[0:24] sets of minutes to consider, as well as two bylaws

[0:27] for preliminary readings and adoption and one item of closed

[0:30] business. But of course, before we begin our work together,

[0:33] we always want to take a moment to pause and

[0:36] reflect and express our gratitude and recognition to the two

[0:41] nations on whose territories are City sits in its entirety.

[0:44] The co - opsum nation and the Songhees Nation. These

[0:47] two nations and there are multiple families and members have

[0:51] for hundreds of years, many, many generations taking it upon

[0:55] themselves to pay special attention to the lands on which

[0:59] we all operate and live and play and work, and

[1:03] the waters that surround them as well. And in so

[1:06] doing, they have created the opportunity for us to do

[1:08] the work that we do here in these halls, in

[1:11] the city council and in the city itself, and all

[1:14] of our neighbourhoods and homes when we're lucky enough to

[1:16] have them. And when we have the opportunity to work

[1:19] with our colleagues, our friends, our families, and all of

[1:22] our residents together, hopefully making decisions that have respect for

[1:26] the past and acknowledgment of it, as well as a

[1:29] willingness, a courage to confront the issues that are with

[1:32] us today and thought, of course, for the future and

[1:34] all the things that will come in the days, weeks,

[1:38] and years ahead. The nations themselves have done that type

[1:41] of work for so many years. We can only admire

[1:44] their resilience. Hope to learn from it and appreciate the

[1:47] continuing collegiality and willingness that they have to work with

[1:50] us. And to help us learn together as we make

[1:53] the mutual and individual decisions that we make for the

[1:56] benefit of our residents, indigenous and non - Indigenous alike.

[2:01] With that, we like to say thank you in their

[2:03] language, and that is to say, hi, Chica or Hichukasium,

[2:05] Nicolia. And that is to just say thank you to

[2:08] offer a bit of respect to all of the leaders,

[2:11] individuals, alike throughout the community who each day make a

[2:15] decision to do one thing, perhaps one very small thing,

[2:19] which changes the way someone else lives their life hopefully

[2:22] for the better. So with that, let's hope that that

[2:24] is our goal too. And we say hi, Tricka CM

[2:26] Nicole. I made some remarks earlier today, just reflecting a

[2:33] little bit on the passing of Gloria Steinem. I won't

[2:35] repeat those, but I would urge folks to look at

[2:37] them earlier today if they're interested. And iconic figure for

[2:40] many of us of a certain age and interest, and

[2:44] certainly for those of us who spent many, many years

[2:47] working the Community of Women's Rights and the rights of

[2:51] other equity seeking equity deserving people. It is a sad

[2:55] day indeed to note her passing. I'm not aware of

[3:00] any late items that need to be brought to council

[3:02] today. And so we will look first to an approval

[3:05] of the agenda. First, I'm going to ask to move

[3:06] it, I'm going to ask to amend it. So if

[3:08] we could first have a motion to approve the distributed

[7:37] ask staff just to briefly explain why this is here

[7:41] and what exactly we are doing. This is an item

[7:44] that we have considered previously and for the most part

[7:47] approved. So what are we doing here today? Mr. Handy.

[8:12] Look at Mr. Carroll. Please explain to us why this

[8:14] is here again today and what we're actually considering. Good

[8:19] afternoon, Mayor and all of council. So just for the

[8:25] record, Patrick Carroll, senior planner, development services. Uh, before you

[8:29] today is the adoption of a site - specific amendment

[8:32] to the zoning regulation bylaw for the property known as

[8:35] evergreen terrorists. The proposal is for a phased redevelopment. Of

[8:40] the site, which would replace all 196 existing units. And

[8:45] add approximately 700 new rental units. The proposal includes nine

[8:51] buildings. In a mix of high and mid - rise

[8:54] forms. As noted in your update report, the approved CD

[8:59] zone. Set a density for the entire site of 2.

[9:03] 6 to one FSR. However, it has been determined that

[9:08] the maximum floor area for each development area is required

[9:12] to enable future subdivisions. There is no change to the

[9:17] proposal or the maximum permitted density across the site. The

[9:21] recommended motion includes language to rescind, re - approve and

[9:24] adopt the amended CD zone. And therefore attachments to show

[9:29] track change of the comparison. In addition, the applicant has

[9:34] met the condition to register the MDA prior to bylaw

[9:38] adoption. However, two commitments in the MDA requires some updates

[9:42] for councils awareness. First, the resolution included a commitment of

[9:48] two 21 supportive housing units to be operated by the

[9:51] Aboriginal coalition to end homelessness. During MDA discussions, the applicant

[9:57] clarified that they could not commit to a specific operator

[10:00] in the long term, um, as it is in agreement.

[10:03] And the two parties. Although the intention is for no

[10:06] change to the operator. Second, the resolution included a commitment

[10:11] that at least 70 percent of the residential units would

[10:15] have access to a usable private outdoor space. The applicant

[10:19] requested that the MDA allows some flexibility to include a

[10:23] Juliet balcony. Staff added language to require due consideration to

[10:29] the design guidelines that do encourage these private outdoor spaces.

[10:36] It should be noted that the first phase of development

[10:40] has been approved and actually far exceeds the 110 units

[10:49] lacking a private outdoor space. And that's about 95 percent.

[10:53] And there are no Juliet balconies proposed in phase one.

[10:57] And that's, that, that's everything covered in the report. And

[11:00] I can take your questions at this time. Right. Thank

[11:12] one clarification. I'm just trying to remember. So we had

[11:13] done for a second and third before and we're ascending

[11:26] the condition was that the MDA had to be completed,

[11:29] executed and registered. And that has happened. Okay. So are

[11:32] we able to do third and final adoption on the

[11:34] same day. Through the mayor, yes, I did consult internally

[11:39] with legal and confirm that that was possible in this

[11:47] Just a couple. Okay. When I read the document you

[11:51] gave to us. So they're going to be divided up

[11:54] the lots. Of through to the mirror. As of now,

[11:59] we are aware of five development areas and those were

[12:02] communicated through the Committee of the whole report is developed

[12:04] in areas through the discussions. It became clear the applicant

[12:08] was intending to subdivide, uh, which is what has led

[12:11] to this correction. And so effectively we don't know what

[12:16] lots. They'll ultimately subdivide, but at least we know that

[12:19] the five development areas will be their own parcels. Will

[12:23] BC housing continue to own all parcels or is there

[12:26] an intent to sell. Through to the mayor, uh, it's

[12:29] been made clear from the applicant that there is no,

[12:31] uh, intention to divest of any of the provincial lands.

[12:35] And it's part of the PRP program. So the provincial

[12:38] redevelopment program. That is the funding source for this development.

[12:41] And it does stipulate that lands must be remain in

[12:44] the province's hands. Great. Now, with the separation and the

[12:50] alteration of the MDA for each parcel is developed. Are

[12:54] we going to rung to something like we did at

[12:56] the Bayview and Roundhouse with coming back for whole redevelopment

[13:01] type of applications? Cause I thought all that was rather

[13:06] taken care of. Uh, through to the mayor, if I

[13:08] am understanding your question correctly, um, the intention is that

[13:12] this will not return to council for a rezoning in

[13:15] the future. And this is part of the correction today

[13:17] is to ensure they can subdivide in the future and

[13:20] not create a density problem that would lead them to

[13:23] return to council. And our intention is to not have

[13:26] to reopen the MDA again as well. That being said

[13:29] future phases will definitely need a development permit. It may

[13:33] be delegated depending on the details, the level of affordability.

[13:36] Um, and some other factors as well. But it may

[13:40] return to council as a development permit regulating form and

[13:43] character for a given phase. And there could be variances

[13:46] triggered as well. Um, but not, um, the intention is

[13:49] to not return to revisit the MDA or the zoning.

[14:04] hear correctly that none of the Juliet balcony door space

[14:17] no immediate intention to utilise Juliet balconies in any of

[14:21] the designs, but reality is the only design that we've

[14:24] seen and that the applicant has done is phase one.

[14:26] But we can confirm that there are no Juliet balconies

[14:29] at all in the first phase. And we won't know

[14:31] about future phases until they apply for that development permit.

[14:36] Okay. Thanks. Has there been any consideration about how, um,

[14:41] okay. Here's, sorry, let me rephrase. Folks who are going

[14:45] to be populating phase one are the current tenets of

[14:48] evergreen terrorists who have been temporarily displaced, right? That is

[14:54] correct. Um, the first phase is 110 units in total.

[14:58] So it will allow for options for occupying up to

[15:03] 110 of the 196 that it currently, uh, exists, uh,

[15:08] on the land. Uh, so it would be the first

[15:11] two phases that would be intended to accommodate those that

[15:16] are currently living on the site. My concern is that,

[15:23] uh, folks who had previous access to green space as

[15:27] one of the original tenants, um, are, are losing that,

[15:31] especially given that face one is confirmed to not have,

[15:34] uh, things like balconies. What direction or assurance is or

[15:40] any procedural steps, would you advise in order to try

[15:45] to encourage or affirm outdoor access in phase two. Uh,

[15:51] girls? Thank you for the question and through to the

[15:53] mayor, um, just one clarification. They're in the first phase,

[15:57] which is approved, uh, in principle at this point, uh,

[16:01] it did not include any Juliet balconies and only five

[16:04] of the 110 are lacking a balcony. And I should

[16:09] note that all phases of development through the MDA secured

[16:13] common amenity space that is outdoor as well as indoor.

[16:17] Um, and now phase two, um, we just don't know

[16:20] what's being proposed yet, uh, but the MDA will be

[16:24] required common amenity space in phase two, both outdoor and

[16:29] indoor. And also, um, at least as well, so there

[16:38] is some assurance, um, but a lot of it would

[16:40] come down if there is a proposal for, say, a

[16:43] higher number of juliet balconies in phase two. We would

[16:46] utilise the development permit guidelines to try to emphasize the

[16:50] importance of these private outdoor spaces. Thank you. Thank you

[17:25] Island's history, I don't know of any that are bigger

[17:27] than this. So it's, it's going to be really, really

[17:29] transformative and I think in a positive way for Quadril

[17:32] side and for downtown and for the community as a

[17:35] whole. So I'm really appreciative that BC housing given, even

[17:39] given all these fiscal constraints, is willing to keep moving

[17:41] forward with phase one. And at least based on my

[17:43] reading of the staff report, it sounds like they might

[17:46] start work relatively soon. Maybe I'll just put that as

[17:49] a final question. It looked like phase one might be

[17:51] done in like two or three years, which implies that

[17:53] starting soon. So do we have a sense of timelines.

[17:56] Thank you for the question. And through to the mayor,

[17:59] uh, so, uh, the very speedy timeline being planned by

[18:03] BC housing at this time. It's part of the rush

[18:05] to, um, proceed and finish the master development agreement as

[18:09] quickly as it did. Effectively, the fences up now, they've

[18:13] received their demolition permit for the first phase. And they

[18:17] will immediately go into construction. I understand it as soon

[18:21] as the demolition is complete. So phase, I don't know

[18:23] what the timing to finish it is, but it should

[18:25] be underway early, early to mid fall. And has everyone

[18:29] been rehoused who's being displaced by the redevelopment? Yes. To

[18:34] my understanding, everybody was, uh, has been moved out of

[18:37] the first phase. And I'm not, I'm not privy to

[18:39] the exact details, but they have all moved out to

[18:42] alternative accommodations. And they would be, of course, offered in

[18:47] the new building when it is. Right. Ready. Thanks, Olivia

[19:42] my appreciation to all of the partners and to our

[19:45] staff for assisting and continuing to make it move as
