[2:51] attire this evening? >> Yeah, I would. Would you please
[2:55] introduce yourself for the record? >> Yes. David Morad. I'm a a resident of
[3:00] Morland Hills. I am also an educator in higher education for 20 plus years and I
[3:06] have two young children who will be going to the Orange Public Schools uh
[3:10] very shortly. Um, the school district is here about a levy that will be on the
[3:15] ballot in the fall. And as a resident, educator, and parent, I fully support
[3:21] it. The Orange School District has not passed a general operating levy since
[3:25] 2011. That levy, 5 mills, has been in effect for roughly 14 years. And in that
[3:30] time, property tax revenues for the district have risen only modestly, less
[3:35] than a million on average per year, or roughly one and a half%. Meaning they
[3:40] have also failed to keep up with inflation which ran at over two and a
[3:44] half% during that same time. And it's that loss against inflation effect that
[3:49] I try and show a table chart in one of the handouts.
[3:54] As I speak, the elephant in the room with any levy discussion is property
[3:58] taxes. And I recognize some commun community members must be asking
[4:02] themselves, how do schools need more money? Property values have exploded
[4:08] over the past 10-15 years. And since levies come from property taxes on such
[4:12] values, doesn't that mean that the schools have seen a windfall of cash?
[4:16] The short answer is no. Some small gains, yes, but not enough to keep up
[4:22] with inflation and certainly enough not enough to match the skyroing
[4:26] skyrocketing home valuation increases. The more complicated answer lies with
[4:30] Ohio's House Bill 920 enacted in 1976, which generally holds that such school
[4:36] levies collect a fixed or restricted number of dollars rather than a fixed
[4:40] rate. Thus, even if property values rise, the amount collected can stay
[4:47] roughly the same. For orange, this means the skyrocketing home values do not
[4:52] equate to similar gains in school district revenues. The primary chance
[4:56] for additional revenue growth comes from new construction and then a relatively
[5:00] small amount of unvoted millillage. To see how this plays out, just take the
[5:05] 2024 Kyoga County property reappraisal, which recorded a 32% increase in county
[5:11] home values. For Orange District, the assessed value increase wasn't as high,
[5:17] more around 20%. From 1.26 26 billion to 1.51 billion, an
[5:23] increase of roughly $250 million. Yet, none of that money, or next to none of
[5:30] it, is going to the schools. Again, House Bill 920 reduces the rate
[5:37] on voted levies to offset rising values, leaving only the district's 5.2 mills of
[5:43] unvoted millage to collect on that increased value. That millage produced
[5:48] roughly $1.3 million in additional school revenue, about 1.5% of the
[5:53] property value rise. In short, it's a onetime step increase of roughly 2%
[5:59] against a potential tax base increase of 20%. I can give you my own personal
[6:05] story. My property taxes rose in that rep reappraisal by 20%. To almost
[6:11] $1,000. You would think Orangeville school
[6:14] districts would see a lot of that. They see roughly $160 of that. Why? How? How
[6:20] can this be? Where does the rest of it go? It's Ohio, so it's complicated. But
[6:26] one answer is that it simply gets shifted around, transferred among
[6:30] neighbors rather than generating any new tax revenue. Here's one example. how I
[6:35] perused just out of curiosity a few multi-million dollar properties in
[6:40] Morland Hills Orange District area and found several whose property taxes did
[6:44] not shift much at all, much less than the 20% rise that mine did. There was
[6:49] also at least one multi-million dollar property whose tax burden actually fell
[6:55] during that period by nearly eight times the amount that mine went up.
[7:00] I am not calling out any properties and I'm not naming names. I'm simply
[7:05] explaining how the system works that it's a shift between neighbors often
[7:10] rather than any revenue uh generated. So in conclusion, the reality is true. Ohio
[7:17] has a very real property tax problem, but one reason is a problem is because
[7:22] it's almost by design that the schools will be perennially lacking money. by
[7:27] design that revenues cannot keep up with costs. The cost of labor, materials that
[7:33] always are rising in the econom economy, but revenues are always always capped.

[7:46] orange school's fault. None of this is the fault of Orange leaders and
[7:49] absolutely none of it is the fault of our children and of our students. the
[7:54] people in this room, the people of Morland Hills, we can't resolve the
[7:58] state issues, but we can resolve hopefully the school levy issue from our
[8:03] own end. I I think we can do that and I believe we should. I thank you for your
[8:07] time. There are additional um uh tables and slides that contain a lot more
[8:14] factual information about what's happening at the school district, where
[8:18] levies have been over the past 20, 30, 40 years, how it's been 15 years since
[8:24] uh Orange went to the voters for a levy and so on and so forth. If you have

[8:54] I'm running for the Bedford Municipal Court Judge. It's an open seat in 2027.
[8:58] I've been a trial attorney for 33 years. I represent people on their very very
[9:04] worst days when they're looking at their wives, their children that they may not
[9:08] be able to go home to their wives. They going to lose their freedom. I love what
[9:12] I do. Uh, as I said, I've been an attorney for 33 years. I've been a
[9:19] part-time pro municipal prosecutor. I've been a special prosecutor. I practice in
[9:24] federal court. I practice in all the courts in the state of Ohio. I'm a
[9:27] graduate of the Case Western Reserve University. Uh, I'm been appointed to be
[9:32] on the CGA panel to represent federal criminal defendants. Uh, but at 58 years
[9:38] old, I've determined that I can do more help to people if in fact I'm a judge
[9:43] rather than helping one person at a time. So, I'm looking to be a judge at
[9:48] the court where I think that too often we just put prosecutors in or people
[9:53] that are in the court. I think it's time that we put someone that's actually done
[9:57] in real practice that actually sees what happens to people. I think the court
[10:02] needs to use different alternatives, programming, different whether it's
[10:08] traffic, whether it's driver suspensions. There's a lot of reasons as
[10:11] why people go into municipal court. Municipal court is the low-level court.
[10:14] It's not felony court. It's not common please. It's lowle. There's ways that we
[10:18] can help these people. Uh we don't need to put people in jail for any extended
[10:22] period of time. Uh, I'll be here more uh talking to you about what I intend to
[10:27] do, but just a brief introduction of who I am.

[10:42] report some communications from the mayor and other municipal officials. And
[10:46] I will start. Uh I've got a few updates for council here. The first is um you're
[10:52] all probably wondering what's happening with AT&T since this has been taking
[10:56] quite a long time. So I I'm here to give you an update. Uh Mr. Hannah and I have
[11:01] been uh continuing to have conversations with AT&T,
[11:07] but we also are still getting hung up on the same legal issues that we've been
[11:10] talking about for several months. And um we are at this point um going to step
[11:19] back and and evaluate whether continuing in the current phase or whether other
[11:25] paths may be more sensible here to try to move this thing forward. I get
[11:30] questions from residents all the time about this project. And um and uh I'm
[11:35] I'm anxious to to make progress and we're just not getting there. I don't
[11:39] know Mr. Hannah, if you would like to make a comment or two, feel free.
[11:43] » Sure. Uh, Mayor, I I mean, I would uh echo those comments. I think, you know,
[11:48] we we've had a a long and uh relatively uh comprehensive discussion with AT&T
[11:56] um about, you know, the necessary ingredients from the villages
[11:59] perspective for a lawful agreement that doesn't constitute an um an
[12:05] inappropriate or unlawful subsidy using public funds to a private corporation.
[12:10] And you know it gets a little more complicated than that of course but um
[12:14] but we are continuing to find working through those issues very challenging.
[12:19] And so um one of the options um down the road could be revisiting the RFP that
[12:25] the village issued previously. Um and uh you know thinking about the other
[12:31] respondent I think there was just the one correct
[12:34] » to that and uh and and see you know if we're not able to make this work with uh
[12:40] with AT&T with whom the village has been negotiating um you know it may be
[12:45] possible to commence a different discussion um or to revisit the RFP um
[12:51] itself and and reissue a uh an RFP to try to more carefully calibrate what the
[12:58] village is seeking um visav people who may be interested in providing it.

[13:49] it looks at least the latest is that it's going to stay dry. So, I hope we
[13:54] can have some fun and I hope hope to see you there. Um, let's see. A couple other
[13:59] things. Um, [clears throat] I want to bring to
[14:03] council's attention something that I had a discussion with the Mr. Water and with
[14:08] Sher, I think it was yesterday or the day before um regarding the pavilion
[14:13] rental process. Um, we continue to have issues with the rental process up there
[14:19] where people are not respecting our rules like emptying their trash. They're
[14:25] drawing um I don't know if it's chalk or pens on the on the heartscape up there
[14:31] that we can't seem to remove. Um they're leaving the bathrooms a complete mess.
[14:37] Um, and we're doing the best. The service department is doing a great job
[14:41] to try to get up there in between rentals, uh, and and take care of
[14:46] things, but I think, uh, I'm going to make some changes to the rules. Uh, I
[14:51] don't care to imple implement them until next year because we've already kind of
[14:56] set the rules for the season and we're sort of getting toward the end of the
[14:59] season. But, um, my proposal, nothing final. I welcome input or call me or if
[15:05] you have any input tonight. Um the primary things that that we discussed
[15:10] that I'd like to do is number one go to full day rentals rather than trying to
[15:14] do half and half because it creates and most other communities are doing kind of
[15:18] full days. So you rent it for the whole day and you've got it the whole time and
[15:22] we're not trying to um run up there for an hour in between two groups and clean
[15:28] everything. Second, I'm going to require a deposit for all rentals. we only
[15:33] require deposit for rentals when um people are food truck
[15:37] » and we're finding that um we're spending extra cost going up there to clean up
[15:42] things that they're supposed to be doing. So I think if we have a a a
[15:46] deposit that is forfeited if some of these things happen, I think we'll be in
[15:52] better shape. And then the third is to raise the rate uh for non-residents. And
[15:57] I don't know what the rate exactly is going to be yet, but um it will be a
[16:03] larger gap between residents and non-residents because I think we have
[16:07] more recourse on residents when they do these things than non-residents and and
[16:11] it's pretty common that other communities either don't rent to
[16:15] non-residents or they charge more. So those are the things that are going on.
[16:18] I welcome your feedback. We're not doing anything till next season like I said,
[16:21] but I think change some changes are in order and I'm going to let you guys know
[16:25] about that. And then the last thing I'll say uh tonight is around power outages.
[16:30] We continue to have them. Um I've been all over I've written many letters.
[16:36] You've seen maybe some of the social media posts that Sherry's helping with.
[16:40] We I've reached out to our elected officials. Um I had our councilman reach
[16:46] out to me again and I told him what we're doing. He said he'll help whatever
[16:49] we can. I think just making our story known that we need more attention from
[16:57] um from First Energy here to address some of these problems. I know it's not
[17:01] a short-term problem, but I'm just going to stay on it. I just think it's it's
[17:04] not acceptable level of service that we're getting. Um and you know,
[17:10] hopefully with the collective voice and some of the other communities around
[17:14] here that are doing similar things, we'll get some action.

[17:21] go to Pukco about it, too. I don't know. I haven't done that yet. That's the one
[17:24] thing I haven't done. But anyway, I just wanted you to keep you guys know this is
[17:28] something that's on my agenda. >> I just want to add to that. I um we
[17:32] talked to the council um that um I'm I share the survey with
[17:38] Pepper Pike so far so that they can copy it. they can also send it out to their
[17:43] residents and we talked maybe about collectively getting those te that
[17:47] testimonial data data in case we want to go to
[17:50] » so now that that we would have it and if we get Pepper Pike or Bentleyville I

[21:18] and, uh, market conditions or what have you, uh, can certainly impact us, um,
[21:24] very rapidly. So in in dollars we are down about $527,000
[21:32] um year to date. Um again our budget was conservatively estimated um at even less
[21:40] than that. So we are fine as far as the budget is concerned. Um but as far as
[21:45] actual cash and revenue collections we are down. So just a heads up.

[22:34] and all those things and if all this comes together with u reduction in
[22:39] income tax revenue which is our main source of revenue and um property tax is
[22:44] also u being discussed um you know we'll have to look at it
[22:49] keep an eye on it and I'm sure you may um are familiar with all the things
[22:53] going on statewide because uh as part of your mayors and managers association
[22:58] they do have discussions on Uh, but I'm I'm certainly keeping my eye
[23:02] on it and keep you informed as we go along.

[24:33] that was a square footage variance for a detached garage and covered patio at 30
[24:41] Addison Lane and that was uh approved. Um we also uh besides the player house
[24:50] camp matter which uh will come up later in the agenda we had other items. One
[24:58] was the um design for that uh the tax garage at 30 Addison. Uh we also had two
[25:08] um designs for new dwellings. one at 45 Stern Crest and one at 110 Meadow Meadow
[25:16] Hill Lane, sorry. Um all three uh were approved. Um all three were were subject
[25:25] to um site plan revisions, engineering uh review and approval and
[25:31] particularly to um new drawings were also subject to a um septic uh permit.

[26:17] help assemble the the kind of earth bridge and, uh, and it's been a good

[27:15] Ball Morland Hills area. Um, she had emailed me expressing concern about the
[27:22] the speed in that area on Miles Road. So, she attended the meeting um shared
[27:27] her concerns, talked about how she had um reached out to Shrint Hall's roads
[27:32] and safety committee um as well and how it may um they felt it may have to be a
[27:41] combined effort to take a look at that road if we were going to do anything
[27:45] about it with with the village. Um, but what she's saying is the stretch there
[27:50] between Solen, where Solen Road starts and intersects with Miles heading
[27:56] westbound, um, is currently 35 miles per hour, um, she feels it's it's too high
[28:02] of a speed limit for that area being very, uh, dense in residential um,
[28:08] homes. So, she was coming to ask Beth if we would take a look at it in the area.
[28:14] Um, by the end of the conversation, uh, Chief Diesel stated he'd be happy to
[28:19] install a speed box in the area going westbound, also eastbound to to do a
[28:23] seven-day study to take a look at the speeds. Um, that's currently in process
[28:30] um because it takes some time to get all that, make sure that we're not putting a
[28:34] poll where their utilities are lying. So, um, that's sort of our next steps to

[29:10] from planning to allow eight buses to access the Hyram Trail three times per

[29:22] challenge of developing a storm water drainage system around East and West
[29:27] Juniper. um and he discussed several different
[29:31] options of how to address that. Um we're still in discussions on or he's still in
[29:38] discussions on trying to figure out the best option is. So that's where we are.

[35:06] uh requested informally in some preliminary hearings
[35:11] uh and formally at the uh public hearing at uh the the last planning commission
[35:18] meeting uh requesting modification of their conditional use. actually kind of
[35:23] modification of the previous modification of of their traditional
[35:27] use. Uh specifically modifying you may recall there were seven conditions in
[35:33] 2023. The specific modification would be condition number one uh that currently
[35:40] only allows ingress of buses to the access road. And the uh request
[35:47] modification was uh egress for at three periods of time.
[35:55] um once in the morning for eight of stu regular students and one bus for
[36:03] special education students um uh for egress on high trail in in the uh in in
[36:12] the morning specifically at at present time between the hours of 7:30 8 7:55
[36:19] and twice uh in the afternoon uh one approximately typically uh 245
[36:26] uh for um Brady students and one approximately 345 for uh Morland Hill
[36:34] students and the uh Y is the school uh and Hyram [clears throat] presented that
[36:40] um that we'll be able to um and the
[36:45] transportation director um worked all this out that they're expecting delay
[36:50] time to be reduced by 15 Um, and those 8 hour those eight buses
[36:58] represent about 23 cars that would be removed from the queue at um uh at at
[37:05] Gail Allison. Um I I stated at the planning commission that I I thought our
[37:12] job was kind of really summarized kind of by the one line in our conditional
[37:16] use um ordinance and that is that uh the conditional use regulations are quote
[37:23] intended to ensure that conditional uses are reviewed in a reasonable equitable
[37:26] manner while safeguarding property rights of all individuals and the
[37:31] health, safety and welfare of the entire community. In other words, a balancing
[37:34] of property rights, if you will, of of Hyram House uh with the um need to
[37:42] overall um look at the interest of Morland Hills um as a whole. And um in
[37:49] order that for the planning commission to uh to balance those uh we first have
[37:56] really two or two things. Uh first our our police department um and our
[38:03] engineering uh department uh reviewed the situation. Police department
[38:08] actually went out uh and staged um and and examined the uh traffic at those
[38:15] times and also talked with the um transportation director at Orange. And
[38:22] um neither uh bottom line neither uh the the chief nor our engineer felt that um
[38:30] there would be any material traffic delays at high trail uh due to the the
[38:37] staggered nature of of this um uh bus traffic of this egress and bus traffic.
[38:43] Now on the flip side, I thought that it would be helpful in reducing
[38:49] uh the queue on Gail Allison Drive, helpful in reducing traffic um backing
[38:56] up at Sugarin and S and [clears throat] helpful in reducing the possibility that
[39:03] emergency vehicles might get stuck in that queue without being able to get
[39:08] through. Um and so we had a public hearing. Um also there there were um
[39:17] just uh basic besides the school board um individuals who were um who were also
[39:23] residents uh there was one um individual who um who expressed support. There were
[39:31] two individuals that indicated not not so much opposition but that um they
[39:38] didn't want they didn't think more than hills um
[39:43] should and and higher trail should be responsible for what they they they
[39:48] thought was a school issue. Um and the planning commission uh we basically uh
[39:55] and and and I as a council member basically think uh you know this is not
[39:59] just a school issue. Um higher house and school are also institutional residents.
[40:06] Many Mor Hills residents have um have uh children that go to orange schools. But
[40:14] most importantly, um
[40:17] the uh the requested modification is is not expected to
[40:24] hurt and affect Hyram Trail residents based on our engineer and our uh police
[40:31] departments. Its intent is to help and expected to
[40:36] help by again freeing up the queue by um by lessing traffic at some degree and
[40:42] reducing possibility of of hyum. Um and the the other kind of solace uh the
[40:52] other item to to recall is this is really in effect a a two-year
[40:59] modification because recall in two years That will be the fiveyear mark uh where
[41:07] the um hyram house has to come back to us with a new traffic study showing all
[41:14] the alternatives that uh alternative uh to to using a hyum um to um and and how
[41:23] those may or may not require still the need for a hyum and they need uh uh to
[41:30] do that two years from Now, so long story short, um we recommended that
[41:39] council approve um the requested modification
[41:43] to the conditional use, specifically the request to modify condition one to also
[41:49] allow egress on the Hyram Trail of up to eight regular buses and one special
[41:54] education bus in the morning during the 7 to 9:00 a.m. time frame and twice in
[42:01] the afternoon during the 2 to 4:00 time frame. Provided that all other existing
[42:08] conditions 2 through 7 from 2023 um
[42:14] be uh remain in full force in effect. Uh so that's um that's the base. happy to
[42:21] answer any questions and then I could um I got to repeat that in motion form uh

[1:00:06] the last thing was I got an email about the Ohio disability conference. I don't
[1:00:11] know anything about it. Do you all do we go to that? Do we participate in that or

[1:03:23] discussion uh realized that we have a good foundation
[1:03:28] um of those is it four there four or five there's you know five categories
[1:03:34] um we all agreed that what we would do was look at them um you know see if
[1:03:41] there's any modifications that might need to be made and maybe identify uh
[1:03:46] some short-term actions we could take to advance toward the goals uh or even
[1:03:52] something you know longer term uh not not necessarily a a concrete goal but
[1:03:59] something we're always you know working toward. So just just yes would like to
[1:04:05] uh you know remind people to take a look at that hopefully come prepared at the

[1:04:46] I was proposing that I also added at the end of that email that doesn't has that
[1:04:54] has the goal doesn't have the objectives but does have a list of potential action
[1:04:59] items just just FYI. So when you look at it, you know,
