this.
[49:50] >>Kevin Engelke: I agree with my
[49:50] colleagues.
[49:51] We need to have a seat at the
[49:52] table.
[49:54] This is going to be a topic of
[49:56] discussion for the next ten
[49:59] years or maybe five or maybe
[49:59] fifteen.
[50:01] I think it's important that we
[50:04] as a community are in front with
[50:06] the technology, with what could
[50:07] be impacting us.
[50:09] Right now, we have a lot of
[50:10] discussion about the airport.
[50:14] So timing-wise is probably --
[50:16] it's in between, at least for
[50:18] me.
[50:21] I do feel that we need to stay
[50:24] out in front on this, and we
[50:25] need to communicate clearly to
[50:28] everybody in this room and to
[50:29] everybody in our community and
[50:33] the surrounding environment.
[50:35] I think we need to make sure we
[50:37] do not lose this, and my
[50:40] suggestion would be perhaps
[50:47] putting it on the agenda for a
[50:48] topic of discussion shortly.
[50:49] Not within one month, two
[50:51] months, but not six years
[50:51] either.
[50:52] That's kind of where I am.
[50:54] Thanks.
[50:55] >>Mayor Pachota: MR. City
[50:57] manager, I have some questions.
[50:59] So in reviewing the memorandum,
[51:00] my understanding was this was
[51:05] just like any other -- I don't
[51:06] want to say task force because
[51:08] we don't do it very often -- but
[51:10] any other committee we would
[51:11] serve on.
[51:12] When I read the agreement, it
[51:14] said this wasn't going to be
[51:14] binding.
[51:15] It was really just to have our
[51:17] voice and a host of other cities
[51:20] participating all the way from
[51:22] bradenton beach down to city of
[51:23] north port and organizations
[51:26] that don't even have an airport.
[51:28] If you could just clarify for me
[51:30] a little bit better, is this
[51:32] simply just another committee
[51:34] like the hundreds of other
[51:35] committees we have, or is this
[51:38] going to lock us into any -- are
[51:41] we giving the faa guidance on
[51:42] what we want to see?
[51:44] Are we giving staff the ability
[51:45] to communicate for the council
[51:48] as to our wishes for the future?
[51:49] >>James Clinch: you're exactly
[51:50] right.
[51:52] This committee is really so we
[51:55] can go out and get the answers
[51:56] and get the facts on what this
[51:58] future technology is going to
[52:00] look like.
[52:02] Your opinion on the technology
[52:04] for anyone is not really
[52:05] relevant at this point in the
[52:07] game because we don't really
[52:08] even understand what this would
[52:09] mean for venice.
[52:10] This is to work with our
[52:12] partners, to get those answers
[52:13] so we can bring them back.
[52:15] Does not obligate us to any
[52:16] infrastructure.
[52:17] Doesn't obligate us to spend any
[52:19] money on future projects, but
[52:21] those future questions are going
[52:24] to come up is my message to you.
[52:25] Technology whether we
[52:26] participate in the task force or
[52:28] not is not going away.
[52:30] It's going to end up in our lap
[52:32] at some point in the future.
[52:33] My recommendation is, let's be
[52:35] as prepared as we can be when it
[52:36] does come our way.
[52:38] But happy to give a presentation
[52:39] that would make council feel
[52:41] more comfortable with the
[52:42] technology.
[52:42] >>Mayor Pachota: I just want to
[52:44] highlight concerns for my
[52:44] colleagues.
[52:45] To me, this is nothing more than
[52:47] us participating on the council
[52:48] of governments.
[52:50] The tdc, the economic
[52:51] development, all these different
[52:53] committees that we serve on
[52:55] aren't making binding decisions
[52:56] for the council.
[52:57] They are just so we have a voice
[52:58] at the table.
[53:03] I grow concern that I understand
[53:04] how cautious we need to be with
[53:05] the airport and make sure that
[53:07] we're listening to the citizens.
[53:08] I'm just concerned that we're
[53:10] tying two items together that
[53:12] don't necessarily relate to each
[53:13] other.
[53:14] Since I've been on council,
[53:15] we've been talking about seeking
[53:17] grant funding for the tower and
[53:20] I remember, I think it was after
[53:23] covid maybe 2022-ish that we had
[53:25] discussion about pursuing grant
[53:25] funding.
[53:27] It's not something new that just
[53:28] came up yesterday.
[53:30] I don't even see this as an item
[53:32] that relates to that.
[53:33] I'm just concerned that we're
[53:35] going to be lumping everything
[53:37] airport into one silo and lose a
[53:38] seat at the table.
[53:39] That's just my only concern is I
[53:41] don't want us to be absent from
[53:44] any discussions that MAY impact
[53:46] us.
[53:49] MR. Howard.
[53:49] >>Rick Howard: thanks, mayor.
[53:51] I appreciate the comments that
[53:52] my colleagues have made.
[53:55] Trust me, I don't have anything
[53:58] against vitol.
[53:59] It's the future.
[54:00] Kind of star wars if you want to
[54:01] think about it that way.
[54:03] It is a very quiet delivery
[54:03] system.
[54:04] These are electric.
[54:07] I think the ultimate goal will
[54:09] be unmanned so there's no pilot
[54:11] in these things.
[54:12] And they fly from point a to
[54:16] point b with people or products.
[54:18] it takes congestion off the
[54:20] roads.
[54:22] They are relatively quiet.
[54:24] Some are like weed whackers.
[54:27] If you ever heard drones flying
[54:28] around, picture this thing as a
[54:30] big drone.
[54:35] So I'm not opposed to VITOLs
[54:37] and definitely not opposed to
[54:39] having a seat at the table.
[54:41] My focus is more on where the
[54:43] focus is at the airport right
[54:46] now.
[54:49] I want nick and staff to be
[54:52] focused on what my colleague
[54:53] said.
[54:54] It feels like we've lost trust
[54:55] of the community again.
[54:57] And we work really hard.
[54:58] I think it was a great
[54:59] presentation that was given
[55:01] before we went on break, and I
[55:03] think everybody was embracing
[55:05] that.
[55:07] Yeah, our e-mails are blowing
[55:08] up.
[55:10] I read every single one of them.
[55:12] I've spoken to many of our
[55:12] residents.
[55:16] Some are here in the audience
[55:16] today.
[55:19] I think I'm speaking for the
[55:20] entire council and staff.
[55:21] We want to do what's right for
[55:25] the residents and for the
[55:25] airport.
[55:27] There's just a lot of moving
[55:27] parts.
[55:29] I want the focus to be on what's
[55:31] at hand, what's on deck today.
[55:34] I don't want our airport
[55:36] director going to a meeting
[55:38] about a vitol right now.
[55:40] We have bigger fish to fry that
[55:42] we should be focused on, in my
[55:42] opinion.
[55:43] Thank you, mayor.
[55:44] >>Mayor Pachota: okay.
[55:45] With that, MADAM Clerk, if
[55:47] you'll ready us for an
[55:48] electronic vote.
[55:49] Council members, when your
[55:51] lights are flashing, you can
[55:55] indicate your vote.
[55:57] MADAM Clerk, you can tally and
[56:02] display the vote.
[56:04] It passes 5-2.
[56:05] [Sounding gavel]
[56:07] With that we will take a
[56:08] 15-minute and come back at
[56:10] 10:20.
[56:11] [Recess]
[56:32] [Sounding gavel]
[56:33] >>Mayor Pachota: okay.
[56:34] We are back.
[56:37] We are on to public hearings,
[56:38] unfinished business.
[56:39] MADAM Attorney, I believe you
[56:42] have an update for us on this
[56:42] one.
[56:43] >>Kelly m. Fernandez: yes.
[56:44] Yesterday afternoon we received
[56:46] a request from the applicant
[56:47] that the hearing not be held.
[56:49] They would like to revise their
[56:51] application to resolve some of
[56:53] the issues that were brought
[56:54] forward by the appellant.
[56:56] So they are asking that we have
[56:59] this remanded back to staff.
[57:01] >>Mayor Pachota: okay.
[57:02] >>Kelly m. Fernandez: I should
[57:05] also add, I'm sorry, that the
[57:07] appellant is aware of this and
[57:09] staff is aware of this as well
[57:11] and no one has an issue with
[57:11] that outcome.
[57:12] >>Mayor Pachota: with that, I'll
[57:14] move to vacate planning
[57:17] commission order and remand
[57:21] petition 25-40sp back to staff
[57:22] for amendment and further
[57:26] review.
[57:28] Sorry, 26 --- do I have the
[57:32] number right, MADAM Attorney?
[57:36] 25-40sp is the actual
[57:37] application number.
[57:38] >>Mayor Pachota: 25-40sp.
[57:40] Seconded by vice mayor boldt.
[57:42] MADAM Clerk, do you have anybody
[57:43] signed up to speak in.
[57:44] >>Kelly Michaels: no, I don't.
[57:45] >>Mayor Pachota: any council
[57:49] discussion?
[57:50] Seeing none, MADAM Clerk, if
[57:51] you'll ready us for an
[57:53] electronic vote.
[57:54] Council members, when your
[57:55] lights are flashing, you can
[58:00] indicate your vote.
[58:02] Go ahead and tally and display
[58:03] the vote.
[58:04] Passes unanimously.
[58:05] [Sounding gavel]
[58:07] I'll just remind the audience
[58:08] that we can hear everything
[58:10] you're saying up here, including
[58:11] curse words.
[58:13] So please be respectful in the
[58:13] audience.
[58:14] If you're having an issue with
[58:16] the speaker system, get with the
[58:18] clerk's office so we can get you
[58:19] a part of the loop recording
[58:25] system and a speaker box.
[58:30] Do you have a point of order?
[58:33] >> I'd like to restate my vote
[58:36] on our last, my own motion,
[58:39] which I voted on incorrectly.
[58:40] >>Mayor Pachota: so we're back
[58:43] to 26-0701.
[58:43] >> that's correct.
[58:44] >>Mayor Pachota: MADAM Attorney,
[58:47] how would we remedy his wish to
[58:48] restate his vote?
[58:49] >>Kelly m. Fernandez: I actually
[58:51] need to look up robert's rules
[58:53] of order on that to tell you the
[58:54] proper procedure.
[58:55] >>Mayor Pachota: we'll take a
[58:56] five-minute break.
[58:58] We'll be back at 28 after.
[59:09] [Sounding gavel]
[59:11] >>Mayor Pachota: okay.
[59:15] We are back, and MR. Howard has
[59:17] a motion, or you can make a
[59:22] motion, to amend your vote on
[59:22] 26-0701.
[59:24] If you want to make that motion.
[59:25] >>Kelly m. Fernandez: he doesn't
[59:26] have to make a motion.
[59:27] It's really a request.
[59:29] I believe you voted -- you voted
[59:31] no and you intended to vote yes.
[59:32] Is that the situation?
[59:33] So that's his request.
[59:35] If there's no objection from
[59:37] anyone else on council, then his
[59:41] vote can stand as adjusted to
[59:42] the yes versus no.
[59:44] >>Mayor Pachota: any members of
[59:45] council object to MR. Howard's
[59:50] request?
[59:51] Seeing none, let the record
[59:52] reflect that MR. Howard is
[59:54] voting in favor of the motion,
[59:59] so it is a 6-1.
[1:00:00] >>Rick Howard: I would like to
[1:00:01] apologize to everyone in the
[1:00:03] chambers and everyone listening.
[1:00:07] Sometimes passion creates
[1:00:09] freudian slips and I just had
[1:00:09] one.
[1:00:12] >>Mayor Pachota: moving on now,
[1:00:14] we will go to ordinances final
[1:00:18] reading, ordinance number
[1:00:18] 2026-22.
[1:00:20] The public hearing is now open.
[1:00:23] [Sounding gavel]
[1:00:25] MADAM Clerk, when you're ready,
[1:00:27] if you can go ahead and read
[1:00:29] this by title only, please.
[1:00:30] >>Kelly Michaels: an ordinance
[1:00:31] of the city of venice, florida,

[1:00:34] chapter 87, land development
[1:00:36] code, by amending section 2.4.3,
[1:00:40] residential uses, adding section
[1:00:41] 6.11, certified recovery

[1:01:02] regulations; providing for
[1:01:03] repeal of all ordinances in
[1:01:05] conflict herewith, providing for
[1:01:06] severability, and providing an
[1:01:08] effective date.
[1:01:09] >>Mayor Pachota: do we have any
[1:01:10] written communication since the
[1:01:12] last hearing?
[1:01:13] >>Kelly Michaels: no.
[1:01:14] >>Mayor Pachota: all right.
[1:01:15] Is there an update from staff
[1:01:20] since the last hearing?
[1:01:20] >> [Inaudible]
[1:01:21] >>Mayor Pachota: okay.
[1:01:23] MADAM Clerk, anybody signed up
[1:01:24] to speak?
[1:01:25] >>Kelly Michaels: no.
[1:01:26] >>Mayor Pachota: the public
[1:01:27] hearing is now closed.
[1:01:28] [Sounding gavel]
[1:01:31] I'll entertain a motion.
[1:01:33] >>Vice Mayor Boldt: I move that
[1:01:34] ordinance 2026-22 be approved
[1:01:36] and adopted.
[1:01:38] >>Mayor Pachota: seconded by MR.
[1:01:38] Engelke.
[1:01:41] Any council discussion?
[1:01:42] Seeing none, MADAM Clerk, if
[1:01:43] you'll ready us for an
[1:01:44] electronic vote.
[1:01:45] Council members, when your
[1:01:46] lights are flashing, you can
[1:01:50] indicate your vote.
[1:01:53] MADAM Clerk, you can tally and
[1:01:54] display the vote.
[1:01:55] Passes unanimously.
[1:01:59] [Sounding gavel]
[1:02:04] We will move on to ordinance
[1:02:04] 2026-23.
[1:02:06] The public hearing is now open.
[1:02:06] [Sounding gavel]
[1:02:07] MADAM Clerk, when you're ready,
[1:02:08] you can go ahead and read this
[1:02:10] ordinance by title only.
[1:02:11] >>Kelly Michaels: an ordinance
[1:02:12] of the city of venice, florida,
[1:02:14] amending the code of ordinances
[1:02:16] chapter 87, land development
[1:02:18] code by amending section 1.9.3
[1:02:19] specific application
[1:02:20] requirements, amending and
[1:02:23] renumbering section 1.10,
[1:02:26] preliminary plat (Quasi-judicial
[1:02:29] application), amending section

[1:03:35] development code, providing for
[1:03:37] repeal of all ordinances in
[1:03:39] conflict herewith, providing for
[1:03:40] severability, and providing an
[1:03:43] effective date.
[1:03:43] >>Mayor Pachota: MADAM Clerk,
[1:03:45] have we received any written
[1:03:47] communication since last
[1:03:48] hearing?
[1:03:48] >>Kelly Michaels: none.
[1:03:49] >>Mayor Pachota: do we have a
[1:03:50] staff update on this one?
[1:03:51] >>James Clinch: no, sir, unless
[1:03:52] there are any questions.
[1:03:54] >>Mayor Pachota: I actually do
[1:03:57] have some questions, specific to
[1:03:59] the signage, temporary signs and
[1:04:07] such.
[1:04:08] >> good morning.
[1:04:11] For the record, nicole tremblay,
[1:04:13] senior planner for the city of
[1:04:13] venice.
[1:04:14] What questions do you have?
[1:04:15] >>Mayor Pachota: I was waiting
[1:04:17] for the introduction.
[1:04:19] I received some feedback as it
[1:04:20] relates to, sounds like it is
[1:04:22] political sign related, we're in
[1:04:24] political season so it makes
[1:04:27] sense, that our code is more
[1:04:31] strict than sarasota county and
[1:04:31] manatee county.
[1:04:32] I'm curious.
[1:04:34] It sounds like we have a square
[1:04:36] footage based on the size of the
[1:04:38] building and some things that
[1:04:41] make it a little bit
[1:04:41] complicated.
[1:04:42] I wanted to see if we could
[1:04:44] discuss that and if there's any
[1:04:46] merit to the idea of being a
[1:04:49] little closer to the county code
[1:04:51] so as to avoid confusion during
[1:04:52] this time.
[1:04:55] One of the big reasons that --
[1:04:57] I'll say this carefully -- one
[1:05:00] of the reasons that we went
[1:05:01] along with the voter referendum
[1:05:03] and kind of changed our terms
[1:05:06] and when they coincide, it was a
[1:05:07] lower-hanging fruit but it was
[1:05:10] because we go through this every
[1:05:11] year where there are political
[1:05:12] signs all over town.
[1:05:13] It was going to be nice to have
[1:05:14] a little time off.
[1:05:17] At the same time, I don't want
[1:05:18] to reduce anybody's freedom or
[1:05:21] ability to properly advertise
[1:05:23] their campaign so that we're
[1:05:26] being more strict than somebody
[1:05:26] else.
[1:05:28] >>Nicole Tremblay: okay.
[1:05:30] I don't know the county's code
[1:05:32] off the top of my head.
[1:05:33] But the sign standards related
[1:05:35] to the size of the building and
[1:05:36] things like that are for
[1:05:37] permanent signs.
[1:05:42] So a temporary sign, now, they
[1:05:44] are not explicitly political
[1:05:47] because we're not able to
[1:05:49] determine the content that way.
[1:05:53] But the temporary signs, it says
[1:05:56] MAY not exceed three square feet
[1:05:59] for residential property or --
[1:06:02] you know what, I apologize.
[1:06:04] Put it at a nonresidential
[1:06:05] property, you do have one square
[1:06:07] foot per linear foot of
[1:06:07] building.
[1:06:08] We typically see them in
[1:06:09] residential.
[1:06:10] I apologize.
[1:06:11] Can I look up the county's code
[1:06:17] and bring it back.
[1:06:18] Either later today or at the
[1:06:19] next meeting.
[1:06:20] >>Mayor Pachota: I would ask
[1:06:22] you, is it better for us
[1:06:23] procedurally to get through,
[1:06:23] because there are a lot of
[1:06:25] things on this that I would like
[1:06:26] to see us get through.
[1:06:28] Perhaps I put this on the agenda
[1:06:29] to readdress the specific item
[1:06:30] at another meeting.
[1:06:31] >>Nicole Tremblay: that would be
[1:06:33] fine with me if we want to pull
[1:06:34] just this item and talk about it
[1:06:35] again later.
[1:06:35] >>Mayor Pachota: I'm okay with
[1:06:36] doing that.
[1:06:38] I'll put it on a future agenda.
[1:06:40] I just wanted to make sure that,
[1:06:41] you know, I don't want to stop
[1:06:42] the train on some of these other
[1:06:44] things that are pretty common
[1:06:44] sense.
[1:06:46] On this particular one, I have
[1:06:48] received feedback and I want to
[1:06:49] make sure that we at least
[1:06:51] address the feedback in a proper
[1:06:53] way, whether, it's, no, we like
[1:06:54] being more strict or whether we
[1:06:56] want to come in line with the
[1:06:58] county's code, whatever it might
[1:06:59] be, I want to make sure we do
[1:07:00] that properly and give the
[1:07:01] residents an opportunity to
[1:07:04] speak to it.
[1:07:04] >>Nicole Tremblay: that is fine
[1:07:06] with me.
[1:07:08] >>Roger Clark: roger clark,
[1:07:09] planning and zoning director.
[1:07:10] I want to make sure i
[1:07:11] understand.
[1:07:12] You're going to pull this
[1:07:13] individual amendment and let the
[1:07:16] other ones be approved?
[1:07:18] If that's your plan, I have a
[1:07:19] little issue with that because
[1:07:22] that's going to eliminate the 90
[1:07:23] days that this is changing to,
[1:07:25] which I know is something that
[1:07:26] was originally requested.
[1:07:28] >>Mayor Pachota: so my plan was
[1:07:30] actually to let this go the way
[1:07:33] it is, and then just kind of put
[1:07:35] you on notice gently that I'm
[1:07:38] going to bring this back at
[1:07:39] another agenda so we can talk
[1:07:41] about finite details of that
[1:07:42] specific piece of the code and
[1:07:43] make some changes to that.
[1:07:45] I don't want to delay the
[1:07:45] process.
[1:07:47] I don't see the need since we're
[1:07:49] on our second hearing and kind
[1:07:50] of at the finish line.
[1:07:52] I do want to readdress this
[1:07:54] since it's now been brought up.
[1:07:56] I'll put it on the next agenda
[1:07:57] and we can isolate that
[1:07:57] particular item.
[1:07:59] As far as today, I would like to
[1:08:02] move forward as is with all of
[1:08:04] us on the same page now, that I
[1:08:06] have had some conversation, and
[1:08:08] we do need to look at it a
[1:08:09] little tighter.
[1:08:10] >>Roger Clark: I understand.
[1:08:11] I don't want to lose that 90
[1:08:13] days we put in place.
[1:08:13] >>Mayor Pachota: I don't want to
[1:08:14] stop the train.
[1:08:15] I want to make sure I'm on the
[1:08:17] record for saying I received
[1:08:18] some feedback and I think we
[1:08:20] need to address it at a later
[1:08:21] date.
[1:08:21] >>Nicole Tremblay: thank you.
[1:08:22] >>Roger Clark: thank you.
[1:08:23] >>Mayor Pachota: okay.
[1:08:25] With that, anyone else have any
[1:08:29] questions of staff? Okay.
[1:08:30] madam clerk, do you have anybody
[1:08:32] signed up to speak?
[1:08:32] >>Kelly Michaels: no.
[1:08:33] >>Mayor Pachota: with that,
[1:08:34] we'll close the public hearing.
[1:08:36] I'll go ahead and move that
[1:08:38] ordinance 2026-23 be approved
[1:08:39] and adopted.
[1:08:42] Seconded by MR. Howard.
[1:08:45] Any council discussion?
[1:08:46] Seeing none, MADAM Clerk, if
[1:08:48] you'll make us ready for an
[1:08:48] electronic vote.
[1:08:49] Council members, when your
[1:08:51] lights are flashing, you can
[1:08:53] indicate your vote.
[1:08:55] MADAM Clerk, you can tally and
[1:08:56] display the vote.
[1:08:57] Passes unanimously.
[1:09:06] [Sounding gavel]
[1:09:06] Okay.
[1:09:09] We are now on to new business
[1:09:10] ordinances.
[1:09:12] Ordinance 2026-24.
[1:09:14] MADAM Clerk, when you are ready,
[1:09:15] you can go ahead and read this
[1:09:16] ordinance by title only, please.
[1:09:18] >>Kelly Michaels: an ordinance
[1:09:19] amending city of venice
[1:09:22] ordinance number 2025-32 as
[1:09:23] previously amended which adopted
[1:09:24] the official budget of the city
[1:09:25] of venice, florida, for the
[1:09:27] fiscal year beginning OCTOBER 1,
[1:09:30] 2025, and ending SEPTEMBER 30,
[1:09:32] 2026, by increasing the total
[1:09:36] revenue by 6,476,400 and total
[1:09:41] expenditures by 6,476,400, and
[1:09:43] providing an effective date.
[1:09:44] >>Mayor Pachota: MADAM Clerk, do
[1:09:46] you have anybody signed up to
[1:09:46] speak?
[1:09:47] >>Kelly Michaels: no.
[1:09:48] >>Mayor Pachota: with that, I'll
[1:09:51] entertain a motion.
[1:09:52] >>Kevin Engelke: I move to
[1:09:54] approve ordinance 2026-24 on
[1:09:56] first reading and schedule it
[1:09:58] for final reading.
[1:09:59] >>Mayor Pachota: seconded by
[1:10:00] vice mayor boldt.
[1:10:02] Any council discussion?
[1:10:03] Seeing none, MADAM Clerk, if
[1:10:05] you'll make us ready for an
[1:10:06] electronic vote.
[1:10:06] Council members when your lights
[1:10:09] are flashing, you MAY indicate
[1:10:10] your vote.
[1:10:12] MADAM Clerk, you can tally and
[1:10:13] display the vote.
[1:10:14] Passes unanimously.
[1:10:22] [Sounding gavel]
[1:10:22] All right.
[1:10:24] We are on to resolutions,
[1:10:29] resolution number 2026-15.
[1:10:31] MADAM Clerk, when you're ready,
[1:10:32] you can go ahead and read this
[1:10:34] resolution by title only,
[1:10:34] please.
[1:10:35] >>Kelly Michaels: a resolution
[1:10:36] of the city of venice, florida,
[1:10:38] accepting utilities and
[1:10:40] improvements installed by
[1:10:41] southwest florida retirement
[1:10:43] center inc. And accepting a
[1:10:44] one-year developers maintenance
[1:10:46] bond and bill of sale, providing
[1:10:47] an effective date.
[1:10:48] >>Mayor Pachota: MADAM Clerk, do
[1:10:49] you have anybody signed up to
[1:10:50] speak?
[1:10:50] >>Kelly Michaels: no.
[1:10:51] >>Mayor Pachota: all right.
[1:10:53] Then with that, I'll entertain a
[1:10:55] motion.
[1:10:56] MR. Vice mayor.
[1:10:58] >>Vice Mayor Boldt: I move
[1:10:59] resolution 2026-15 be approved

[1:11:09] Any council discussion?
[1:11:10] Seeing none, MADAM Clerk, if
[1:11:11] you'll ready us for an

[1:11:17] indicate your vote.
[1:11:19] MADAM Clerk, you can tally and
[1:11:21] display the vote.
[1:11:22] passes unanimously.
[1:11:26] [Sounding gavel]
[1:11:28] We are now on to presentations.
[1:11:32] Presentation 26-0702, and this
[1:11:33] is finance director linda senne
[1:11:36] with the quarterly financial
[1:11:37] update.
[1:11:38] MS. Senne, if you would like to
[1:12:02] come down.
[1:12:21] >>Linda Senne: good morning,
[1:12:21] mayor and council.
[1:12:22] Linda senne.
[1:12:23] Finance director.
[1:12:26] This is the quarterly financial
[1:12:28] report as of JUNE 30, so nine
[1:12:33] months into fiscal year '26.
[1:12:35] As of today, number one on
[1:12:36] there, the property tax revenue.
[1:12:39] We collected 100% of our budget
[1:12:41] amount at this point in time,
[1:12:43] which is -- we always generally
[1:12:45] collect our money by JUNE 30 for
[1:12:46] the property taxes for the
[1:12:47] fiscal year.
[1:12:50] The fire and insurance premium
[1:12:53] tax, which is the number 2, is
[1:12:54] as of now zero.
[1:12:55] We generally get that money in
[1:12:57] AUGUST or later in SEPTEMBER.
[1:13:02] So that shows zero collections.
[1:13:04] Our communication taxes is
[1:13:05] slightly above.
[1:13:07] 74 -- slightly below at 74
[1:13:07] percent.
[1:13:09] At this point in time, we should
[1:13:10] be at 75 percent.
[1:13:13] That's just slightly below.
[1:13:15] The utility service tax is
[1:13:16] slightly -- that's the one that
[1:13:18] is above at 82%.
[1:13:20] That's the number four.
[1:13:23] 82% at this point in time.
[1:13:25] The franchise fees are at 81%,
[1:13:31] which is the number 5.
[1:13:36] Licenses and permits are below
[1:13:36] target.
[1:13:43] They are at 239,000 -- 239,625.
[1:13:45] The majority is business tax
[1:13:48] receipts, makes up 29805.
[1:13:49] Majority of those licenses come
[1:13:50] in AUGUST and SEPTEMBER.
[1:13:51] That's again where we get the
[1:13:54] money in AUGUST and SEPTEMBER
[1:13:55] for business tax receipts, and
[1:13:57] then the other bigger part is
[1:13:59] the zoning and permit
[1:14:03] certifications which makes up
[1:14:07] 168,048 at this point in time.
[1:14:08] 7, the investment income.
[1:14:12] We are higher above than what we
[1:14:13] -- sorry.
[1:14:16] The 7 is the intergovernmental
[1:14:17] revenues.
[1:14:19] And the city received for the
[1:14:24] first year $265,000 under an ice
[1:14:25] agreement that we have.
[1:14:28] We also received $298,000 from
[1:14:31] fema as reimbursements that are
[1:14:33] due to hurricane ian and milton.
[1:14:34] Some of those are way back from
[1:14:35] hurricane ian.
[1:14:36] So that goes to show you how
[1:14:38] long it takes sometimes to get
[1:14:41] our money reimbursed from fema.
[1:14:44] And then also state revenue
[1:14:46] sharing is on target, slightly
[1:14:50] above at 76%, and the government
[1:14:51] half-cent sales tax is right on
[1:14:52] target at 75%.
[1:14:55] And those are all the number
[1:14:57] sevens that you see in red.
[1:15:00] And then for charges for
[1:15:01] services, they are slightly
[1:15:05] below target at 74%, and the ems
[1:15:08] transport fees are right at 74%
[1:15:16] also.
[1:15:18] Number 9 is the investment
[1:15:19] earnings.
[1:15:20] So we are above target at this
[1:15:21] point in time.
[1:15:22] We collected more than what we
[1:15:27] have budgeted for this.
[1:15:29] We budgeted, so we're above that
[1:15:30] dollar amount by hundred
[1:15:32] percent.
[1:15:34] For miscellaneous revenues for
[1:15:36] the first nine months we're
[1:15:37] already above the budgeted
[1:15:39] amount for the entire year.
[1:15:41] The second quarter, which was in
[1:15:43] the MARCH quarter is when we
[1:15:44] received the contribution from
[1:15:47] the venice pier group and then
[1:15:48] also our other miscellaneous
[1:15:50] revenue includes a bank rebate
[1:15:53] of almost $67,000 that we get
[1:15:54] for the city using the
[1:15:55] purchasing card.
[1:15:57] We get a rebate back from the
[1:15:59] bank when we use our p-card.
[1:16:03] Also, we had $87,000 of
[1:16:04] insurance settlements this year
[1:16:06] so far.
[1:16:11] General fund expenses, they are
[1:16:12] projected at where we expect
[1:16:15] them to be at this point in
[1:16:15] time.
[1:16:16] They are tracking well.
[1:16:17] There's only one department.
[1:16:19] That's the one we have in pink,
[1:16:22] which that was also noted on the
[1:16:22] last quarterly report that
[1:16:24] exceeds the 75% target.
[1:16:26] That's due to the $5 million
[1:16:28] that we paid to sarasota county
[1:16:31] for the wellfield park.
[1:16:34] I'll go back to this page, the
[1:16:35] ending fund balance of SEPTEMBER
[1:16:39] 30 of '25 was 35.3 million.
[1:16:43] That's this number right here.
[1:16:46] That was SEPTEMBER 30 of '25,
[1:16:48] and we had project rollover of
[1:16:48] 2.1.
[1:16:51] So at the end of fiscal '26,
[1:16:54] we're expecting that the fund
[1:16:56] balance will be up to 29
[1:16:58] million.
[1:16:59] And then I'm just going to make
[1:17:01] a note, when you see the
[1:17:04] proposed budget of that net
[1:17:05] revenues, on the far right
[1:17:06] column, the negative 800,000,
[1:17:08] that's what we had at the
[1:17:09] proposed budget when we did the
[1:17:12] proposed budget, that was for
[1:17:13] the $800,000 transfer into the
[1:17:16] new fleet and operating fund
[1:17:17] we're going to make.
[1:17:19] When I'm talking this afternoon
[1:17:21] or the next part when I talk
[1:17:22] about the changes since then,
[1:17:24] this is the number that slightly
[1:17:26] changes, just so you're aware.
[1:17:28] You won't see this whole thing,
[1:17:29] unless you want me to bring it
[1:17:31] back up again when I go over the
[1:17:32] changes for the proposed budget
[1:17:34] that's later on the agenda.
[1:17:35] The $800,000 number is the final
[1:17:37] number that changes.
[1:17:38] When I'm talking about the
[1:17:39] change, that will be the change.
[1:17:41] When you see the net revenues
[1:17:42] number, it's slightly different
[1:17:45] than the $800,000 now for the
[1:17:49] fiscal '27 proposed budget.
[1:17:52] Any questions to date on the
[1:17:53] general fund?
[1:17:57] >>Mayor Pachota: MR. Smith.
[1:18:00] >>Ron Smith: thank you, mayor.
[1:18:01] Thank you for that report.
[1:18:04] It's a lot to take in, and I
[1:18:06] look forward to the discussion
[1:18:08] later, what's changed with the
[1:18:09] funding of these positions that
[1:18:12] we wanted to add.
[1:18:14] But my question is something
[1:18:17] I've asked before about the fema
[1:18:17] money.
[1:18:20] You say more came in.
[1:18:21] If I understand correctly,
[1:18:23] there's still a whole bunch more
[1:18:24] we're hoping to get.
[1:18:26] Could you talk about that?
[1:18:28] I think in the next budget we
[1:18:31] didn't show any revenue from
[1:18:32] fema because we can't be sure
[1:18:34] it's coming, but you told me
[1:18:36] there was a big number we're
[1:18:37] hoping to get.
[1:18:39] Was this another number, the
[1:18:41] money we just got from fema, is
[1:18:42] that something that we didn't
[1:18:44] budget this year?
[1:18:45] >>Linda Senne: correct.
[1:18:46] It was not budgeted.
[1:18:47] We don't generally budget
[1:18:49] because we're not sure if we get
[1:18:50] any money.
[1:18:53] We submit projects, and then
[1:18:56] they, like with the ian project,
[1:18:57] three years ago.
[1:18:59] So then they determine whether
[1:19:00] they are going to fund the
[1:19:02] project or not.
[1:19:04] So we don't budget generally for
[1:19:05] that revenue.
[1:19:06] Not sure if we're going to
[1:19:08] actually get reimbursed for it.
[1:19:10] >>Ron Smith: right, the money we
[1:19:12] did just get, it wasn't budgeted
[1:19:13] and it changes how much we need
[1:19:16] to find in the budget to fund
[1:19:17] these changes we wanted to make,
[1:19:18] is that correct?
[1:19:19] >>Linda Senne: well, that
[1:19:21] increases the bottom line when I
[1:19:23] say the estimated dollar amount.
[1:19:25] Because when we did the report
[1:19:29] in MARCH, I estimated that the
[1:19:31] fund balance would be 28.4
[1:19:32] million.
[1:19:34] Now I'm estimating it will be 29
[1:19:35] million.
[1:19:36] Because we have the revenue
[1:19:37] increase --
[1:19:38] >>Ron Smith: rolling that money
[1:19:40] over into the reserve.
[1:19:40] >>Linda Senne: correct.
[1:19:41] >>Ron Smith: rather than using
[1:19:42] it for.
[1:19:44] >>Linda Senne: correct, correct.
[1:19:47] So it increases your ending
[1:19:48] savings reserve amount.
[1:19:50] Because when I did the -- when I
[1:19:52] did this in MARCH, my estimate
[1:19:55] at that time was 28.4 million.
[1:19:58] Now the estimate is going to be
[1:20:00] 29.1 million.
[1:20:01] >>Ron Smith: just banking it is
[1:20:03] what you're telling me.
[1:20:05] >>Linda Senne: correct.
[1:20:07] >>Ron Smith: could you tell me
[1:20:08] again at this point since that
[1:20:10] now changed, how much money
[1:20:11] we're hoping to get still from
[1:20:14] fema, even though we have no
[1:20:15] guarantees we're in the process
[1:20:17] of trying to get repaid for work
[1:20:17] we did.
[1:20:19] >>Linda Senne: we got reimbursed
[1:20:21] for all the -- which went into
[1:20:22] the solid waste fund for the
[1:20:23] debris.
[1:20:24] We got reimbursed for debris.
[1:20:28] That's all done for ian and for
[1:20:29] milton and for helene.
[1:20:31] All that money reimbursed.
[1:20:32] But that went into the solid
[1:20:33] waste fund because the expenses
[1:20:35] came out of the solid waste
[1:20:38] fund, picking up the debris.
[1:20:41] Maybe another one to two million
[1:20:44] max, but it doesn't all go in
[1:20:45] the general fund.
[1:20:46] Some of it is utilities fund and
[1:20:49] some could be stormwater fund.
[1:20:50] Probably one to two million,
[1:20:52] maybe, at the high end.
[1:20:53] >>Ron Smith: thank you.
[1:20:56] >>Mayor Pachota: MS. Frank.
[1:20:57] >>Rachel Frank: thank you.
[1:20:59] Could you expound a little bit
[1:21:03] on the stormwater fund 480,
[1:21:06] particularly because I believe
[1:21:07] it's healthy reserve, according
[1:21:09] to your memo here, on page 6, it
[1:21:12] talks about the non-earmarked
[1:21:13] working capital balance dropping
[1:21:14] to 5.2 million.
[1:21:16] But you say it's still well
[1:21:17] above target levels.
[1:21:19] Just because I believe it
[1:21:22] potentially could be germane to
[1:21:23] our conversation later about
[1:21:25] curry creek, deer town gully,
[1:21:27] update on all of those efforts.
[1:21:30] I just want to fully understand
[1:21:32] where our stormwater fund is at
[1:21:35] and maybe what you mean about
[1:21:39] well above target levels.
[1:21:40] >>Linda Senne: let me pull that
[1:21:41] fund up.
[1:21:43] Stormwater.
[1:21:47] Stormwater, they have had --
[1:21:48] because they are in the middle
[1:21:50] of some of the projects that
[1:21:52] aren't encumbered yet, but they
[1:21:52] have some projects that they are
[1:21:56] working on, but when you look at
[1:21:58] this part right up here, when
[1:22:01] you see expenses to date for
[1:22:04] some of these projects, there is
[1:22:10] no money yet spent to date for
[1:22:11] some of the stormwater projects.
[1:22:13] So at the end, when you look at
[1:22:16] the overall fund, when we say
[1:22:19] it's above target because we
[1:22:20] estimate -- they are estimating
[1:22:22] at the end of fiscal '26 what
[1:22:25] we're expecting, that the
[1:22:27] working capital would be we have
[1:22:29] 5.2 total expenses and then with
[1:22:32] an estimate of 2.9 million that
[1:22:35] would be basically in reserves
[1:22:37] that they could use for other
[1:22:37] projects.
[1:22:40] That's what we're expecting at
[1:22:42] the end of SEPTEMBER.
[1:22:42] >>Rachel Frank: okay.
[1:22:45] In the memo it says 2.9 million
[1:22:47] is earmarked for water quality
[1:22:47] projects.
[1:22:49] You're saying separate than that
[1:22:51] earmark you believe --
[1:22:52] >>Linda Senne: I say earmarked
[1:22:53] for water quality because
[1:22:54] everything in the stormwater has
[1:22:56] to go to stormwater projects.
[1:22:58] It can't be spent on some other
[1:22:59] projects.
[1:23:01] We say the dollar amount, 2.9
[1:23:03] million, that's above our
[1:23:04] required reserve is available
[1:23:06] for water projects.
[1:23:08] Any stormwater-type project.
[1:23:09] >>Rachel Frank: very helpful.
[1:23:14] Thank you, linda.
[1:23:16] >>Mayor Pachota: MR. Engelke,
[1:23:18] did you have your hand up?
[1:23:19] Looks like it.
[1:23:22] Thank you so much.
[1:23:23] MADAM Clerk, do you have anybody
[1:23:25] signed up to speak on this?
[1:23:26] >>Kelly Michaels: no.
[1:23:27] >>Mayor Pachota: okay.
[1:23:29] Then we will move on to council
[1:23:35] action and discussion, 26-0703.
[1:23:36] This is to appoint a member to
[1:23:37] the citizens tax oversight
[1:23:39] committee to serve a term from
[1:23:43] SEPTEMBER 1, 2026, to AUGUST
[1:23:47] 31 -- do you have any more
[1:23:49] introduction than that?
[1:23:52] Anybody signed up to speak?
[1:23:53] >>Kelly Michaels: no.
[1:23:54] >>Mayor Pachota: do I have a
[1:23:54] council member that would like
[1:23:57] to make a motion?
[1:23:58] >>Vice Mayor Boldt: MR. Mayor, I
[1:24:02] move to appoint peyton dewitt to
[1:24:03] the citizens tax oversight
[1:24:05] committee to serve a term from
[1:24:08] SEPTEMBER 1, 2026 to AUGUST 31,
[1:24:09] 2030.
[1:24:10] >>Mayor Pachota: I'll second
[1:24:11] that.
[1:24:12] With that, any council
[1:24:16] discussion?
[1:24:18] Seeing none, MADAM Clerk, if
[1:24:19] you'll make us ready for an
[1:24:20] electronic vote.
[1:24:21] Council members, when your
[1:24:23] lights are flashing, you can
[1:24:25] indicate your vote.
[1:24:27] MADAM Clerk, you can tally and
[1:24:28] display.
[1:24:29] Passes unanimously.
[1:24:30] [Sounding gavel]
[1:24:33] Thank you to peyton dewitt for
[1:24:34] volunteering for that.
[1:24:38] We will move on to 26-0704.
[1:24:41] And this is appoint two members
[1:24:42] to the historic and
[1:24:43] architectural preservation board
[1:24:45] to serve a term from SEPTEMBER
[1:24:47] 1, 2026, to AUGUST 31, 2029.
[1:24:49] MADAM Clerk, did you have
[1:24:51] anything in addition to add to
[1:24:51] that.
[1:24:52] >>Kelly Michaels: I don't.
[1:24:53] >>Mayor Pachota: okay.
[1:24:55] Do we have anybody signed up to
[1:24:55] speak?
[1:24:55] >>Kelly Michaels: no.
[1:24:56] >>Mayor Pachota: I will
[1:24:57] entertain a motion from a
[1:24:59] council member.
[1:25:00] >>Rick Howard: move to appoint
[1:25:03] jean trammell to the historic
[1:25:04] and architectural preservation
[1:25:07] board to serve a term from
[1:25:09] SEPTEMBER 1 of '26 to AUGUST 31
[1:25:16] of '29.
[1:25:19] Give me a minute.
[1:25:19] >>Mayor Pachota: how many
[1:25:22] minutes do you need?
[1:25:28] >> move to appoint john steckty
[1:25:29] to the historic and
[1:25:30] architectural preservation board
[1:25:31] to serve a term from SEPTEMBER
[1:25:34] 1, '26 to AUGUST 31 of 2029.
[1:25:36] >>Mayor Pachota: I'll second it.
[1:25:37] With that, any council
[1:25:40] discussion?
[1:25:42] MADAM Clerk, we have a proper
[1:25:44] motion of both names and a
[1:25:45] proper second.
[1:25:47] We can go ahead and take an
[1:25:47] electronic vote.
[1:25:48] Council members, when your
[1:25:50] lights are flashing, you can
[1:25:52] indicate your vote.
[1:25:54] You can tally and display the
[1:25:55] vote.
[1:25:55] Passes unanimously.
[1:25:58] [Sounding gavel]
[1:26:00] We'll go ahead and take a
[1:26:06] seven-minute break and return --
[1:26:07] [Inaudible]
[1:26:19] [Sounding gavel]
[1:26:19] >>Mayor Pachota: okay.
[1:26:21] We are back.
[1:26:24] If I can get everyone to quiet
[1:26:31] down for me, we are at 26-0705,
[1:26:32] which is airport workshop
[1:26:33] scheduling.
[1:26:35] That is the next item on the
[1:26:35] agenda.
[1:26:36] MR. City manager, if you would
[1:26:38] like to introduce the topic,
[1:26:39] please.
[1:26:40] >>James Clinch: thank you,
[1:26:40] mayor.
[1:26:41] As you know, we have a couple of
[1:26:45] things happening at the airport
[1:26:45] this fall.
[1:26:48] We are actively working towards
[1:26:50] the finalization of our master
[1:26:50] plan.
[1:26:52] It is almost done.
[1:26:54] It will end up being about three
[1:26:57] years in the making.
[1:26:58] We've gone above and beyond the
[1:26:59] number of public meetings
[1:27:01] required and we'll be picking
[1:27:03] the public meetings back up in
[1:27:03] OCTOBER.
[1:27:05] I think it's very important,
[1:27:07] today is a great demonstration
[1:27:09] of that, that we do everything
[1:27:11] we can to get the real story out
[1:27:13] there, make sure everyone feels
[1:27:15] informed and clear up any
[1:27:16] questions that there are related
[1:27:18] to the airport.
[1:27:19] And there's just, unfortunately,
[1:27:22] a lot of things happening at the
[1:27:22] same time.
[1:27:24] I appreciate that.
[1:27:25] And I recognize the concerns
[1:27:27] that come along with that.
[1:27:29] The flip side is, we, as you all
[1:27:32] know, are stewards of the
[1:27:34] airport and subject to the faa
[1:27:35] federal regulations.
[1:27:38] So with that, comes a lot of
[1:27:39] restrictions to our authority.
[1:27:42] So the purpose of this workshop
[1:27:44] would be before we kick off the
[1:27:46] public meetings to finish the
[1:27:47] master plan, I'd like to bring
[1:27:51] in our aviation attorney, chris
[1:27:51] wilson.
[1:27:53] He is an expert on aviation law.
[1:27:56] He is a teacher at embry-riddle
[1:27:58] university, and he can speak to
[1:28:02] the faa rules and regulations
[1:28:02] firsthand.
[1:28:03] I had the privilege of meeting
[1:28:05] with the faa in person about a
[1:28:06] month ago.
[1:28:07] The first time I had that
[1:28:09] privilege and hearing from them
[1:28:10] firsthand what we can do and
[1:28:12] what we can't do was very
[1:28:13] eye-opening.
[1:28:16] So I believe bringing MR. Wilson
[1:28:18] here to speak to those
[1:28:20] regulations will give you all a
[1:28:22] much better idea of what our
[1:28:23] authorities are, our
[1:28:26] capabilities are as we move
[1:28:27] towards closing out this master
[1:28:28] plan.
[1:28:28] It's going to be a very
[1:28:30] difficult process to bring this
[1:28:30] to a close.
[1:28:34] I think we all recognize that.
[1:28:37] Just because there are these faa
[1:28:38] regulations, doesn't mean we
[1:28:40] don't have any power.
[1:28:42] Chris can help us to navigate
[1:28:44] where our areas we can advocate
[1:28:46] and we can make, leave our
[1:28:47] fingerprints on this master plan
[1:28:50] and do things for the community
[1:28:51] like we've committed to and
[1:28:52] where are things we cannot,
[1:28:54] frankly, because of federal law.
[1:28:56] He'll help us navigate that,
[1:28:56] take questions.
[1:28:58] Ask him the hard questions.
[1:28:59] Ask him about the festival
[1:28:59] grounds.
[1:29:01] We can talk about the golf
[1:29:03] course, talk about noise,
[1:29:04] environment, whatever we want to
[1:29:05] talk about, I think it would be
[1:29:07] a very healthy exercise.
[1:29:08] My request to you today is,
[1:29:11] number one, do you want to hold
[1:29:11] this council workshop?
[1:29:14] Number two, what would be a good
[1:29:17] date to get that scheduled?
[1:29:17] >>Mayor Pachota: is there more
[1:29:19] of a presentation or does that
[1:29:20] sum everything up?
[1:29:21] >>James Clinch: that sums
[1:29:21] everything up.
[1:29:23] I'm happy to dive into question
[1:29:24] necessary you have.
[1:29:27] I'd love to talk, if there's
[1:29:28] time, about the
[1:29:29] misinterpretation of the tower
[1:29:31] that we've heard from today, but
[1:29:34] I'll leave that for your
[1:29:35] discussion, mayor.
[1:29:35] >>Mayor Pachota: okay.
[1:29:40] any questions of MR. Clinch?
[1:29:41] MR. Engelke.
[1:29:43] >>Kevin Engelke: I love the idea
[1:29:45] of scheduling a workshop to hear
[1:29:46] from the attorney.
[1:29:48] I think it's going to clear up a
[1:29:51] lot of concerns, a lot of
[1:29:52] misconceptions, and kind of
[1:29:54] outline what we can and cannot
[1:29:54] do.
[1:29:56] I'm highly encouraged that we
[1:29:59] have that opportunity.
[1:30:01] >>Mayor Pachota: MS. Frank.
[1:30:02] >>Rachel Frank: thank you.
[1:30:03] Again, in favor of scheduling
[1:30:05] this workshop, I believe the
[1:30:07] dates floated were in OCTOBER.
[1:30:08] Is there anything you can
[1:30:12] educate us on relating to the
[1:30:13] special events and the festival
[1:30:14] grounds from the public comment
[1:30:16] concerns we heard today?
[1:30:17] Because I feel like OCTOBER is a
[1:30:20] long way to wait for clarity on
[1:30:21] that particular issue.
[1:30:22] >>James Clinch: sure.
[1:30:23] We can address that right now.
[1:30:25] I met with the faa directly a
[1:30:25] month ago.
[1:30:27] We asked them point-blank about
[1:30:28] the festival grounds.
[1:30:30] The festival grounds has always
[1:30:32] been part of the airport and has
[1:30:33] faa oversight.
[1:30:36] It is intended for aeronautical
[1:30:38] use at some point in the future.
[1:30:39] The faa made that very clear.
[1:30:41] At some point in the future,
[1:30:44] that area will be used for
[1:30:45] aeronautical activities, which
[1:30:47] will be -- is and will be
[1:30:49] reflected in our master plan.
[1:30:51] The faa understood, because I
[1:30:52] expressed the importance of this
[1:30:55] location to our community, we
[1:30:56] actually generate revenue by
[1:30:58] having events there, and there's
[1:30:59] nothing happening out there
[1:31:00] right now, right?
[1:31:02] There's nothing on the books.
[1:31:04] there's no leases coming your
[1:31:06] way any time soon.
[1:31:08] So there's really no reason to
[1:31:09] preclude events from happening
[1:31:10] there.
[1:31:11] And they were very open to that.
[1:31:13] The concern, and the reason why
[1:31:15] our department reached out
[1:31:17] earlier this year is we had
[1:31:18] received some correspondence
[1:31:20] from faa with concerns about the
[1:31:21] festival grounds.
[1:31:22] They don't want to see any more
[1:31:24] improvements there.
[1:31:26] They don't want to see any more
[1:31:27] non-aeronautical investments in
[1:31:28] that area.
[1:31:30] They know at some point in time,
[1:31:31] that will be aeronautical
[1:31:32] expansion.
[1:31:34] And they made that very clear.
[1:31:36] So I think we've put to rest
[1:31:38] with them that in the meantime,
[1:31:39] these festivals are a very
[1:31:40] positive thing, but we wanted to
[1:31:43] be transparent with our event
[1:31:45] holders because, and we've
[1:31:46] learned this in the past with
[1:31:48] the faa, they could send a
[1:31:50] letter at any point in time that
[1:31:52] says you have 90 days to vacate
[1:31:53] the festival grounds.
[1:31:56] This is a non-aeronautical
[1:31:56] activity.
[1:31:57] I don't anticipate that's going
[1:31:59] to happen, but it's important
[1:32:01] that our event holders know that
[1:32:03] is always a possibility that's
[1:32:04] on the table.
[1:32:05] That's what we communicated to
[1:32:06] them.
[1:32:07] But I hope after our meetings
[1:32:09] with the faa recently, we can
[1:32:11] give them a little more
[1:32:13] confidence that we will give you
[1:32:14] every authority we have to
[1:32:16] schedule and hold your event.
[1:32:18] If a federal authority above us
[1:32:20] says we can't, that's out of all
[1:32:21] of our hands.
[1:32:25] so just be aware of that.
[1:32:28] >>Mayor Pachota: MR. Howard.
[1:32:30] >>Rick Howard: just echoing my
[1:32:30] colleagues.
[1:32:32] Total support, james, of having
[1:32:33] this workshop.
[1:32:35] I think it's a great idea to
[1:32:38] make sure we're as educated as
[1:32:41] possible with what the faa does
[1:32:44] and their authority, our
[1:32:46] authority or not.
[1:32:48] And thank you, rachel, for
[1:32:50] clarifying the fairgrounds
[1:32:51] because I know that is special
[1:32:53] to a lot of residents and event
[1:32:54] holders.
[1:32:56] That's it, mayor.
[1:33:02] >>Mayor Pachota: MR. Smith.
[1:33:03] >>Ron Smith: thank you, mayor.
[1:33:05] I'm very happy we're going to
[1:33:08] set, seems like everybody is in
[1:33:11] favor, of a workshop.
[1:33:12] Originally, MR. City manager, I
[1:33:18] had asked if we could have the
[1:33:19] faa actually some representative
[1:33:21] be here so we could ask
[1:33:22] questions.
[1:33:24] I wanted to do that because so
[1:33:26] often our answer is, well, the
[1:33:27] faa won't let us do that.
[1:33:30] I just want to ask, can we do
[1:33:31] this?
[1:33:32] Interesting, earlier today, one
[1:33:34] of the speakers said there is a
[1:33:35] new statement by the faa that
[1:33:37] they can approve non-aviation
[1:33:38] uses.
[1:33:39] That fascinates me.
[1:33:41] I know nothing about it except
[1:33:42] what I just heard and everybody
[1:33:43] else here heard.
[1:33:45] I would like to know if that is
[1:33:47] the case and if we can formally
[1:33:49] designate some areas with their
[1:33:51] approval for non-aviation uses
[1:33:52] because we have some that we'd
[1:33:56] like to have for sure.
[1:33:59] But I believe you told me they
[1:34:01] declined our invitation to be a
[1:34:04] part of this, is that right?
[1:34:04] >>James Clinch: that is correct.
[1:34:06] It was not personal to venice.
[1:34:08] I asked them point-blank if they
[1:34:10] would be interested and willing
[1:34:12] to come speak to our council.
[1:34:13] They said they have a policy
[1:34:14] they don't do that.
[1:34:16] That's all they would end up
[1:34:17] doing all day, every day and
[1:34:18] have another job to do.
[1:34:20] They were, however, very
[1:34:22] supportive and actually
[1:34:23] referenced MR. Wilson directly
[1:34:25] and said, you know what, we work
[1:34:26] with him regularly.
[1:34:28] He knows our rules.
[1:34:29] He will speak to your questions
[1:34:31] just the same as if we were.
[1:34:33] That was their recommendation.
[1:34:34] >>Ron Smith: I thank you.
[1:34:36] I thank you for your suggestion
[1:34:37] that we have our attorney, who
[1:34:39] you said graduated from
[1:34:41] aeronautical school himself and
[1:34:43] new the fa ark rules better than
[1:34:46] anybody, to be at our workshop.
[1:34:47] So I thank you for that.
[1:34:49] Maybe he can answer some of the
[1:34:50] very questions I would have
[1:34:54] liked to ask the faa.
[1:34:57] I think the workshop has taken
[1:35:01] on a whole different light in
[1:35:04] response to presentations made
[1:35:05] today, the mayor-elect.
[1:35:07] I'm not going to call you vice
[1:35:08] mayor anymore.
[1:35:11] Mayor-elect pointed out all the
[1:35:13] e-mails he's gotten on the
[1:35:14] concerns over what seems to be
[1:35:19] an evolving idea of what was
[1:35:22] once a pole and cameras to be
[1:35:24] coming -- to becoming something
[1:35:29] that would be a locally based
[1:35:31] flight control operation, and
[1:35:33] now even possibly a separate
[1:35:35] additional building to the
[1:35:38] terminal building to house up to
[1:35:40] five city employees.
[1:35:43] So the dismay we've heard from
[1:35:45] the public and from even members
[1:35:53] of the citizens advisory council
[1:35:57] for the master plan has me very
[1:35:58] concerned that we need to have a
[1:35:59] discussion about all of that.
[1:36:02] And is the right place for that
[1:36:04] discussion at this workshop?
[1:36:05] Will there be opportunity to
[1:36:05] have conversation at the
[1:36:07] workshop is what I want to ask
[1:36:08] you?
[1:36:08] >>James Clinch: yes.
[1:36:10] I think that workshop, you know,
[1:36:12] my original intent is to bring
[1:36:14] in MR. Wilson so we can get a
[1:36:15] presentation and ask him
[1:36:15] questions.
[1:36:19] I think the remote tower, which
[1:36:20] I need to speak to you here in a
[1:36:24] moment, but if the grant is
[1:36:25] successful on the remote tower,
[1:36:28] I think at that point we'll be
[1:36:29] able to have a meaningful
[1:36:31] discussion on what the remote
[1:36:32] tower is going to look like.
[1:36:35] That would be the perfect time.
[1:36:36] Our airport director is in the
[1:36:37] back.
[1:36:38] I'm sure he would be more than
[1:36:39] happy to put together a
[1:36:40] presentation on the remote
[1:36:42] tower, of which we'll have a lot
[1:36:44] more answers at that point.
[1:36:45] I'd love to speak a little more
[1:36:47] on that topic when it's
[1:36:48] appropriate.
[1:36:52] >>Ron Smith: if I can just ask
[1:36:55] this, I feel like we couldn't
[1:36:56] really have a citizen panel
[1:36:59] working with us on adopting a
[1:37:01] ten-year master plan without
[1:37:02] them knowing that this existed
[1:37:07] or that we were pursuing this,
[1:37:08] which is they didn't have any
[1:37:09] knowledge of it.
[1:37:11] I didn't have any knowledge of
[1:37:12] it.
[1:37:14] And it's very different than --
[1:37:16] we saw that little video where
[1:37:18] we're saying it's just a pole.
[1:37:21] Reminds me of the old thing in
[1:37:21] grammar school.
[1:37:23] Just a bill, just a bill.
[1:37:25] It's not anything until it gets
[1:37:26] signed by the mayor or the
[1:37:31] PRESIDENT.
[1:37:36] The group we recruited as a
[1:37:37] citizens advisory board to the
[1:37:38] master plan conversation, I
[1:37:40] think every single person on
[1:37:41] this council attended the
[1:37:44] meeting at the community center
[1:37:47] with 250 people, and it was
[1:37:48] never mentioned that this was
[1:37:49] the direction we were going to
[1:37:49] take.
[1:37:54] So that's my big concern is the
[1:37:55] transparency and leaving people
[1:37:57] who are on an advisory board
[1:37:58] feeling like they were not
[1:37:59] informed or misled.
[1:38:01] And then to a certain extent
[1:38:03] that I was misled because
[1:38:05] somebody accused me of being to
[1:38:06] blame for all this because I was
[1:38:09] out there saying it was just a
[1:38:11] pole and camera and nothing
[1:38:13] about expanding the airport.
[1:38:15] Stop saying we're expanding the
[1:38:15] airport.
[1:38:21] Some people told me that they
[1:38:23] ramped down because I was
[1:38:23] telling them that.
[1:38:25] I was telling them what I was
[1:38:26] being told.
[1:38:28] I feel to a certain extent, let
[1:38:31] down that I was put in that
[1:38:32] position.
[1:38:34] I'm aghast, and I apologize to
[1:38:36] anybody for anything I told them
[1:38:37] that was short of what is
[1:38:39] reality.
[1:38:41] I do look forward to your
[1:38:42] addressing that.
[1:38:45] Thank you.
[1:38:46] >>Mayor Pachota: let's go ahead,
[1:38:48] MADAM Clerk, if you'll reorder,
[1:38:50] put vice mayor boldt ahead of
[1:38:51] mine and let vice mayor go
[1:38:56] first.
[1:38:58] >>Vice Mayor Boldt: thank you.
[1:39:00] it's distressing to listen to
[1:39:01] the public.
[1:39:03] It is distressing to listen to
[1:39:05] all of this, simply because for
[1:39:07] anybody that's worked with the
[1:39:08] federal government, which we all
[1:39:10] have in some way, shape, or
[1:39:13] form, whether paying our taxes
[1:39:14] or otherwise, you know there's
[1:39:16] no easy answer.
[1:39:17] And there's usually not even a
[1:39:19] straight answer.
[1:39:22] I'm not here to defend anybody,
[1:39:26] but the reality is that this is
[1:39:30] kind of a moving target, shall
[1:39:31] we say?
[1:39:33] What we think we should have and
[1:39:38] what the faa tells us we need to
[1:39:39] have can be two entirely
[1:39:42] different things.
[1:39:44] I'm not putting words in james'
[1:39:45] mouth because I don't really
[1:39:48] know the answer, but I get the
[1:39:53] impression from our discussions
[1:39:55] that you have to approach this
[1:39:57] from different ways depending on
[1:39:58] what you're after.
[1:40:00] Is it you just need a tower for
[1:40:03] safety or do you need a grant
[1:40:07] for a tower?
[1:40:08] Asking for a grant, you have to
[1:40:09] substantiate that.
[1:40:10] And I think that's a lot of what
[1:40:12] we've seen in the report that
[1:40:16] went to the faa, trying to
[1:40:17] substantiate the need.
[1:40:19] Do I agree with all the wording?
[1:40:20] Of course, not.
[1:40:22] Because it does sound like we're
[1:40:24] trying to expand the airport.
[1:40:25] I can tell you from my
[1:40:27] standpoint here, that is not
[1:40:28] what I'm looking for.
[1:40:31] I'm looking for safety.
[1:40:34] So I would just, you know, I'm
[1:40:35] all for this workshop.
[1:40:36] I look forward to it.
[1:40:38] I think it will be a great
[1:40:40] opportunity for us to get with
[1:40:44] attorney wilson, and try to get
[1:40:45] us some clarity on what we're
[1:40:48] allowed to do and what we're not
[1:40:49] allowed to do.
[1:40:50] Because I really get the feeling
[1:40:55] that it's just like every other
[1:40:56] federal government situation.
[1:40:57] Well, today, it's this, but
[1:41:00] tomorrow it could be this.
[1:41:01] So I would just ask everybody to
[1:41:04] bear that in mind, what our
[1:41:08] staff is trying to do is put
[1:41:11] together a program that gets us
[1:41:14] where we need to be.
[1:41:15] However, that MAY require them
[1:41:17] to say some things that aren't
[1:41:18] necessarily -- I don't want to
[1:41:21] say untrue -- but aren't
[1:41:25] necessarily what we in total are
[1:41:27] looking for.
[1:41:27] I'm all for this.
[1:41:29] The sooner the better.
[1:41:32] Thank you.
[1:41:33] >>Mayor Pachota: I have a few
[1:41:35] points of clarity.
[1:41:36] This is where things get
[1:41:37] complicated.
[1:41:38] We have a lot of discussions.
[1:41:40] We get a lot of feedback.
[1:41:42] But, unfortunately, unless it is
[1:41:44] voted on, a motion made by the
[1:41:46] council and voted on, then it's
[1:41:47] not official.
[1:41:49] I think perhaps looking at some
[1:41:51] of our previous information
[1:41:52] sheets and making sure that all
[1:41:54] of the data to date is correct
[1:41:56] is another important piece to
[1:41:57] this puzzle.
[1:41:59] But I'm reminded now
[1:42:00] specifically because the minutes
[1:42:02] are in front of me, when we were
[1:42:05] discussing this back in MAY of
[1:42:06] 2022, and we were having a
[1:42:07] discussion about the master plan
[1:42:10] and it needing to be updated and
[1:42:13] I was then vice mayor and I
[1:42:14] actually made the motion to move
[1:42:16] up the master planning process
[1:42:18] because we were afraid we were
[1:42:21] going to be too far behind.
[1:42:22] so, again, having a plan in
[1:42:23] place is the most important
[1:42:25] thing so we know what is coming
[1:42:26] and what to expect.
[1:42:29] But at no point in time did we
[1:42:32] ever promote, discuss,
[1:42:34] encourage, expansion beyond the
[1:42:35] current footprint of the
[1:42:35] airport.
[1:42:37] I think that's important that we
[1:42:39] highlight that because I'm
[1:42:40] reminded by reading through the
[1:42:41] motion here, specifically that
[1:42:43] we said, well, we rather,
[1:42:45] instead of this coming out of
[1:42:48] our general fund or our taxpayer
[1:42:50] dollars, we rather get a grant
[1:42:53] for this because we know it's
[1:42:53] coming.
[1:42:54] Very clear from the minutes this
[1:42:55] was the presentation.
[1:42:57] Getting some form of a tower,
[1:42:58] whether remote.
[1:42:59] At the time, I think we were
[1:43:01] talking about a traditional faa
[1:43:04] staffed tower, but we had the
[1:43:05] forethought to say we want to
[1:43:06] make sure we apply for grants so
[1:43:10] we don't have to take it out of
[1:43:11] our general fund.
[1:43:13] That said, I'm absolutely in
[1:43:14] favor of transparency.
[1:43:16] I think having workshops is very
[1:43:16] important.
[1:43:17] I think it's important that
[1:43:18] people understand that when we
[1:43:19] have the workshops and we listen
[1:43:21] to all the feedback, that
[1:43:23] doesn't make it the actual
[1:43:24] direction moving forward like
[1:43:25] this does.
[1:43:27] When the council makes a motion
[1:43:29] and approves that motion and
[1:43:30] this is unanimous.
[1:43:33] I wasn't mayor at the time, but
[1:43:34] everybody on the council at that
[1:43:36] time had agreed to move forward
[1:43:38] with pursuing grant funding for
[1:43:39] that tower.
[1:43:40] I think that's important that
[1:43:42] we're talking back to '22.
[1:43:44] This has been a very long
[1:43:44] process.
[1:43:46] If you look back at the
[1:43:46] timeline.
[1:43:48] It probably even started before
[1:43:48] me.
[1:43:50] But that said, I do have a
[1:43:53] concern as it relates to the
[1:43:54] date for the workshop.
[1:43:56] Having just gone through this in
[1:43:57] the primary election, I'm very
[1:43:58] concerned that we would be doing
[1:44:02] a workshop in the middle of
[1:44:03] early voting.
[1:44:05] So with all the candidates for
[1:44:08] seat 2 and two candidates for
[1:44:09] another seat, I think it's
[1:44:10] important that we not take away
[1:44:12] from those individuals, the
[1:44:13] ability to participate.
[1:44:14] So I would say that we need to
[1:44:17] look at something that's more
[1:44:19] OCTOBER 15 would be my
[1:44:19] suggestion.
[1:44:21] I don't know how that fits into
[1:44:23] staff's timeline, but I would
[1:44:25] caution you before we solidify a
[1:44:28] date here that we look at what's
[1:44:29] going on during that time,
[1:44:30] because you'll have early voting
[1:44:32] and then the election and, of
[1:44:34] course, things could change on
[1:44:36] the council as far as who is
[1:44:36] officially on the council.
[1:44:38] I would like everybody to have
[1:44:39] the opportunity to participate,
[1:44:41] so I think we need to look at
[1:44:44] the week before early voting so
[1:44:46] we're not taking that away from
[1:44:47] anybody.
[1:44:49] Any comments or objections?
[1:44:50] >>James Clinch: none at all.
[1:44:52] I think more than ever, moving
[1:44:53] it sooner is a good thing for
[1:44:54] us.
[1:44:55] We'll just have to confirm with
[1:44:58] MR. Wilson to make sure that
[1:44:59] works with his schedule.
[1:45:00] If you want to give us authority
[1:45:02] to work with the city clerk with
[1:45:04] your all schedule, we can work
[1:45:06] with MR. Wilson to find a date
[1:45:07] that works.
[1:45:07] >>Mayor Pachota: my proposal to
[1:45:09] the council would be OCTOBER 15,
[1:45:10] because I think you have make a
[1:45:11] difference day happening the
[1:45:13] next day and then you have that
[1:45:15] weekend and then early voting
[1:45:17] starting that weekend.
[1:45:20] The other thing is, I'd like to
[1:45:22] give you an opportunity to speak
[1:45:23] to some of the things that we're
[1:45:25] talking about.
[1:45:26] I'm going to need to remind
[1:45:28] everybody, probably the third or
[1:45:29] fourth time, if we could take
[1:45:31] our cell phones and put them on
[1:45:32] silent so we can have
[1:45:33] uninterrupted discussion, I
[1:45:35] think that's very important.
[1:45:37] I would like you to take a
[1:45:38] minute, MR. Clinch, and just
[1:45:41] kind of talk about some of these
[1:45:42] concerns that have been brought
[1:45:42] up.
[1:45:44] I specifically remember a time
[1:45:44] when we were talking about
[1:45:45] laurel road.
[1:45:47] I had just come on to council,
[1:45:49] talking about a public-private
[1:45:49] partnership.
[1:45:51] Everybody on the northeast side
[1:45:52] was in favor.
[1:45:53] Then we had a group come in, I
[1:45:55] think they just moved into town,
[1:45:56] kind of built up and then all of
[1:45:58] a sudden wanted to pump the
[1:46:00] brakes on it, came back to the
[1:46:01] council, hey, we want to move
[1:46:03] forward on the expansion of
[1:46:04] laurel road.
[1:46:04] It's very complicated as a
[1:46:05] council member because you're
[1:46:07] trying to listen to your
[1:46:08] constituents.
[1:46:09] I specifically remember looking
[1:46:12] at the audience at that time and
[1:46:13] saying, I want to very
[1:46:14] cautiously move forward on this
[1:46:17] because we've already had two
[1:46:19] different pump-the-brakes
[1:46:20] conversation.
[1:46:21] If you really want us to move
[1:46:22] forward, I want to hear it from
[1:46:24] a lot of people that we're
[1:46:25] moving forward so I'm not
[1:46:28] pumping the brakes on something
[1:46:28] again.
[1:46:30] Kind of reliving that with the
[1:46:30] airport.
[1:46:32] Had concerns over time.
[1:46:33] Since I was a kid, we talked
[1:46:35] about having the airport
[1:46:36] relocated across town and other
[1:46:39] parts of the state.
[1:46:41] I'm not trying to minimize
[1:46:42] anyone's concerns, but at the
[1:46:45] same time, the master plan
[1:46:47] should be for us to have a plan
[1:46:50] so that we can see what's
[1:46:50] coming.
[1:46:53] It should not be for us to do
[1:46:56] any expansions, to do anything
[1:46:58] that's going to drive more
[1:46:59] growth at the airport.
[1:47:01] I've been very vocal about that
[1:47:02] since the beginning of this.
[1:47:03] I want you to have an
[1:47:04] opportunity here to talk about
[1:47:05] some of the concerns because I'm
[1:47:07] seeing it again in my e-mail.
[1:47:09] There are definitely some things
[1:47:11] that seem to be misconstrued
[1:47:13] facts or misunderstandings or
[1:47:14] whatever it might be.
[1:47:16] So if you'd like to take a
[1:47:17] minute to kind of go over some
[1:47:19] of that, I'm going to give you
[1:47:20] that opportunity.
[1:47:21] >>James Clinch: thank you,
[1:47:23] mayor.
[1:47:25] Happy to also work with the
[1:47:27] history which you touched on, on
[1:47:28] the tower.
[1:47:29] This did come up originally over
[1:47:30] four years ago.
[1:47:32] It was brought to our attention
[1:47:34] by vasi directly.
[1:47:36] it still is today all about
[1:47:38] safety.
[1:47:40] This was a major safety concern
[1:47:42] that they brought forward to us,
[1:47:43] made a presentation to council,
[1:47:46] and we got the direction at that
[1:47:48] point in time to expedite the
[1:47:52] master plan and to pursue grant
[1:47:53] sources for a tower.
[1:47:55] At that point in time, remote
[1:47:57] towers were not really well
[1:48:00] known and were not authorized
[1:48:00] for use.
[1:48:03] So there was a real potential of
[1:48:07] having a brick and mortar style
[1:48:08] tower.
[1:48:09] I want to clear that up, next
[1:48:10] topic.
[1:48:12] What we heard today, nothing has
[1:48:13] really changed with the tower.
[1:48:16] It's still a remote tower that
[1:48:17] we're pursuing, as it always has
[1:48:19] been, a camera on top of poles,
[1:48:21] but you still have to have a
[1:48:24] place where humans are
[1:48:26] monitoring these virtual -- the
[1:48:28] virtual information that's
[1:48:29] coming into a control room.
[1:48:32] When I spoke to you all in JUNE,
[1:48:34] and this kind of goes to the
[1:48:36] root of the challenge that we're
[1:48:36] having here.
[1:48:38] I certainly apologize to the
[1:48:40] community for any misinformation
[1:48:41] or misinterpretation that's
[1:48:44] happened.
[1:48:45] But while we were on breaks from
[1:48:47] council meetings, our staff are
[1:48:48] actively still working.
[1:48:49] So there have been some changes
[1:48:51] since JUNE that we just haven't
[1:48:53] had the opportunity to share.
[1:48:56] One of the big changes is we had
[1:48:57] hoped, and I talked about in
[1:48:58] JUNE, we hoped that we would be
[1:49:01] able to put that control room
[1:49:03] within the new administrative
[1:49:05] building that we are building,
[1:49:07] that's under construction today
[1:49:08] on the airport property.
[1:49:10] our engineers and our architects
[1:49:13] were directed to look into that,
[1:49:15] modifying the building to
[1:49:15] incorporate it.
[1:49:17] The only way it would fit
[1:49:18] because it is a pretty big space
[1:49:20] with all the screens and I.T.
[1:49:22] Equipment is if we lost the
[1:49:23] community room.
[1:49:26] Well, that community room is
[1:49:27] something we've been promising
[1:49:30] the airport and south island
[1:49:31] community for years.
[1:49:32] So I was not comfortable with
[1:49:34] losing the community room and
[1:49:35] replacing it with a control
[1:49:36] room.
[1:49:38] So I asked our staff, I said, we
[1:49:40] need to go back to the drawing
[1:49:41] board.
[1:49:44] So that's where this potential
[1:49:46] other location came from.
[1:49:48] So we have to put the control
[1:49:49] room somewhere.
[1:49:50] Where could that control room
[1:49:51] be?
[1:49:52] Well, it could be off-site.
[1:49:53] It could be anywhere.
[1:49:56] It could be at our airport in
[1:49:58] another small modular building.
[1:50:00] It could be at a different
[1:50:02] airport in tampa or arcadia.
[1:50:04] These are decisions that have
[1:50:06] not been made yet, but as part
[1:50:08] of the grant process, there are
[1:50:10] decisions that have to be
[1:50:13] clarified and conceptualized for
[1:50:14] the faa.
[1:50:15] That's where this presentation
[1:50:16] came from.
[1:50:19] It was a direct response to
[1:50:21] questions that came in from the
[1:50:23] faa as part of the grant
[1:50:23] process.
[1:50:24] Kind of going back to the
[1:50:26] history, we talked about this
[1:50:27] remote tower for four years.
[1:50:30] Talked about it at length at our
[1:50:31] FEBRUARY strategic planning
[1:50:33] session and got into our
[1:50:35] strategic plan, and we've been
[1:50:37] lucky enough now that there is
[1:50:39] this authorized remote tower
[1:50:41] system that we can pursue.
[1:50:42] We submitted the grant.
[1:50:43] We don't know yet if we're going
[1:50:46] to be awarded this grant or not,
[1:50:49] but if we were, it would be a
[1:50:50] huge benefit from a safety
[1:50:52] standpoint to our airport.
[1:50:56] And from a financial standpoint,
[1:50:57] it would cover virtually the
[1:51:00] entire cost of the remote tower.
[1:51:01] What I would propose, and why
[1:51:02] this workshop is so important,
[1:51:05] if we hold it after we know --
[1:51:06] we should hear on the grant
[1:51:08] award really within the next 30
[1:51:08] days or so.
[1:51:10] When we hold this workshop,
[1:51:11] we'll know if we're getting the
[1:51:12] money or not.
[1:51:15] When we know we're getting the
[1:51:16] money, we can have those more
[1:51:17] substantial conversations about
[1:51:20] how are we going to staff the
[1:51:20] tower?
[1:51:22] Do we want to have in-house
[1:51:24] controllers or contract it out?
[1:51:25] Where do we want to put the
[1:51:27] control room?
[1:51:29] There are a lot of benefits,
[1:51:30] pros and cons to all the
[1:51:31] scenarios.
[1:51:33] We just haven't gotten into that
[1:51:34] yet.
[1:51:35] It is a little bit unfortunate
[1:51:37] that this conceptual plan is
[1:51:41] being taken out of context and
[1:51:42] used as this is what's going to
[1:51:43] happen.
[1:51:44] That's just not true.
[1:51:48] But I'm sorry we weren't able to
[1:51:48] get ahead of it sooner.
[1:51:50] The last thing I want to say and
[1:51:52] this is the most important
[1:51:54] thing, it's still about safety.
[1:51:57] In 2022, when this came up, it
[1:52:00] was about safety, and we are now
[1:52:03] 41% higher operations than we
[1:52:03] were in 2022.
[1:52:07] If it was unsafe then, it's 41%
[1:52:09] more unsafe at this point in
[1:52:10] time.
[1:52:12] We've also had a study from
[1:52:14] F.D.O.T., an engineering
[1:52:16] analysis, to say a tower is
[1:52:18] warranted for safety purposes.
[1:52:20] I can't stress that enough.
[1:52:23] I love the video slip of the
[1:52:24] statement I made because that is
[1:52:25] so true.
[1:52:27] Safety is paramount when you are
[1:52:30] running this type of operation.
[1:52:31] Unfortunately, we've had
[1:52:33] incidents, we've had fatalities
[1:52:34] at our airport.
[1:52:35] I'll do everything in my
[1:52:37] authority to make sure we reduce
[1:52:39] that risk moving forward.
[1:52:40] Safety remains the most
[1:52:41] important thing.
[1:52:43] Will there be benefits for noise
[1:52:44] abatement, absolutely.
[1:52:47] We'll have more control over the
[1:52:48] zero control that we have today.
[1:52:52] So there's some ancillary
[1:52:52] benefits, but it's all about
[1:52:55] safety.
[1:52:56] Last thing I want to say is I
[1:52:57] appreciate everybody who reached
[1:53:00] out to our office yesterday with
[1:53:01] questions.
[1:53:02] We answered everybody who called
[1:53:04] in and every e-mail that came in
[1:53:06] and we will continue and be open
[1:53:07] to do that.
[1:53:09] I hope that helped to at least
[1:53:11] clarify where we are a little
[1:53:11] bit today.
[1:53:13] >>Mayor Pachota: with that, is
[1:53:15] there any other question for MR.
[1:53:15] Clinch?
[1:53:16] MR. Smith.
[1:53:18] >>Ron Smith: just briefly.
[1:53:19] Two things.
[1:53:21] I first focused on yesterday,
[1:53:27] when we saw e-mails, and, again,
[1:53:28] I don't know the actual
[1:53:30] situation, so I'd ask if you
[1:53:34] could give us a quick update,
[1:53:37] not wait until fire off
[1:53:38] workshop.
[1:53:39] People were asking about whether
[1:53:42] we are planning to buy air
[1:53:46] rights or outright buy homes as
[1:53:49] part of our noise abatement
[1:53:49] situation.
[1:53:51] There was a map showing where
[1:53:52] they would be and people saying
[1:53:54] I live right next to that,
[1:53:55] what's going on there.
[1:53:58] Is it possible to update the
[1:54:00] public on that at this moment?
[1:54:02] The other one last night being
[1:54:03] asked about whether we're going
[1:54:06] to have a second fixed-base
[1:54:07] operator and what is the status
[1:54:08] of that.
[1:54:10] If I could ask those today so
[1:54:12] people know what the situation
[1:54:12] is.
[1:54:14] >>James Clinch: sure.
[1:54:16] I'm happy to tell you what I
[1:54:16] know.
[1:54:18] Airport directors in the back,
[1:54:19] if you want to get into more
[1:54:20] details.
[1:54:21] These are really separate from
[1:54:22] the tower discussion.
[1:54:23] There was an exhibit in the
[1:54:25] tower grant that showed the rpz,
[1:54:28] the runway protection zone,
[1:54:30] showed it overlapping three
[1:54:30] properties.
[1:54:31] This is really part of the
[1:54:32] master plan process.
[1:54:34] We'll be talking more about
[1:54:34] this.
[1:54:36] My understanding is the faa is
[1:54:37] looking at those three
[1:54:39] properties as a hazard, because
[1:54:39] they are.
[1:54:41] They are in the rpz.
[1:54:45] We were able to move that rpz
[1:54:46] about ten years ago or so which
[1:54:47] was great.
[1:54:49] We took a lot of houses out of
[1:54:51] the danger zone by shifting the
[1:54:52] runway to the south.
[1:54:53] but there are still three
[1:54:55] properties that are within that
[1:54:55] rpz.
[1:54:57] I believe the faa is looking at
[1:54:59] that going, you really need to
[1:55:00] have a plan for these properties
[1:55:02] in the future, whether it's
[1:55:05] getting an easement or outright
[1:55:06] buying those properties.
[1:55:07] That's something that we will
[1:55:10] talk more about when we get into
[1:55:11] the master plan.
[1:55:12] I spoke to a couple of people
[1:55:14] about this yesterday.
[1:55:16] We are not actively pursuing any
[1:55:17] purchase of those properties.
[1:55:18] Ing
[1:55:21] .Nothing is happening at this
[1:55:23] point in time but is part of a
[1:55:24] discussion for the master plan.
[1:55:25] >>Mayor Pachota: I think you
[1:55:26] need to highlight we're not
[1:55:29] actively pursuing eminent domain
[1:55:29] either.
[1:55:30] I think that was a very big
[1:55:31] concern, are you coming to take
[1:55:32] my house?
[1:55:33] >>James Clinch: correct.
[1:55:35] Not pursuing eminent domain.
[1:55:37] It is the master plan.
[1:55:40] It is the plan for the next 10
[1:55:42] to 30 years of the airport.
[1:55:44] Second fbo, again, something
[1:55:46] that ties into the master plan.
[1:55:47] I think it's very well known at
[1:55:49] some point in time there will be
[1:55:52] a need for second fbo.
[1:55:53] We're looking in the master plan
[1:55:55] and we'll get into where these
[1:55:57] kind of things could go, because
[1:55:59] as we heard in the video clip,
[1:56:01] which is true, we do want to try
[1:56:04] to shift the more impactful
[1:56:05] operations to the far east side
[1:56:07] of the airport.
[1:56:09] If and when an fbo were to come
[1:56:11] in, that would be the area we
[1:56:12] would look at.
[1:56:13] That will be talked about in
[1:56:16] more depth with the master plan.
[1:56:16] >>Ron Smith: thank you for those
[1:56:17] answers.
[1:56:18] >>Mayor Pachota: with that, I'll
[1:56:19] make a motion then that we
[1:56:23] schedule the airport workshop,
[1:56:24] and, if we could, look at the
[1:56:26] date of OCTOBER 15, or working
[1:56:27] with the clerk's office, propose
[1:56:29] a date that works with all of
[1:56:31] the council members.
[1:56:33] Seconded by vice mayor boldt.
[1:56:35] MADAM Clerk, do you have anybody
[1:56:38] signed up to speak?
[1:56:39] >> no, we do not.
[1:56:40] >>Mayor Pachota: any council
[1:56:43] discussion on the motion?
[1:56:45] Seeing none, MADAM Clerk, if you
[1:56:47] can ready us for an electronic
[1:56:47] vote.
[1:56:48] Council members, when your
[1:56:49] lights are flashing, you can
[1:56:51] indicate your vote.
[1:56:53] MADAM Clerk, you can tally and
[1:56:53] display the vote.
[1:56:54] It passes unanimously.
[1:56:59] [Sounding gavel]
[1:57:00] We do have a noon executive
[1:57:02] session scheduled, so I'll move
[1:57:03] on to the next item and then
[1:57:05] we'll probably break after that
[1:57:08] to go to executive session.
[1:57:13] With that let's move on to
[1:57:15] 26-0706, and this is an item
[1:57:19] that was put on by MR. Smith and
[1:57:20] MS. Frank.
[1:57:21] So MR. Smith, if you would like
[1:57:29] to introduce the topic briefly.
[1:57:31] >>Ron Smith: thank you, mayor.
[1:57:32] I know you want an introduction
[1:57:34] and then a discussion.
[1:57:35] I'll try.
[1:57:38] I was extremely impressed with a
[1:57:40] presentation given to us over
[1:57:43] the course of two meetings by
[1:57:45] steve carr on this topic.
[1:57:46] And we have since received
[1:57:49] materials from their lawyer.
[1:57:53] So I wanted us to have a good
[1:58:04] discussion of this long-standing
[1:58:05] issue involving curry creek.
[1:58:06] >>Mayor Pachota: with that, is
[1:58:08] there any staff input on this,
[1:58:10] MR. Clinch?
[1:58:12] >>James Clinch: yes, mayor, if
[1:58:14] it's satisfactory, I'd love to
[1:58:15] invite our city engineer up to
[1:58:17] give you an update on really the
[1:58:18] two items, one being the swap
[1:58:20] with sarasota county on deer
[1:58:22] town gully and curry creek.
[1:58:24] The second being the private
[1:58:25] maintenance discussion on the
[1:58:34] sawgrass section.
[1:58:34] >>Mayor Pachota: he's already up
[1:58:40] here and ready to go.
[1:58:41] >> good morning, mayor and
[1:58:42] council.
[1:58:46] For the record, jon kramer, city
[1:58:46] engineer.
[1:58:49] I do have some exhibits for the
[1:58:57] overhead.
[1:59:00] As a reminder, you're probably
[1:59:03] familiar with this exhibit, this
[1:59:07] is showing the patchwork
[1:59:08] fractured nature of maintenance
[1:59:11] for curry creek and blackburn
[1:59:11] canal.
[1:59:13] There are several segments here
[1:59:15] that have different entities
[1:59:18] responsible for their
[1:59:18] maintenance.
[1:59:20] Some sections, there is a
[1:59:21] different entity on the north
[1:59:25] side and the south side of the
[1:59:26] creek.
[1:59:27] The city is responsible for the
[1:59:30] portion of the yellow and green
[1:59:33] portions of curry creek.
[1:59:37] In an effort to consolidate the
[1:59:40] maintenance, city staff begun a
[1:59:43] conversation with county staff
[1:59:44] to transfer this portion of
[1:59:47] curry creek from city
[1:59:50] responsibility to county, and in
[1:59:52] return, the city would take the
[1:59:58] responsibility for deer town
[2:00:02] gully.
[2:00:04] This is the portion that the
[2:00:06] city is responsible for
[2:00:08] maintenance of curry creek that
[2:00:10] we would like to transfer to the
[2:00:11] county.
[2:00:13] Through that discussion, we
[2:00:15] recognized that this would also
[2:00:17] be an opportunity to resolve
[2:00:19] some right-of-way segments and
[2:00:22] easements that were never
[2:00:24] transferred in the 2014 road
[2:00:26] transfer agreement between
[2:00:27] sarasota county and the city,
[2:00:30] but were probably believed to
[2:00:35] have been at the time.
[2:00:36] This exhibit -- and I have one
[2:00:38] more -- is showing the easements
[2:00:40] and right-of-way that the city
[2:00:42] would assume from the county.
[2:00:45] And in here, we have deer town
[2:00:48] gully, the unimproved beach
[2:00:52] road, unimproved circle drive,
[2:00:56] unimproved sunset drive, circle
[2:01:00] drive north of short road, and
[2:01:02] unimproved alleyway in the cross
[2:01:05] wind landings easements.
[2:01:07] In addition, the city would like
[2:01:10] to take maintenance of this
[2:01:13] easement portion of flamingo
[2:01:13] ditch.
[2:01:14] We would like to be able to
[2:01:19] maintain that.
[2:01:20] City staff have worked with the
[2:01:24] city attorney's office to draft
[2:01:25] an interlocal agreement for
[2:01:27] consideration by the county
[2:01:29] staff and then presentation to
[2:01:32] city council and the county
[2:01:33] commission.
[2:01:35] This now, since we're looking at
[2:01:37] road right-of-ways as well as
[2:01:38] drainage right-of-ways and
[2:01:40] easements, this is going to
[2:01:42] require input from the county's
[2:01:45] stormwater and transportation
[2:01:46] departments.
[2:01:48] They have notified us that the
[2:01:49] earliest they might consider
[2:01:51] this would be the end of this
[2:01:56] calendar year.
[2:01:59] Now, I'm sure you're also
[2:02:03] familiar with the portion of
[2:02:07] curry creek within sawgrass that
[2:02:10] is maintained by sawgrass.
[2:02:15] This has been about a ten-year
[2:02:15] discussion.
[2:02:18] And we did receive the recent
[2:02:23] correspondence from the attorney
[2:02:25] with sawgrass questioning the
[2:02:27] maintenance responsibility of
[2:02:28] that portion.
[2:02:31] Our city attorney has responded
[2:02:33] and there's been no change to
[2:02:37] city staff's position that
[2:02:38] sawgrass is the responsible
[2:02:47] entity.
[2:02:51] There are currently no
[2:02:53] discussions with sawgrass about
[2:02:55] the city potentially assuming
[2:02:58] some maintenance o this
[2:02:58] portion.
[2:03:01] If council directs staff, we can
[2:03:04] initiate some sort of
[2:03:04] discussion.
[2:03:07] I'd like to point out that
[2:03:09] council MAY not hear requests to
[2:03:13] assume maintenance of private
[2:03:14] infrastructure very often.
[2:03:15] But in the engineering
[2:03:17] stormwater department, we get
[2:03:20] these requests several times a
[2:03:20] week.
[2:03:22] We did analysis, and if you look
[2:03:25] at the lane miles of roads
[2:03:28] with the cit t city I
[2:03:29] respsible for the maienance
[2:03:31] of less analf the roads
[2:03:32] within t city.
[2:03:35] E rest are private roads,
[2:03:37] d-maintain roads, county
[2:03:38] ros, state roa.
[2:03:42] And in addition, we don't have a
[2:03:44] good number of the private
[2:03:46] ormwater infrastructe, but
[2:03:49] we believe alsohe city I
[2:03:52] responsible for aboutalf or
[2:03:54] less of e stormwar
[2:03:56] infrasucture within city
[2:03:58] limi.
[2:04:02] If city sff were to start
[2:04:02] mainining private
[2:04:04] infrasucture, that would
[2:04:06] generay require an incree in
[2:04:08] our stormwer assessments.
[2:04:10] So city staff's position, whe
[2:04:13] 're asked to maintainrivate
[2:04:15] infrastrucre is not to
[2:04:19] recommd approval b council I
[2:04:19] neral.
[2:04:21] However,his is aolicy
[2:04:24] decisionhat is up to cncil.
[2:04:27] Council directsity staff,
[2:04:29] we can look into some sor of
[2:04:31] intenance agreement with
[2:04:34] sawgrass.
[2:04:36] Mayor Pachota: does that
[2:04:38] conclude your presentation?
[2:04:39] >>Jon Kramer: yes.
[2:04:40] >>Mayor Pachot we'll start
[2:04:43] with MS. Fra.
[2:04:44] >>Rachel Frank: ank you so
[2:04:46] muchor refreing our memory
[2:04:48] on countversusity vsus
[2:04:49] privately matained.
[2:04:51] First, quick aside I'm
[2:04:52] thrilled that we asked the
[2:04:54] county about potentily taking
[2:04:55] over maintenancef what I wou
[2:04:58] call -- what d you call I
[2:05:00] golden bch unit 2asement,
[2:05:04] north hibiscu poinsettia.
[2:05:05] That would be aming to have
[2:05:06] at within city control,
[2:05:07] obviously, becau we are all
[2:05:08] well aware of what that
[2:05:10] neighborhood went tough wit
[2:05:11] the storm two years ago.
[2:05:13] So to have the accountability
[2:05:15] th usnd not with the county,
[2:05:18] think wou be a win for the
[2:05:20] residentin that area.
[2:05:22] That's wonderful
[2:05:24] in regards tcurry cre, I
[2:05:27] hear you loudnd clear that if
[2:05:29] multip times a week the city
[2:05:33] staff has to tell individuals,
[2:05:35] no, we'r notoing to aume
[2:05:37] publicnfrastructure, whether
[2:05:43] that's roa, pipes, et cetera
[2:05:45] wean't withoutramatically
[2:05:48] creasing our budget.
[2:05:50] So I would like a ltle bit
[2:05:52] morelarity on -- youre the
[2:05:54] engineernot us.
[2:05:57] Is there any broader public
[2:05:59] benefit to pottially
[2:06:02] maintaining th sawgrass section
[2:06:02] of cry creek?
[2:06:04] Just talk to me a lite more in
[2:06:06] deil abouthe wer flow in
[2:06:07] that aa.
[2:06:08] Obviously, the resents are
[2:06:10] very concerned about flooding
[2:06:12] after all that we've endured
[2:06:13] over the lastwo years as a
[2:06:14] city.
[2:06:15] Can youalk to me a little bit
[2:06:17] about the water flow in that
[2:06:21] area and the dynamics of the
[2:06:22] sawgrassrivately owned and
[2:06:24] maintained poron?
[2:06:24] >>Jon Krer: sure.
[2:06:26] If weo bk to thexhibit,
[2:06:28] you'll note that thisortion of
[2:06:31] curry creek within sawgrasss
[2:06:34] in the middle of the curry creek
[2:06:35] conveyance
[2:06:38] obviously, any obsuction in
[2:06:41] that ption or any area
[2:06:43] downream could cause potential
[2:06:45] issues for residen outside of
[2:06:51] sawgrass.

[2:19:50] Mayor Pachota: not t for

[2:19:55] Ce mayor.
[2:19:56] Vice Mayor Boldt: thou.
[2:19:58] T torolong this, but my

[2:20:02] help
[2:20:04] iteems to m the last
[2:20:07] of years, we worki
[2:20:11] with sawtrying to do a
[2:20:14] rezoning.
[2:20:16] The history of sawgrass, if yo
[2:20:20] go back aittle bit, m memoryagain is nhat great, it
[2:20:21] s county.
[2:20:22] It was
[2:20:24] it wasy, it was c
[2:20:25] there was t back forth
[2:20:28] thhink that went o
[2:20:29] tely, we to
[2:20:30] compromi I seem to r
[2:20:33] on what weanted to versus
[2:20:34] what we ultim
[2:20:36] but what I'ming to say is I
[2:20:39] feel like cty of
[2:20:41] rass got stuck inhe middle
[2:20:43] this whing.
[2:20:47] So there I of fingepointing goingo who
[2:20:49] should b taking care of
[2:20:51] the easies to resol all
[2:20:53] of that is to, hey,t's
[2:20:54] yourem.
[2:20:56] Eems to be wherere.
[2:20:58] I completelee wit m
[2:20:59] colleagues up h that a
[2:21:01] saying it flows through
[2:21:04] ity, it affects other
[2:21:06] areas stormwater within the
[2:21:09] city, we don't take care

[2:21:12] we delp tre of it,
[2:21:13] we can bigger probl than
[2:21:15] werted out with.
[2:21:21] So I am an advocate fortartingsome negotiations with regard to

[2:21:29] have t worut this

[2:21:38] Jold you p the map
[2:21:39] ag for me, pleas
[2:21:42] I have questions about the map.
[2:21:44] >>Jon Kramer: the overall one.
[2:21:46] >>Lloyd Weed: there legendons.

[2:21:49] veis that correct?
[2:21:51] Jon Kramer: yellow green.
[2:21:53] Lloyd Weed: yellow green.
[2:21:53] Okay.
[2:21:54] We are looking fhe
[2:21:58] unty toake over themaintenance of yellow andn?
[2:22:00] >>Jon Kramrrect.
[2:22:01] D Weed: okay.
[2:22:04] also, the words
[2:22:05] curry creek canal, ts gray
[2:22:07] and black.Who has responsib for the
[2:22:11] grayhe blarea, in t
[2:22:12] area?
[2:22:13] Jon Kramer: there I a legend
[2:22:16] goes with this that
[2:22:17] rtunately I did not print
[2:22:20] he city.
[2:22:22] Lloyd Weed: the city.
[2:22:22] Okay.
[2:22:26] Ghter]
[2:22:33] My concern I have many,
[2:22:35] maifferentroup wking on
[2:22:38] differenarts of cuy creek
[2:22:40] and blaburn canal.
[2:22:42] 'reoong a tnsfeing
[2:22:43] e mntenan respoibilies
[2:22:46] tohe gre and the yellow to
[2:22:48] the county in ehae r us
[2:22:50] ki or dr townul,
[2:22:51] which ave no pblemh.
[2:22:52] But at the sa tim we'
[2:22:56] log aturer cplatin
[2:23:00] byaking,heit vic
[2:23:00] tangr eec tt
[2:23:02] go tou cry cek,hich
[2:23:05] us lehain one
[2:23:06] patchwork quilt for another.
[2:23:10] I don't know if there's any
[2:23:11] possibility of negotiating with
[2:23:15] the county to take over the
[2:23:16] sawgrass portions, that they
[2:23:19] have that entire run under their
[2:23:20] responsibility rather than just
[2:23:21] moving this patchwork quilt
[2:23:24] around.
[2:23:26] >>Jon Kramer: if council directs
[2:23:28] staff to look into maintaining
[2:23:30] this portion, city staff would
[2:23:33] likely talk to county staff
[2:23:34] about having the county perform
[2:23:36] the maintenance in that portion
[2:23:40] and city MAY fund that
[2:23:43] maintenance.
[2:23:46] As just a point of reference,
[2:23:49] right now, our last maintenance
[2:23:52] contract, city paid about $1.55
[2:23:56] per linear foot to maintain the
[2:23:58] banks of the curry creek
[2:24:01] portions we're responsible for.
[2:24:03] If council would like us to look
[2:24:04] into maintaining that, we would
[2:24:07] likely ask the county to perform
[2:24:13] the maintenance and fund that.
[2:24:14] >>Lloyd Weed: thank you for
[2:24:17] clarifying.
[2:24:18] >>Mayor Pachota: all right.
[2:24:20] I'm last on the list and then
[2:24:22] we'll go back around for round
[2:24:22] two.
[2:24:24] My biggest concern is just like
[2:24:26] everything else that's come our
[2:24:32] way, flamingo ditch, curry lane,
[2:24:34] gene green road, all the
[2:24:36] different parcels, there's a
[2:24:37] funding component.
[2:24:38] Millions of dollars to do these
[2:24:41] things, and when the development
[2:24:42] begins, they have the
[2:24:44] opportunity to bring it up to
[2:24:46] standard and present it to us as
[2:24:48] us taking that over and the city
[2:24:50] could take over if wanted to.
[2:24:51] Millions of dollars need to be
[2:24:53] spent and curry lane is best
[2:24:55] example, to bring it up to
[2:24:57] standard before we take it over.
[2:24:59] I pause here with all this
[2:24:59] discussion.
[2:25:00] Yes, of course, I'd love for us
[2:25:02] to maintain it and make sure it
[2:25:03] gets done, but at the same time,
[2:25:05] I would need to see the costs
[2:25:07] associated with us being
[2:25:10] responsible, plus I vaguely
[2:25:12] remember with the flamingo ditch
[2:25:13] discussions that anytime we take
[2:25:15] something over or take over the
[2:25:16] responsibility of the
[2:25:18] maintenance, we then become
[2:25:20] liable for any of the issues
[2:25:22] that develop later on or bank
[2:25:23] improvements or whatever it
[2:25:24] might be.
[2:25:26] So there is a lot of caution in
[2:25:28] my mind when we start talking
[2:25:29] about taking these things over,
[2:25:30] that the developer could have
[2:25:32] done that when they built this
[2:25:34] in the first place and chose not
[2:25:36] to do it for whatever the reason
[2:25:36] was.
[2:25:38] Now we'll have to take that on
[2:25:42] as a citywide taxpayer base.
[2:25:44] I'm not saying I'm against it.
[2:25:46] I'm saying I would need to see
[2:25:47] all of the financials involved
[2:25:48] and all of the legal
[2:25:50] ramifications involved in us
[2:25:51] taking responsibility of that.
[2:25:53] So when we do get to that point,
[2:25:57] I would love for those questions
[2:25:58] to be answered as we're moving
[2:26:01] forward with this discussion.
[2:26:02] MS. Frank, you're next and then
[2:26:05] MR. Engelke.
[2:26:06] >>Rachel Frank: yes, to my
[2:26:07] colleague, MR. Weed's question,
[2:26:09] I pulled up the e-mail from MR.
[2:26:10] Carr and it stated that the
[2:26:12] black line is sarata county
[2:26:14] owned d maiained, andhe

[2:26:35] that was why I questioned our
[2:26:36] fina director about the
[2:26:38] overall state of our stormwater
