[0:16] Welcome Rick
[0:18] [laughter]
[0:25] everybody. Okay.
[0:27] » Good evening everybody. I'd like to call
[0:29] the August 12 uh 2006 regular council
[0:33] meeting to order at 700 p.m. Would you
[0:36] please stand for the pledge pledge of
[0:37] allegiance?
[0:40] I pledge allegiance to the flag of the
[0:43] United States of America and to the
[0:45] republic for which it stands one nation
[0:49] under God, indivisible with liberty and
[0:53] justice for all.
[0:56] Okay, Sher, would you please call the RO
[0:59] » Here?
[1:02] » Here, Mr.
[1:03] » Melly
[1:04] » Here.
[1:04] » Mr. Richmond
[1:05] » Here.
[1:06] » Mr. V
[1:06] » Here.
[1:08] » Thank you, Sherry. Next up is reading
[1:10] and disposal of the journal. Has
[1:13] everyone had a chance to review the
[1:14] minutes? And are there any recommended
[1:16] changes or updates?
[1:18] » I had one change.
[1:23] » Sorry, Mr. Vincent.
[1:34] Uh the six I think it might be
[1:38] » No page four I'm sorry. Um
[1:42] the ordinance uh 2026 31 it's about one
[1:46] two
[1:49] the end of the fourth sentence. I think
[1:51] we should just add out of the production
[1:52] line quicker.
[1:57] » So what would be that set?
[1:58] » So at the time it was first discussed,
[2:00] it was going to take 30, this is
[2:01] regarding the generator.
[2:03] » So at the time it was first discussed it
[2:04] was going to take 33 weeks to get it,
[2:05] but Mr. Dewater mentioned that they were
[2:07] going to try to get one for us out of
[2:09] the production line quicker, meaning
[2:10] they were going to pull one out of many
[2:13] that [clears throat] they were making.
[2:14] » Thanks for the clarification. Any
[2:16] others?
[2:18] Okay. I'd like to entertain a motion to
[2:20] approve.
[2:20] » Motion to approve as amended. Second.
[2:23] » Okay. We have a motion approved by
[2:24] council president. Seconded by Mr.
[2:25] Richmond. Sh.
[2:26] » M.
[2:27] » Yes.
[2:28] » Mrs. Irish class.
[2:29] » Yes.
[2:29] » Mr. Yankee.
[2:30] » Yes.
[2:31] » Mr. Elliott.
[2:31] » Yes.
[2:32] » Mr. Richmond.
[2:33] » Yes.
[2:33] » Mr. Vincent.
[2:34] » Yes.
[2:35] » Okay. Uh, next up is action upon any
[2:38] matter which any resident may wish to
[2:39] present to council. And I see some very
[2:41] colorful residents in the audience. They
[2:44] may wish to uh say something. I also see
[2:47] for judge. So, let me start. Would
[2:49] anybody like to speak in the orange
[2:51] attire this evening?
[2:53] » Yeah, I would. Would you please
[2:55] introduce yourself for the record?
[2:56] » Yes. David Morad. I'm a a resident of
[3:00] Morland Hills. I am also an educator in
[3:03] higher education for 20 plus years and I
[3:06] have two young children who will be
[3:08] going to the Orange Public Schools uh
[3:10] very shortly. Um, the school district is
[3:13] here about a levy that will be on the
[3:15] ballot in the fall. And as a resident,
[3:18] educator, and parent, I fully support
[3:21] it. The Orange School District has not
[3:23] passed a general operating levy since
[3:25] 2011. That levy, 5 mills, has been in
[3:28] effect for roughly 14 years. And in that
[3:30] time, property tax revenues for the
[3:32] district have risen only modestly, less
[3:35] than a million on average per year, or
[3:38] roughly one and a half%. Meaning they
[3:40] have also failed to keep up with
[3:42] inflation which ran at over two and a
[3:44] half% during that same time. And it's
[3:47] that loss against inflation effect that
[3:49] I try and show a table chart in one of
[3:52] the handouts.
[3:54] As I speak, the elephant in the room
[3:55] with any levy discussion is property
[3:58] taxes. And I recognize some commun
[4:00] community members must be asking
[4:02] themselves, how do schools need more
[4:05] money? Property values have exploded
[4:08] over the past 10-15 years. And since
[4:10] levies come from property taxes on such
[4:12] values, doesn't that mean that the
[4:14] schools have seen a windfall of cash?
[4:16] The short answer is no. Some small
[4:19] gains, yes, but not enough to keep up
[4:22] with inflation and certainly enough not
[4:24] enough to match the skyroing
[4:26] skyrocketing home valuation increases.
[4:29] The more complicated answer lies with
[4:30] Ohio's House Bill 920 enacted in 1976,
[4:34] which generally holds that such school
[4:36] levies collect a fixed or restricted
[4:38] number of dollars rather than a fixed
[4:40] rate. Thus, even if property values
[4:44] rise, the amount collected can stay
[4:47] roughly the same. For orange, this means
[4:50] the skyrocketing home values do not
[4:52] equate to similar gains in school
[4:54] district revenues. The primary chance
[4:56] for additional revenue growth comes from
[4:58] new construction and then a relatively
[5:00] small amount of unvoted millillage. To
[5:03] see how this plays out, just take the
[5:05] 2024 Kyoga County property reappraisal,
[5:08] which recorded a 32% increase in county
[5:11] home values. For Orange District, the
[5:14] assessed value increase wasn't as high,
[5:17] more around 20%.
[5:19] From 1.26 26 billion to 1.51 billion, an
[5:23] increase of roughly $250 million. Yet,
[5:27] none of that money, or next to none of
[5:30] it, is going to the schools.
[5:34] Again, House Bill 920 reduces the rate
[5:37] on voted levies to offset rising values,
[5:40] leaving only the district's 5.2 mills of
[5:43] unvoted millage to collect on that
[5:45] increased value. That millage produced
[5:48] roughly $1.3 million in additional
[5:50] school revenue, about 1.5% of the
[5:53] property value rise. In short, it's a
[5:56] onetime step increase of roughly 2%
[5:59] against a potential tax base increase of
[6:01] 20%. I can give you my own personal
[6:05] story. My property taxes rose in that
[6:08] rep reappraisal by 20%. To almost
[6:11] $1,000.
[6:13] You would think Orangeville school
[6:14] districts would see a lot of that. They
[6:16] see roughly $160 of that. Why? How? How
[6:20] can this be? Where does the rest of it
[6:22] go? It's Ohio, so it's complicated. But
[6:26] one answer is that it simply gets
[6:28] shifted around, transferred among
[6:30] neighbors rather than generating any new
[6:32] tax revenue. Here's one example. how I
[6:35] perused just out of curiosity a few
[6:38] multi-million dollar properties in
[6:40] Morland Hills Orange District area and
[6:42] found several whose property taxes did
[6:44] not shift much at all, much less than
[6:47] the 20% rise that mine did. There was
[6:49] also at least one multi-million dollar
[6:52] property whose tax burden actually fell
[6:55] during that period by nearly eight times
[6:57] the amount that mine went up.
[7:00] I am not calling out any properties and
[7:03] I'm not naming names. I'm simply
[7:05] explaining how the system works that
[7:08] it's a shift between neighbors often
[7:10] rather than any revenue uh generated. So
[7:14] in conclusion, the reality is true. Ohio
[7:17] has a very real property tax problem,
[7:20] but one reason is a problem is because
[7:22] it's almost by design that the schools
[7:25] will be perennially lacking money. by
[7:27] design that revenues cannot keep up with
[7:30] costs. The cost of labor, materials that
[7:33] always are rising in the econom economy,
[7:35] but revenues are always always capped.
[7:39] » Respectfully, I have to ask you to wrap
[7:40] it up because we we usually
[7:42] » None of this I got one small paragraph
[7:43] and then I'm done. None of this is
[7:46] orange school's fault. None of this is
[7:48] the fault of Orange leaders and
[7:49] absolutely none of it is the fault of
[7:51] our children and of our students. the
[7:54] people in this room, the people of
[7:56] Morland Hills, we can't resolve the
[7:58] state issues, but we can resolve
[8:01] hopefully the school levy issue from our
[8:03] own end. I I think we can do that and I
[8:06] believe we should. I thank you for your
[8:07] time. There are additional um uh tables
[8:12] and slides that contain a lot more
[8:14] factual information about what's
[8:16] happening at the school district, where
[8:18] levies have been over the past 20, 30,
[8:21] 40 years, how it's been 15 years since
[8:24] uh Orange went to the voters for a levy
[8:26] and so on and so forth. If you have
[8:28] questions, I or definitely those on the
[8:30] school board, I would be able to take
[8:32] them.
[8:32] » Thank you, Mr. Mor.
[8:33] » Thanks. Or anybody else like to speak
[8:35] this evening? Yeah, I'll yield some of
[8:37] my time to the Orange School since
[8:39] that's probably more important. I make
[8:41] mine shorter. I wasn't planning on
[8:43] talking today. I was just planning on
[8:45] introducing myself, but since you give
[8:47] me an opportunity, I will.
[8:49] » My name is Tim Koharsski. I'm an
[8:51] attorney in Cleveland. I live in Solen.
[8:54] I'm running for the Bedford Municipal
[8:55] Court Judge. It's an open seat in 2027.
[8:58] I've been a trial attorney for 33 years.
[9:01] I represent people on their very very
[9:04] worst days when they're looking at their
[9:06] wives, their children that they may not
[9:08] be able to go home to their wives. They
[9:10] going to lose their freedom. I love what
[9:12] I do. Uh, as I said, I've been an
[9:16] attorney for 33 years. I've been a
[9:19] part-time pro municipal prosecutor. I've
[9:21] been a special prosecutor. I practice in
[9:24] federal court. I practice in all the
[9:25] courts in the state of Ohio. I'm a
[9:27] graduate of the Case Western Reserve
[9:29] University. Uh, I'm been appointed to be
[9:32] on the CGA panel to represent federal
[9:34] criminal defendants. Uh, but at 58 years
[9:38] old, I've determined that I can do more
[9:41] help to people if in fact I'm a judge
[9:43] rather than helping one person at a
[9:45] time. So, I'm looking to be a judge at
[9:48] the court where I think that too often
[9:51] we just put prosecutors in or people
[9:53] that are in the court. I think it's time
[9:55] that we put someone that's actually done
[9:57] in real practice that actually sees what
[9:59] happens to people. I think the court
[10:02] needs to use different alternatives,
[10:05] programming, different whether it's
[10:08] traffic, whether it's driver
[10:09] suspensions. There's a lot of reasons as
[10:11] why people go into municipal court.
[10:12] Municipal court is the low-level court.
[10:14] It's not felony court. It's not common
[10:16] please. It's lowle. There's ways that we
[10:18] can help these people. Uh we don't need
[10:20] to put people in jail for any extended
[10:22] period of time. Uh, I'll be here more uh
[10:25] talking to you about what I intend to
[10:27] do, but just a brief introduction of who
[10:29] I am.
[10:29] » Thank you, Mr. I appreciate you coming
[10:31] this evening.
[10:32] » Would Would anybody else in the audience
[10:34] care to speak this evening?
[10:36] » All right. Well, I thank you for coming.
[10:38] Um, I I will move on then uh to uh
[10:42] report some communications from the
[10:44] mayor and other municipal officials. And
[10:46] I will start. Uh I've got a few updates
[10:49] for council here. The first is um you're
[10:52] all probably wondering what's happening
[10:54] with AT&T since this has been taking
[10:56] quite a long time. So I I'm here to give
[10:58] you an update. Uh Mr. Hannah and I have
[11:01] been uh continuing to have conversations
[11:05] with AT&T,
[11:07] but we also are still getting hung up on
[11:09] the same legal issues that we've been
[11:10] talking about for several months. And um
[11:14] we are at this point um going to step
[11:19] back and and evaluate whether continuing
[11:22] in the current phase or whether other
[11:25] paths may be more sensible here to try
[11:28] to move this thing forward. I get
[11:30] questions from residents all the time
[11:31] about this project. And um and uh I'm
[11:35] I'm anxious to to make progress and
[11:37] we're just not getting there. I don't
[11:39] know Mr. Hannah, if you would like to
[11:41] make a comment or two, feel free.
[11:43] » Sure. Uh, Mayor, I I mean, I would uh
[11:46] echo those comments. I think, you know,
[11:48] we we've had a a long and uh relatively
[11:52] uh comprehensive discussion with AT&T
[11:56] um about, you know, the necessary
[11:58] ingredients from the villages
[11:59] perspective for a lawful agreement that
[12:02] doesn't constitute an um an
[12:05] inappropriate or unlawful subsidy using
[12:08] public funds to a private corporation.
[12:10] And you know it gets a little more
[12:12] complicated than that of course but um
[12:14] but we are continuing to find working
[12:17] through those issues very challenging.
[12:19] And so um one of the options um down the
[12:23] road could be revisiting the RFP that
[12:25] the village issued previously. Um and uh
[12:29] you know thinking about the other
[12:31] respondent I think there was just the
[12:33] one correct
[12:34] » To that and uh and and see you know if
[12:38] we're not able to make this work with uh
[12:40] with AT&T with whom the village has been
[12:42] negotiating um you know it may be
[12:45] possible to commence a different
[12:47] discussion um or to revisit the RFP um
[12:51] itself and and reissue a uh an RFP to
[12:54] try to more carefully calibrate what the
[12:58] village is seeking um visav people who
[13:01] may be interested in providing it.
[13:03] » Thank you. [clears throat]
[13:04] » Sure.
[13:06] » If you have questions, let me know. Um
[13:08] or you can obviously also talk to me
[13:10] anytime. Give me a call or a text and
[13:12] I'd be happy to give you more detail. Uh
[13:14] a few other things. So, I'd like to
[13:17] remind everybody we're having a music
[13:19] event in two days and we have uh Mr. Mar
[13:22] here uh who was spoke this evening who's
[13:25] going to be performing and perhaps his
[13:27] spouse might perform.
[13:28] » Oh, I know.
[13:29] » No.
[13:30] » Okay. Well, we have him and we have
[13:32] three other residents that are going to
[13:33] be sprinkled inter sprinkled in
[13:35] performing with a our our primary act um
[13:41] which is um Jason Patrick Meyers. And I
[13:45] I encourage everybody to come. I looks
[13:47] like the weather's not going to rain.
[13:48] We'll see. It's going to be cloudy, but
[13:49] it looks at least the latest is that
[13:51] it's going to stay dry. So, I hope we
[13:54] can have some fun and I hope hope to see
[13:55] you there. Um, let's see. A couple other
[13:59] things. Um,
[14:02] [clears throat] I want to bring to
[14:03] council's attention something that I had
[14:05] a discussion with the Mr. Water and with
[14:08] Sher, I think it was yesterday or the
[14:10] day before um regarding the pavilion
[14:13] rental process. Um, we continue to have
[14:16] issues with the rental process up there
[14:19] where people are not respecting our
[14:22] rules like emptying their trash. They're
[14:25] drawing um I don't know if it's chalk or
[14:28] pens on the on the heartscape up there
[14:31] that we can't seem to remove. Um they're
[14:35] leaving the bathrooms a complete mess.
[14:37] Um, and we're doing the best. The
[14:40] service department is doing a great job
[14:41] to try to get up there in between
[14:43] rentals, uh, and and take care of
[14:46] things, but I think, uh, I'm going to
[14:48] make some changes to the rules. Uh, I
[14:51] don't care to imple implement them until
[14:54] next year because we've already kind of
[14:56] set the rules for the season and we're
[14:57] sort of getting toward the end of the
[14:59] season. But, um, my proposal, nothing
[15:02] final. I welcome input or call me or if
[15:05] you have any input tonight. Um the
[15:08] primary things that that we discussed
[15:10] that I'd like to do is number one go to
[15:12] full day rentals rather than trying to
[15:14] do half and half because it creates and
[15:16] most other communities are doing kind of
[15:18] full days. So you rent it for the whole
[15:20] day and you've got it the whole time and
[15:22] we're not trying to um run up there for
[15:25] an hour in between two groups and clean
[15:28] everything. Second, I'm going to require
[15:30] a deposit for all rentals. we only
[15:33] require deposit for rentals when um
[15:36] people are food truck
[15:37] » And we're finding that um we're spending
[15:41] extra cost going up there to clean up
[15:42] things that they're supposed to be
[15:44] doing. So I think if we have a a a
[15:46] deposit that is forfeited if some of
[15:50] these things happen, I think we'll be in
[15:52] better shape. And then the third is to
[15:54] raise the rate uh for non-residents. And
[15:57] I don't know what the rate exactly is
[15:58] going to be yet, but um it will be a
[16:03] larger gap between residents and
[16:05] non-residents because I think we have
[16:07] more recourse on residents when they do
[16:08] these things than non-residents and and
[16:11] it's pretty common that other
[16:13] communities either don't rent to
[16:15] non-residents or they charge more. So
[16:17] those are the things that are going on.
[16:18] I welcome your feedback. We're not doing
[16:19] anything till next season like I said,
[16:21] but I think change some changes are in
[16:23] order and I'm going to let you guys know
[16:25] about that. And then the last thing I'll
[16:27] say uh tonight is around power outages.
[16:30] We continue to have them. Um I've been
[16:34] all over I've written many letters.
[16:36] You've seen maybe some of the social
[16:38] media posts that Sherry's helping with.
[16:40] We I've reached out to our elected
[16:43] officials. Um I had our councilman reach
[16:46] out to me again and I told him what
[16:47] we're doing. He said he'll help whatever
[16:49] we can. I think just making our story
[16:52] known that we need more attention from
[16:57] um from First Energy here to address
[16:59] some of these problems. I know it's not
[17:01] a short-term problem, but I'm just going
[17:03] to stay on it. I just think it's it's
[17:04] not acceptable level of service that
[17:06] we're getting. Um and you know,
[17:10] hopefully with the collective voice and
[17:12] some of the other communities around
[17:14] here that are doing similar things,
[17:16] we'll get some action.
[17:17] » [clears throat]
[17:17] » I mean, my next my next step may be to
[17:21] go to Pukco about it, too. I don't know.
[17:23] I haven't done that yet. That's the one
[17:24] thing I haven't done. But anyway, I just
[17:27] wanted you to keep you guys know this is
[17:28] something that's on my agenda.
[17:31] » I just want to add to that. I um we
[17:32] talked to the council
[17:34] um that um I'm I share the survey with
[17:38] Pepper Pike so far so that they can copy
[17:40] it. they can also send it out to their
[17:43] residents and we talked maybe about
[17:44] collectively getting those te that
[17:47] testimonial data data in case we want to
[17:49] go to
[17:50] » So now that that we would have it and if
[17:52] we get Pepper Pike or Bentleyville I
[17:54] think was interested
[17:55] » Mayor has reached out to me as well.
[17:56] » Okay. So I can share the survey with
[17:58] them as well.
[17:59] » Great.
[18:00] » And so I think if we were to get
[18:02] multiple communities together and then
[18:04] compile that testimony data I think we'd
[18:06] have a good case. So
[18:07] » Thank you for that. Thank you for your
[18:09] efforts on it. I appreciate
[18:12] » Maybe I really appreciate that.
[18:14] » Okay, that's all I've got, but thank
[18:16] you. Um, I will move on to our our uh
[18:20] department heads. So, let me start with
[18:23] the police report. I think the chief is
[18:25] on there, but we have the lieutenant in
[18:27] the in the chambers here. So, you guys
[18:30] take it away.
[18:32] » He just messaged me. I think he might
[18:33] have just got bounced out of here.
[18:35] » Okay. Um well, Lieutenant,
[18:37] » The only thing we really wanted to
[18:38] address today is because we brought it
[18:39] up, uh roads and safety at the last
[18:42] meeting, um the flock. So, right now,
[18:45] we're shooting for to get a flock
[18:47] representative if we if we still want to
[18:50] entertain that and open it for anybody
[18:53] uh via Zoom. Uh it would be September
[18:58] 2nd at 7 p.m. is what we're shooting
[18:59] for. We kind of bounce back and forth
[19:02] [clears throat]
[19:02] between some emails.
[19:05] Okay.
[19:06] » So, right now that's that's just what we
[19:08] recommend. Try to get done this way. We
[19:10] can address it all together. We can't we
[19:12] can hear it straight from Fox's mouth on
[19:14] whatever questions or whoever wants to
[19:16] bring whatever up. This way it's we're
[19:17] not playing telephone or just come it
[19:20] can come straight from them.
[19:22] » I appreciate that. Thank you
[19:25] » Juliet for that.
[19:27] » Okay. Thank you. Mr. Dwire, do you have
[19:29] a report this evening?
[19:30] » Uh only thing to report on is for
[19:32] continuing on drive forward
[19:33] replacements. Um, you guys are moving
[19:36] right along with that. And with that, we
[19:39] did have a road culver failure on river
[19:42] road that discussing with Jeff and I
[19:45] think our crews are going to replace
[19:46] that in house.
[19:48] » Okay. Okay. Where what section of river?
[19:50] I didn't see.
[19:50] » So, it's north of Shagrin Boulevard,
[19:53] maybe about 75 ft. There's actually a
[19:56] steel plate on the road covering it
[19:58] right now. And it is properly safe down
[20:02] » Uh patch rounded and pinned. Okay.
[20:04] » And there is signed. All right.
[20:06] » All right. Thank you, Mr. Appreciate
[20:08] that. Uh, let's see. I will move on to
[20:12] the engineers report. Mr. Polarski,
[20:18] you're on mute.
[20:21] He's on mute, right?
[20:30] » Mr. Farsy, are you there?
[20:33] Okay, I will circle back with you, Mr.
[20:35] Farski, and we'll move on and come back.
[20:37] And if you're having any uh technical
[20:39] difficulties there, Mr. Mr. Shaw, have a
[20:42] uh finance report this evening.
[20:44] » Uh yes, here may. Um I have one quick
[20:47] report and I'm trying my for some reason
[20:50] my video won't work. Um
[20:54] so [snorts]
[20:55] our income tax, as I mentioned last
[20:57] month, um is still on the downward trend
[21:00] right now. Um, as of
[21:04] this month, um, August 1st, we were down
[21:08] by approximately 12%.
[21:11] It's just a reminder, you know, for a
[21:13] city or a village like Morland Hills,
[21:15] um, we rely on individual income taxes
[21:18] and, uh, market conditions or what have
[21:21] you, uh, can certainly impact us, um,
[21:24] very rapidly. So in in dollars we are
[21:28] down about $527,000
[21:32] um year to date. Um again our budget was
[21:38] conservatively estimated um at even less
[21:40] than that. So we are fine as far as the
[21:42] budget is concerned. Um but as far as
[21:45] actual cash and revenue collections we
[21:48] are down. So just a heads up.
[21:52] » Other than that don't have a report
[21:54] mayor.
[21:55] » Okay. Thank you. Just are you you've
[21:58] been doing this a long time, Pashant. Do
[21:59] you think this is a timing? Do you have
[22:02] concerns it could be continuing
[22:05] or uh and are there things you think we
[22:07] should be looking at now or watch
[22:09] closely and see later?
[22:12] » Well, you know, a couple of concerns
[22:14] there. Nothing I I guess I I'm going to
[22:16] say income tax up and down. You know,
[22:18] we've seen this over the years. Um and
[22:21] being on the Rita board, I've seen um
[22:25] statewide collections are also down a
[22:27] little bit. So um not alarmed yet. Um
[22:30] but I am concerned about you know all
[22:32] these other talk about property taxes
[22:34] and all those things and if all this
[22:37] comes together with u reduction in
[22:39] income tax revenue which is our main
[22:41] source of revenue and um property tax is
[22:44] also u being discussed
[22:47] um you know we'll have to look at it
[22:49] keep an eye on it and I'm sure you may
[22:52] um are familiar with all the things
[22:53] going on statewide because uh as part of
[22:56] your mayors and managers association
[22:58] they do have discussions on
[23:00] Uh, but I'm I'm certainly keeping my eye
[23:02] on it and keep you informed as we go
[23:04] along.
[23:06] » Okay. I appreciate that, Mr. Shot. Thank
[23:07] you.
[23:08] » You're welcome.
[23:10] » Uh, the building department report uh
[23:13] all on vacation is my understanding. So,
[23:15] I don't think we will have that report
[23:17] this evening. So, uh, Mr. Hanner, do we
[23:19] have a law report this evening?
[23:21] » Um, no, we don't.
[23:22] » We do not. Okay, then I will circle back
[23:24] one more time with Jeff to see if I can
[23:27] get him.
[23:29] Uh, I did text him, but he didn't
[23:31] respond to that. So, maybe he is having
[23:33] some troubles. Jeff going once.
[23:38] Going twice.
[23:40] Okay, Jeff, I'm gonna move. Oh, wait a
[23:43] minute. There he is.
[23:45] » Yeah, sorry about that. I uh mistakenly
[23:48] left my laptop and using my phone and my
[23:51] fingers are fat. So, uh [laughter]
[23:55] I have uh nothing to report. Mayor and
[23:57] Council.
[23:59] » Oh, okay.
[24:00] » After all that,
[24:03] then we will move on to appointments and
[24:06] confirmations. We have none. Uh, no
[24:10] petitions,
[24:12] communications, petitions, and claims
[24:14] this evening. So, I'll move to reports
[24:16] of committees. The first is a report of
[24:19] the BCAM planning on August 3rd. Uh, Mr.
[24:24] Richmond, do you have a report?
[24:25] » Uh, thank you, Mayor. Uh so uh BZA met
[24:30] August 3rd. We just had one item and
[24:33] that was a square footage variance for a
[24:37] detached garage and covered patio at 30
[24:41] Addison Lane and that was uh approved.
[24:45] Um we also uh besides the player house
[24:50] camp matter which uh will come up later
[24:53] in the agenda we had other items. One
[24:58] was the um design for that uh the tax
[25:03] garage at 30 Addison. Uh we also had two
[25:08] um designs for new dwellings. one at 45
[25:12] Stern Crest and one at 110 Meadow Meadow
[25:16] Hill Lane, sorry. Um all three uh were
[25:20] approved. Um all three were were subject
[25:25] to um site plan revisions,
[25:28] engineering uh review and approval and
[25:31] particularly to um new drawings were
[25:35] also subject to a um septic uh permit.
[25:40] uh from the county health district
[25:45] » Conclude planning and BCA.
[25:48] » Thank you, Mr. Richmond. Appreciate it.
[25:50] Um next is the facilities from the
[25:52] meeting report for the meeting on August
[25:54] 4th. Uh Mr. Vincent.
[25:56] » Yes, thank you, Mr. Mayor. Um minutes
[25:58] stand in the in the packet there in the
[26:01] dropbox. Um the highlights uh are that
[26:05] uh the foot bridge replacement has
[26:06] started. In fact, it's going so well
[26:08] that they did another one. So, um, they
[26:11] got some donated clay. I guess it was
[26:12] donated, correct, Ted?
[26:13] » Yeah, donated
[26:14] » From Morland Commons to, uh, kind of
[26:17] help assemble the the kind of earth
[26:19] bridge and, uh, and it's been a good
[26:22] project for the service department. So,
[26:23] that's moving along well. I don't know.
[26:25] Do you have any other reports? Is it
[26:27] actually done this week or is it pretty
[26:29] close to being done or
[26:30] » I know they're uh, we're putting the
[26:31] clay on the second dump for the second
[26:33] bridge today. They were working up
[26:35] there. Rain did slow us down a little.
[26:39] » That's all I wanted to let folks know.
[26:40] Otherwise,
[26:42] » Thanks Mr. Richmond.
[26:44] Mr. Mr. Vincent, my apologies.
[26:50] » Roads and safety also met on August 4th.
[26:53] Mrs. Irish, you have a report.
[26:56] » Um, thank you for mentioning the block
[27:00] system camera system. Um, I was going to
[27:03] mention what you said, so thank you for
[27:05] sharing. Takes that off my list. Um, we
[27:09] did have um an extensive discussion with
[27:11] a resident um of Miles Road in the Scrap
[27:15] Ball Morland Hills area. Um, she had
[27:19] emailed me expressing concern about the
[27:22] the speed in that area on Miles Road.
[27:24] So, she attended the meeting um shared
[27:27] her concerns, talked about how she had
[27:30] um reached out to Shrint Hall's roads
[27:32] and safety committee um as well and how
[27:38] it may um they felt it may have to be a
[27:41] combined effort to take a look at that
[27:43] road if we were going to do anything
[27:45] about it with with the village. Um, but
[27:48] what she's saying is the stretch there
[27:50] between Solen, where Solen Road starts
[27:54] and intersects with Miles heading
[27:56] westbound, um, is currently 35 miles per
[27:59] hour, um, she feels it's it's too high
[28:02] of a speed limit for that area being
[28:04] very, uh, dense in residential um,
[28:08] homes. So, she was coming to ask Beth if
[28:11] we would take a look at it in the area.
[28:14] Um, by the end of the conversation, uh,
[28:17] Chief Diesel stated he'd be happy to
[28:19] install a speed box in the area going
[28:21] westbound, also eastbound to to do a
[28:23] seven-day study to take a look at the
[28:25] speeds. Um, that's currently in process
[28:30] um because it takes some time to get all
[28:31] that, make sure that we're not putting a
[28:34] poll where their utilities are lying.
[28:36] So, um, that's sort of our next steps to
[28:40] evaluate that. Jeff uh Floreski shared
[28:42] that there is a who you know this
[28:46] process that you have to go [laughter]
[28:48] through to change a speed limit of any
[28:50] road. Um there are several factors
[28:52] involved with that. So um at this point
[28:56] we're just we're gathering information.
[28:58] So I wanted to give you all an update on
[29:00] that. Um,
[29:03] I see that we have this later on the
[29:06] agenda, but just briefly, Chief Diesel
[29:09] reported that there is a recommendation
[29:10] from planning to allow eight buses to
[29:12] access the Hyram Trail three times per
[29:15] day. And then uh finally,
[29:19] Mr. Farski shared that um there's a
[29:22] challenge of developing a storm water
[29:25] drainage system around East and West
[29:27] Juniper.
[29:29] um and he discussed several different
[29:31] options of how to address that. Um we're
[29:36] still in discussions on or he's still in
[29:38] discussions on trying to figure out the
[29:40] best option is. So that's where we are.
[29:43] » That's it.
[29:44] » Thank you very much.
[29:45] » If I may really quick, the speed box on
[29:47] Miles Road eastbound is already up. So
[29:49] it's pulling data to see if we actually
[29:51] do have a speed problem there. The
[29:53] officers have been sitting there pretty
[29:54] much every shift right now day and
[29:56] night. Uh we're doing like two 30 minute
[29:59] uh stretches there. So we're not just
[30:01] camping there and then nobody's moving
[30:03] at all. So uh we haven't had any
[30:06] violations whatsoever yet. The speed box
[30:08] is pulling data. So when users not there
[30:12] speed box is doing its thing. We did
[30:14] mark one of the polls. Oops. Is did oops
[30:17] already come out?
[30:18] » Oops. So we put poll up tomorrow.
[30:20] » So the poll will be up tomorrow for the
[30:22] westbound traffic. Then we'll be
[30:23] monitoring one week eastbound and
[30:25] westbound traffic with our speed boxes
[30:27] and it'll give us data on flow rates,
[30:30] how many vehicles are coming and going
[30:33] and then speeds.
[30:36] » Thank you very much, Tom. Appreciate
[30:37] that.
[30:40] » Okay. Uh parks commission met on July
[30:44] 20th. Uh Mr. Yon, do you have a report?
[30:47] Uh yeah, I was not in attendance, but I
[30:49] did speak with the um with the treatment
[30:53] works chair about it. Uh really only uh
[30:57] I'll let the minutes stand. Only other
[30:59] you know follow up with uh the mayor
[31:01] already stated this Friday
[31:04] and the Hills if you could come up and
[31:06] support it be great.
[31:08] » Thank you council president. Appreciate
[31:10] that. Uh next is the DEIB commission
[31:13] that met on July 21st. Uh, Miss Davis or
[31:17] Mr. Richmond, do any of either of you
[31:19] have a report?
[31:20] » I have a a brief one. Thank you, Mayor.
[31:23] Uh, minutes um not yet available due to
[31:27] some uh of personal reasons of uh the
[31:32] officers, particularly the minute
[31:34] writing officer. Um, so quick
[31:36] highlights. Uh first of all, regarding
[31:40] ongoing projects, um not too late to get
[31:43] your recipes in
[31:46] for the cookbook, a lot have been in um
[31:49] and they're in the process of figuring
[31:52] out how best to display them on their uh
[31:55] on the DDI web page. Uh this Saturday,
[31:59] August 15th, from 10 to 2, uh the
[32:03] commission will have a table at the
[32:05] Orange Arts Center. I believe they'll be
[32:08] um
[32:10] sponsoring a uh drawing of faces of our
[32:14] community uh uh craft at the DEIV table.
[32:19] Uh it should be a great event. Um
[32:24] [clears throat] the um joint book club
[32:27] with uh green commission um regarding
[32:31] the book grading sweetg grass has been
[32:33] set for October 22nd at 6:30 uh p.m. Uh
[32:40] the we are Morland Hills event. Uh
[32:42] everybody is working very hard to make
[32:44] this bigger and better than it has been
[32:47] before. Um, so far the food truck Frosty
[32:51] Gator will be there. Uh, Blue Cadillac
[32:54] will be there uh for the first uh hour
[32:57] and a half or so and then there'll be uh
[32:59] line dancing for the second hour and a
[33:01] half which should be fun. Uh there'll be
[33:04] again resource tables and a cornole
[33:07] tournament and um potential uh stuff uh
[33:11] for kids. Um there's a food bank
[33:15] volunteer opportunity November 12th from
[33:18] 6:00 to 8. Uh the web page as well as um
[33:24] we are more than host there will be
[33:26] forums if anybody wants to uh join those
[33:32] uh join those volunteering and um that's
[33:36] the uh that's the base of kindness.
[33:39] » Thanks again Mr. Richmond. Appreciate
[33:40] it. Uh let's see. Last is the green
[33:43] commission from two meetings July 8th
[33:45] and August 5th. Uh Mrs. Irish class,
[33:48] would you like to make comments or
[33:51] » Um we had a free cycle of that this past
[33:53] Sunday. It was several people attended
[33:56] and took away many bags of items
[33:58] including myself. Um so that was that
[34:02] was good. Um we had um two meetings ago,
[34:06] the rust belt writers presentation was
[34:08] very informative. Um, I learned a lot um
[34:12] about food waste and how much it's
[34:14] contributing to the to the methane and
[34:16] the in the atmosphere and um they will
[34:20] be bringing they're they're still taking
[34:22] a look at pricing and bringing some
[34:23] options to the village as far as what
[34:26] that might look like.
[34:30] » All right. Thank you. That that
[34:32] concludes reports of committees. So move
[34:34] on to uh approval of bonds, contracts,
[34:38] plats. Uh in this section, we do have
[34:41] something we've put there, which is the
[34:43] Hyram House camp uh conditional use
[34:45] modification
[34:47] uh to allow egress onto Hyum Trail for
[34:50] up to eight regular buses and one
[34:52] special education bus during specified
[34:54] time periods. Uh Mr. Richmond, are you
[34:57] going to present this this evening?
[34:59] » I I will. Thank you very much. Uh so it
[35:02] it's um you know a high room house camp
[35:06] uh requested
[35:08] informally in some preliminary hearings
[35:11] uh and formally at the uh public hearing
[35:15] at uh the the last planning commission
[35:18] meeting uh requesting modification of
[35:22] their conditional use. actually kind of
[35:23] modification of the previous
[35:25] modification of of their traditional
[35:27] use. Uh specifically modifying you may
[35:30] recall there were seven conditions in
[35:33] 2023. The specific modification would be
[35:36] condition number one uh that currently
[35:40] only allows ingress of buses to the
[35:44] access road. And the uh request
[35:47] modification was uh egress for at three
[35:52] periods of time.
[35:55] um once in the morning for eight of
[36:00] stu regular students and one bus for
[36:03] special education students um uh for
[36:06] egress on high trail in in the uh in in
[36:12] the morning specifically at at present
[36:14] time between the hours of 7:30 8 7:55
[36:19] and twice uh in the afternoon uh one
[36:23] approximately typically uh 245
[36:26] uh for um Brady students and one
[36:30] approximately 345 for uh Morland Hill
[36:34] students and the uh Y is the school uh
[36:38] and Hyram [clears throat] presented that
[36:40] um
[36:42] that we'll be able to um and the
[36:45] transportation director um worked all
[36:48] this out that they're expecting delay
[36:50] time to be reduced by 15
[36:53] Um, and those 8 hour those eight buses
[36:58] represent about 23 cars that would be
[37:01] removed from the queue at um uh at at
[37:05] Gail Allison. Um I I stated at the
[37:09] planning commission that I I thought our
[37:12] job was kind of really summarized kind
[37:14] of by the one line in our conditional
[37:16] use um ordinance and that is that uh the
[37:21] conditional use regulations are quote
[37:23] intended to ensure that conditional uses
[37:25] are reviewed in a reasonable equitable
[37:26] manner while safeguarding property
[37:29] rights of all individuals and the
[37:31] health, safety and welfare of the entire
[37:32] community. In other words, a balancing
[37:34] of property rights, if you will, of of
[37:37] Hyram House uh with the um need to
[37:42] overall um look at the interest of
[37:45] Morland Hills um as a whole. And um in
[37:49] order that for the planning commission
[37:52] to uh to balance those uh we first have
[37:56] really two or two things. Uh first our
[37:59] our police department um and our
[38:03] engineering uh department uh reviewed
[38:06] the situation. Police department
[38:08] actually went out uh and staged um and
[38:12] and examined the uh traffic at those
[38:15] times and also talked with the um
[38:18] transportation director at Orange. And
[38:22] um neither uh bottom line neither uh the
[38:26] the chief nor our engineer felt that um
[38:30] there would be any material traffic
[38:33] delays at high trail uh due to the the
[38:37] staggered nature of of this um uh bus
[38:41] traffic of this egress and bus traffic.
[38:43] Now on the flip side, I thought that it
[38:46] would be helpful in reducing
[38:49] uh the queue on Gail Allison Drive,
[38:52] helpful in reducing traffic um backing
[38:56] up at Sugarin and S and [clears throat]
[39:00] helpful in reducing the possibility that
[39:03] emergency vehicles might get stuck in
[39:06] that queue without being able to get
[39:08] through. Um and so we had a public
[39:12] hearing. Um also there there were um
[39:17] just uh basic besides the school board
[39:20] um individuals who were um who were also
[39:23] residents uh there was one um individual
[39:27] who um who expressed support. There were
[39:31] two individuals that indicated not not
[39:34] so much opposition but that um they
[39:38] didn't want
[39:41] they didn't think more than hills um
[39:43] should and and higher trail should be
[39:46] responsible for what they they they
[39:48] thought was a school issue. Um and the
[39:51] planning commission uh we basically uh
[39:55] and and and I as a council member
[39:56] basically think uh you know this is not
[39:59] just a school issue. Um higher house and
[40:04] school are also institutional residents.
[40:06] Many Mor Hills residents have um have uh
[40:12] children that go to orange schools. But
[40:14] most importantly,
[40:16] um
[40:17] the uh the requested modification is is
[40:22] not expected to
[40:24] hurt and affect Hyram Trail residents
[40:28] based on our engineer and our uh police
[40:31] departments.
[40:33] Its intent is to help and expected to
[40:36] help by again freeing up the queue by um
[40:40] by lessing traffic at some degree and
[40:42] reducing possibility of of hyum. Um and
[40:49] the the other kind of solace uh the
[40:52] other item to to recall is this is
[40:55] really in effect a a two-year
[40:59] modification because recall in two years
[41:03] That will be the fiveyear mark uh where
[41:07] the um hyram house has to come back to
[41:10] us with a new traffic study showing all
[41:14] the alternatives that uh alternative uh
[41:17] to to using a hyum um to um and and how
[41:23] those may or may not require still the
[41:27] need for a hyum and they need uh uh to
[41:30] do that two years from Now, so long
[41:34] story short, um we recommended that
[41:39] council approve um the requested
[41:42] modification
[41:43] to the conditional use, specifically the
[41:45] request to modify condition one to also
[41:49] allow egress on the Hyram Trail of up to
[41:52] eight regular buses and one special
[41:54] education bus in the morning during the
[41:57] 7 to 9:00 a.m. time frame and twice in
[42:01] the afternoon during the 2 to 4:00 time
[42:03] frame. Provided that all other existing
[42:08] conditions 2 through 7 from 2023
[42:13] um
[42:14] be uh remain in full force in effect. Uh
[42:18] so that's um that's the base. happy to
[42:21] answer any questions and then I could um
[42:25] I got to repeat that in motion form uh
[42:29] in order to uh to make a motion to
[42:32] approve
[42:35] » Commission recommendation
[42:37] » For the record you had mentioned that
[42:38] Hyram House has to come back in two
[42:40] years to with a new plan and I think you
[42:42] mean orange schools
[42:43] » Well I actually mean hire house because
[42:45] they're the applicant
[42:46] » They're [clears throat]
[42:48] I mean schools will will come with them
[42:51] and the schools put together the traffic
[42:53] study but high house is the actual
[42:55] » They own they own they own
[42:57] » They own the land own
[43:01] » So they are very
[43:03] » If they didn't if they didn't want to do
[43:04] it the school couldn't come and sit on
[43:06] » Okay
[43:08] » Correct
[43:12] » Thank you Mr. Richmond. Any uh questions
[43:14] or clarifications from anybody? I I'd
[43:17] just like to make a comment that I was
[43:19] at the meeting. I'm happy to uh serve on
[43:21] the same planning commission. And um I
[43:25] support this modification. I'm not a
[43:28] vote tonight, but I just want to let
[43:30] council know I support the modification.
[43:31] I think it's the right thing to do to
[43:33] support our schools. And I do think we
[43:35] need to uh make it clear to the schools
[43:38] though that they need to make more
[43:40] progress on evaluating options by the
[43:42] time they come back in two years because
[43:45] that was the expectation three years ago
[43:47] and uh I stated that at the meeting but
[43:50] I just want to let you guys know.
[43:52] » Appreciate that. Um if there's no other
[43:55] questions, I'm I'm definitely assuming
[43:58] um that um this is the the proper um
[44:04] method to approve a conditional use by
[44:06] motion that
[44:09] » Consistent with the council's past
[44:10] practice.
[44:11] » All right, great. So, I I'm I'm make a
[44:14] motion that um we approve the requested
[44:19] um modification to the existing
[44:22] conditional use. specifically that we
[44:25] approve the request to modify condition
[44:31] one of the seven conditions uh currently
[44:36] in force uh to allow [clears throat]
[44:40] egress onto Hyru Trail of up to eight
[44:43] regular buses and one special education
[44:45] bus in the morning during the 7 a.m. to
[44:48] 9:00 a.m. time frame and twice in the
[44:51] afternoon during the 2:00 p.m. to 4:00
[44:53] p.m. time frame provided that all the
[44:57] other conditions two through seven
[45:00] of the current conditional use remain in
[45:03] full force and effect.
[45:05] » Second.
[45:06] » Okay, we have a motion Mr. Richmond
[45:09] seconded by I couldn't hear. I think it
[45:10] was Mr. Melly.
[45:12] » Yes, sir.
[45:13] » Out of time.
[45:14] » Mr. [laughter]
[45:16] » Both sides of Steve
[45:19] Sher, would you call the rules?
[45:21] » Sados.
[45:22] » Yes.
[45:22] » Mr. Squ. Yes,
[45:23] » Mr. Yankee.
[45:24] » Yes,
[45:25] » Mr. Melly.
[45:26] » Yes,
[45:27] » Mr. Richmond.
[45:28] » Yes,
[45:28] » Mr. Vza.
[45:29] » Yes.
[45:30] » Okay. Thank you, Mr. Richmond. I will
[45:32] move on. I think I'm moving right on to
[45:34] ordinances. So, the first ordinance this
[45:37] evening is 2026-34,
[45:40] an ordinance authorizing the mayor to
[45:42] execute a contract with Mr. Excavator,
[45:44] Inc. for the village complex retaining
[45:48] wall project and declaring an emergency.
[45:50] Mr. Vincent, will you be presented? I
[45:52] will. Thank you, Mr. Mayor. Um, so yeah,
[45:55] so there were five bids received for the
[45:57] uh comp village complex retaining wall,
[45:59] which includes all the wall behind the
[46:01] police station all the way down to the
[46:03] sally port. Um, so it's pretty big uh
[46:06] pretty big area. Um, there were good
[46:08] bids. There were five of them, like I
[46:09] said, and they were pretty tight uh to
[46:11] each other, ranging from 162,500
[46:14] to 183,288
[46:17] with the lowest uh bid being Mr.
[46:20] Excavator Inc. at 162500.
[46:23] Um and uh uh Mr. Blowski informed us
[46:27] that the um at the facilities meeting
[46:29] that the Mr. Estavator is actually
[46:31] responsible for the site work on on the
[46:34] village campus here. So they are
[46:35] familiar with our site. Um which I was
[46:37] happy to hear because they're going to
[46:38] be taking down a retaining wall and just
[46:39] leaving it, you know, exposed for a
[46:41] while. So so they have familiarity. Um
[46:44] so with that, I would uh recommend that
[46:46] we pass this make a motion to suspend.
[46:49] » Second. Okay. Minion to suspend the rule
[46:51] seconded by council president Sherry.
[46:54] » Miss David,
[46:55] » Yes.
[46:55] » Mrs. Irish class.
[46:56] » Yes.
[46:56] » Mr. Yaki.
[46:57] » Yes.
[46:58] » Mr. Melly.
[46:59] » Yes.
[46:59] » Mr. Richmond.
[47:00] » Yes.
[47:00] » Mr. Vincent.
[47:01] » Uh, yes. Any questions?
[47:07] None. Okay. I'll make a motion passage,
[47:09] please. Second. Okay. We motion passes.
[47:12] Second by Mr. Nelly. Would you please
[47:14] call the role?
[47:15] » Miss Deas?
[47:16] » Yes.
[47:16] » Mrs. Irish Glass?
[47:18] » Yes.
[47:18] » Mr. Yaki?
[47:19] » Yes.
[47:19] » Mr. Melly.
[47:20] » Yes.
[47:21] » Mr. Richmond.
[47:22] » Yes.
[47:22] » Mr. Vinc.
[47:23] » Yes.
[47:23] » Okay. Thank you, Mr. Vincent. I'll move
[47:25] on to 2026-35,
[47:28] an ordinance amending section 157.03,
[47:32] members terms of chapter 157 parks
[47:36] commission of the codified ordinances to
[47:38] delete the language permitting a
[47:39] community member to serve
[47:42] an an additional term and to modify the
[47:45] term length. Um, it should say
[47:49] prohibiting a community member to serve
[47:51] an additional Oh, no. No, excuse me. I'm
[47:53] sorry. That is correct. Permitting a
[47:55] community member to serve an additional
[47:56] term and to modify the term length for
[47:58] two appointments made at year end 2026
[48:01] and declaring an emergency. And council
[48:03] president,
[48:05] » Thank you. Thank you. Um so this was
[48:08] made uh because we are coming up on uh
[48:12] eight years of the uh of the creation of
[48:16] the uh parks commission. Um and we've
[48:20] realized that we would have a quite a
[48:24] few uh members essentially turn limited.
[48:27] Uh this is the only commission that had
[48:30] was set up as such. Uh and we found it
[48:33] best practice to align it with the other
[48:35] commissions. um that people would like
[48:37] to continue to serve uh then they should
[48:40] be afforded that uh afforded that uh
[48:45] availability. So basically the language
[48:48] um also uh since it it changes two of
[48:52] the appointments though and we have uh
[48:54] there's some staggering in there versus
[48:57] all four terms because when someone
[48:59] comes on uh you know if someone uh steps
[49:03] away the new member assumes the balance
[49:06] of that term so it doesn't start four
[49:08] years it'd be time to join. So that way
[49:10] we've got a little uh overlap so we're
[49:13] not okay everybody we know all new
[49:16] people come in and you kind of lose that
[49:18] continuity of of what we've been doing.
[49:20] So that was what uh what uh this
[49:24] ordinance addresses um with that I'd
[49:27] like to suspend the rules. Second
[49:30] suspend the rules second by Mr. Vincent
[49:33] Sherry.
[49:33] » Yes. M David.
[49:34] » Yes.
[49:34] » Mrs. Irishb
[49:36] » Mr. Yankee.
[49:37] » Yes.
[49:37] » Mr. Millie.
[49:38] » Yes.
[49:38] » Mr. Richmond.
[49:39] » Yes.
[49:40] » Mr. Veteran.
[49:41] » Yes.
[49:42] » Any questions?
[49:47] Like to make a move for passage.
[49:51] Second by Miss.
[50:01] » Yes.
[50:02] » Yes.
[50:04] » Yes.
[50:05] » Yes.
[50:06] » Okay. Thank you, council president.
[50:09] Next up is 2026-36,
[50:12] an ordinance creating the police capital
[50:14] and equipment replacement fund within
[50:15] the financial records of the village of
[50:17] Mormon Hills and declaring an emergency.
[50:20] Miss Davis.
[50:21] » Yeah. So, um I think we talked last time
[50:23] or the time before about um needing u to
[50:27] separate the funds or Mr. Shaw had
[50:29] talked about this um uh from the
[50:32] auditors that they have to segregate the
[50:33] reserves um the police and service. So
[50:36] they're um establishing this is to
[50:38] establish two distinct funds. Um and uh
[50:43] let's see if there's anything else I
[50:44] said about it. Um yeah, this is to set
[50:47] aside reserves for future capital
[50:48] equipment needs in the police department
[50:51] and um the equipment replacement fund u
[50:54] which is the same fund that they were
[50:56] using for the reserves for the service
[50:57] department. So this is essentially just
[50:59] separating them into two distinct funds
[51:01] to comply with the auditor. Um and Mr.
[51:05] shot and letting if you have anything
[51:07] else you'd like to add to that. I
[51:08] probably covered that.
[51:10] » No, I think you did just fine. Thank
[51:13] you. You covered it well.
[51:15] » All right. Um, I'd like to make a motion
[51:17] to suspend the rules.
[51:19] » Second. [clears throat]
[51:20] » Okay. We have a motion to suspend the
[51:21] rules. Second by Mr. Vincent. Would you
[51:23] call?
[51:24] » Mos.
[51:25] » Yes.
[51:25] » Mrs. Irish.
[51:26] » Yes.
[51:27] » Mr. Yaki.
[51:28] » Yes.
[51:28] » Mr. Milly.
[51:29] » Yes.
[51:29] » Mr. Richmond.
[51:30] » Yes.
[51:31] » Mr. Vincent.
[51:32] » Yes.
[51:33] » Okay. Any questions?
[51:37] » Okay.
[51:39] Passage.
[51:39] » Second.
[51:40] » Hey, we have M passage. Seconded by Mr.
[51:42] Richmond. Sherry.
[51:44] » Mel.
[51:45] » Yes.
[51:45] » Mr. Clutz.
[51:46] » Yes.
[51:47] » Mr. Yankee.
[51:48] » Yes.
[51:48] » Mr. Mlly.
[51:49] » Yes.
[51:49] » Mr. Richmond.
[51:50] » Yes.
[51:51] » Mr. Vincent.
[51:52] » Yes.
[51:52] » Okay. Thank you. I'll move on to
[51:54] 2026-37,
[51:56] an ordinance creating the service
[52:00] capital and equipment replacement fund
[52:03] within the financial records uh of the
[52:06] village of Mormon Hills and declaring an
[52:08] emergency and that will be presented by
[52:11] Miss Class.
[52:14] [laughter]
[52:19] » Thought I was reading the same one
[52:20] already.
[52:23] for the artifact author's recommendation
[52:25] to segate segregate the two reserve
[52:27] funds placed similar to um organs in
[52:32] establishing accumulation of reserves
[52:34] for future capital and support.
[52:38] So um I'd like to make a motion to
[52:40] suspend rules second.
[52:42] » Okay, we have a motion to suspend the
[52:43] rules seconded by Miss Davos. Would you
[52:47] roll?
[52:47] » Mos.
[52:48] » Yes. Mrs. Irish class.
[52:49] » Yes.
[52:50] » Mr. Yankee.
[52:51] » Yes.
[52:51] » Mr. Melly,
[52:52] » Yes.
[52:52] » Mr. Richmond,
[52:53] » Yes.
[52:54] » Mr. Vincent,
[52:54] » Yes.
[52:56] » Any questions, comments?
[53:00] » Motion. I'd like to make a motion for
[53:01] passion
[53:03] for pass. Second by Mr. Vincent.
[53:05] » Okay.
[53:07] » Miss David,
[53:07] » Yes.
[53:08] » Mrs.
[53:09] Mr. Yankee,
[53:10] » Yes.
[53:11] » Mr. Melly,
[53:12] » Yes.
[53:12] » Mr. Richmond,
[53:13] » Yes.
[53:13] » Mr. Vincent,
[53:14] » Yes.
[53:15] » Okay. And our last ordinance this
[53:17] evening is 2026-38.
[53:20] An ordinance providing additional
[53:21] appropriations, transferring items
[53:22] already appropriated and declaring an
[53:24] emergency will be presented by Mr. Mali.
[53:27] Sir,
[53:28] » Yes, thank you, Mr. Chair. Uh so this is
[53:30] part of our monthly housekeeping. Uh it
[53:32] is providing certain expenditures for
[53:34] village hills for the uh fiscal year. Uh
[53:38] there is an exhibit A attachment uh that
[53:41] is public record uh discuss the precise
[53:43] amounts uh for engineering study for
[53:46] health insurance for some miscellaneous
[53:48] cabinet expenses and for some refunds.
[53:51] Uh these are detailed out in in that uh
[53:56] in the exhibit A attachment. Um again
[53:58] this just normal housekeeping that we do
[54:00] to transfer funds.
[54:06] Uh with that, I'll make a motion to
[54:08] spell the rules.
[54:11] » Second.
[54:12] » We have a second
[54:14] by Mr. Vinc.
[54:18] » Yes.
[54:18] » Mrs. Irish.
[54:19] » Yes. Mr. Yaki.
[54:20] » Yes.
[54:21] » Mr. Mi.
[54:21] » Yes.
[54:22] » Mr. Richmond.
[54:23] » Yes.
[54:23] » Mr.
[54:24] » Yes. Are there any questions? Was the
[54:28] engineer studying?
[54:31] » Uh that related something we already
[54:33] did. Well, that I would need to ask a
[54:36] shot. Not the engineering study, uh, the
[54:39] $10,000 allocated for the engineering
[54:40] study.
[54:42] » Right. So, for the year we had budgeted
[54:44] about $40,000. Um, and I think we've had
[54:47] some additional projects come along the
[54:49] way. Um, and right now we are about
[54:52] 5,000 short in that fund. What I'm doing
[54:54] is adding another five additional 5,000
[54:57] which hopefully will take us through the
[54:58] rest of the year. So, the total budget
[55:00] for the year will be about 50,000.
[55:04] Oh, I see. It's really more so
[55:05] engineering studies plural rather than
[55:10] study, right?
[55:11] » I'm sorry. I should have clarified. So,
[55:13] those are all expenses for engineers
[55:15] bills for any projects that he's worked
[55:17] on so far this year.
[55:19] » Got it. Thank you.
[55:24] » Appropriation, right? Again, it's not a
[55:25] specific.
[55:26] » Yeah. Yeah.
[55:29] Okay. Oh, make a motion for us.
[55:34] » Okay. We have motion. Motion for passes.
[55:36] Seconded by Miss David. Would you please
[55:39] » Miss David?
[55:40] » Yes.
[55:40] » Mrs. M.
[55:42] » Yes.
[55:43] » Mr.
[55:43] » Yes.
[55:44] » Mr. Richmond.
[55:45] » Yes.
[55:45] » Mr. Vincent.
[55:46] » Yes.
[55:47] » Okay. Thank you, council. That concludes
[55:49] ordinances this evening. I'll move on to
[55:52] miscellaneous business by members of
[55:54] council. Does anyone have miscellaneous
[55:56] business this evening?
[55:58] I guess I have a question. Going back to
[56:00] the opening uh update on the AT&T or the
[56:05] fiber, um if we were to go back for RFP,
[56:10] um would you envision that it would be
[56:11] the same sort of process for getting
[56:14] back to help us and all that?
[56:16] » I do not envision that. I think we could
[56:19] do it on our own with Mr. Hannah,
[56:20] honestly, because I think we have most
[56:22] of what we got there. And I think some
[56:24] of the the legal stuff that we failed to
[56:26] put in the first one,
[56:28] » Um, Mr. Hannah would assure that we have
[56:30] got it.
[56:31] » Um, I will tell you, I've also had, uh,
[56:34] Omni Fiber reach out to me. I've had,
[56:38] um, Spectrum reach out to me. Again,
[56:42] [clears throat]
[56:43] I'm not sure that that one is viable,
[56:45] but there's a new group within Spectrum,
[56:48] Hope Springs Eternal, and they um and
[56:52] they're now trying to market larger
[56:54] projects.
[56:55] » I have no idea what that really means.
[56:57] It was just a one conversation, but
[57:00] they're going to come back to me as
[57:01] well.
[57:02] » Um and my if we go this route again, we
[57:05] haven't Yeah,
[57:05] » Sure. They've done it. I I would imagine
[57:07] that Sugar Valley Geek may still have
[57:10] interest, although they they're pretty
[57:12] bogged down with a lot of work that they
[57:14] have right now is my understanding. But
[57:15] it'd be interesting to see if they did
[57:17] ramp up as they intended to in terms of
[57:19] the
[57:20] » Capacity they have for you know
[57:24] one nice thing about the fact
[57:28] » We haveations that we will not have the
[57:31] same similar issues or we don't know as
[57:34] of yet
[57:37] with with
[57:39] that that we're having with AT&T.
[57:42] » Uh I don't know that I can answer that.
[57:44] I don't think I really know.
[57:46] » That would be just sort of be guessing
[57:48] at the moment.
[57:49] » Yeah, that's just wondering whether we
[57:51] had a sense of
[57:52] » But I think that if I think that if the
[57:54] conversation is framed Sorry
[57:57] if the conversation is framed
[57:58] differently um you know and maybe
[58:01] keeping in mind the experience that
[58:03] we've had, we can avoid some of that.
[58:05] And if the step of reformulating an RFP
[58:09] were taken and reissuing that, of
[58:10] course, we would be really clear about,
[58:12] you know, avoiding some of those
[58:14] pitfalls.
[58:14] » Sure.
[58:15] » Okay.
[58:15] » I guess a bit since we go from the scam.
[58:18] Uh, do we know how much of the village
[58:20] now has been covered by AT&T? I think it
[58:22] was close to 20% back in January, March
[58:25] or so. And they
[58:27] » I do not know that answer. I certainly
[58:29] that would rebase any expectations we
[58:31] would have for fewer households for any
[58:33] RP we put out.
[58:35] » I would assume
[58:37] » Um
[58:40] I would suspect that too. Well, unless
[58:42] we wanted to give them choices beyond.
[58:44] » Sure.
[58:45] » Yes.
[58:46] » I guess the other the other question is
[58:48] given the shortfall that was reported
[58:50] today that we're already half a million
[58:52] short of expected.
[58:55] » Would there be a consideration of
[58:57] wanting to keep our powder dry, you
[58:59] know, to the $200 million?
[59:01] » Very good point. I think before we were
[59:04] um proate, we would have that
[59:06] discussion.
[59:08] No doubt.
[59:10] Anybody
[59:12] else have any slips?
[59:14] » Yeah, I just had um I just had actually
[59:16] a couple quick things. Um one was um the
[59:20] survey. I was just going to leave open
[59:22] for the month unless anyone had any
[59:24] ideas to close it. I just assume that
[59:27] we'll have more power outages and more
[59:28] people be like, "Yeah, let's fill this I
[59:30] think August is a good monthly
[59:35] especially if we're going to have other
[59:37] you know um aing communities giving the
[59:40] survey as well. I feel like a while but
[59:43] I just wanted to check with everyone.
[59:44] And then um the second thing um was uh
[59:48] about the um some of you had sent um
[59:50] stuff about the internship. Um and so I
[59:53] I was just going to recommend thinking
[59:55] about spec I didn't put specific dates
[59:56] in anything and I didn't put specific
[59:58] number of reference letters or any of
[59:59] that. So maybe thinking about all those
[1:00:01] things before the next council's whole
[1:00:04] meeting then we can work that out. And
[1:00:06] the last thing was I got an email about
[1:00:08] the Ohio disability conference. I don't
[1:00:11] know anything about it. Do you all do we
[1:00:13] go to that? Do we participate in that or
[1:00:15] do we get anything out of that? Like
[1:00:17] what is that about someone?
[1:00:18] » We we do get materials from the Ohio
[1:00:21] Municipal League, but I don't believe
[1:00:24] we're members.
[1:00:25] » Okay. I just get these emails.
[1:00:27] » Oh, we are.
[1:00:27] » Oh, okay.
[1:00:28] » Oh, we know was a different one. I'm
[1:00:29] think there's multiple organizations
[1:00:33] like this and some we've chosen not to
[1:00:35] participate. Maybe OML. We do.
[1:00:37] » We do.
[1:00:37] » We do get a newsletter from them. Like
[1:00:39] I'll read from time to time. It'll be a
[1:00:41] legislative update from them saying this
[1:00:44] is what's going on Columbus. This is the
[1:00:46] impact of local communities. And I like
[1:00:48] to be able to read those things.
[1:00:49] » Okay.
[1:00:50] » But I've never been to a conference that
[1:00:53] » The reason I bring it up is they had
[1:00:55] » Oh, so I was just going to say I they
[1:00:56] the village sent when I first goed
[1:01:00] to OML sponsored new newly elected
[1:01:04] officials. Very helpful.
[1:01:06] » Yeah, we did that one I think. But um
[1:01:08] this other one that they were having, I
[1:01:09] I just saw that they were talking about
[1:01:10] three different things that might be
[1:01:12] useful for us. Like one was um Ohio
[1:01:14] property taxes. I know we're kind of
[1:01:16] dealing with that. Um and then the
[1:01:18] energy landscape was one of them. So So
[1:01:21] I don't know if that's something we
[1:01:23] think about doing. I guess next month or
[1:01:25] something.
[1:01:25] » Their annual annual conference.
[1:01:27] » Yeah. September 30th, October 2nd. So I
[1:01:29] don't know that
[1:01:30] » Thomas
[1:01:31] » I
[1:01:33] saw the email before I came in here
[1:01:35] today.
[1:01:37] Um,
[1:01:37] » We could take a look at it and I mean I'
[1:01:39] I'd be supportive of if someone wants to
[1:01:41] attend or um depending on when it is I
[1:01:45] could possibly attend. I don't know. I
[1:01:46] haven't seen whether I could make it.
[1:01:48] But
[1:01:48] » You can get those by the way by email if
[1:01:50] you would
[1:01:52] have to get them every Friday.
[1:01:54] » Okay.
[1:01:54] » Because I went to that one conference
[1:01:55] and they come on the list. [laughter]
[1:01:57] » Well, maybe that's why.
[1:01:59] » Yeah.
[1:02:00] » But it looks it looks like it might be
[1:02:01] useful. some of the topics might be
[1:02:02] useful uh to us specifically with all
[1:02:05] things that we're dealing with right
[1:02:06] now. Um so that was just a thought I
[1:02:08] had. That's it.
[1:02:09] » Thank you. I appreciate that.
[1:02:14] » Anybody else have anything?
[1:02:16] » Just wanted to confirm that everyone
[1:02:18] received my email around the salaries
[1:02:21] and the
[1:02:22] » Um by council the whole I hope that I
[1:02:25] have um firmed up that information. Like
[1:02:29] I said, it was just internet based
[1:02:30] research, but I want to call each each
[1:02:33] city. And if you think of any other
[1:02:34] cities I should reach out to, let me
[1:02:36] know.
[1:02:37] » Is are the OERS benefits the um are they
[1:02:41] linear? Like we get half a credit at
[1:02:43] 6,000. Uh so does it scale? Do you do
[1:02:47] you know based on the based on the
[1:02:49] salary whenever the salary just times
[1:02:51] the same? I know that from my district
[1:02:53] job to this, you know, it's like same.
[1:03:00] Uh I had one other thing and Steve thank
[1:03:03] you for sending out the um your email
[1:03:07] with us today.
[1:03:08] » Um we we did start a discussion uh at
[1:03:12] the committee of the whole. I think some
[1:03:14] of us were under under the understanding
[1:03:16] we were you know going to kind of start
[1:03:18] from scratch. Uh and um after further
[1:03:23] discussion uh realized that we have a
[1:03:26] good foundation
[1:03:28] um of those is it four there four or
[1:03:30] five there's you know five categories
[1:03:34] um we all agreed that what we would do
[1:03:37] was look at them um you know see if
[1:03:41] there's any modifications that might
[1:03:43] need to be made and maybe identify uh
[1:03:46] some short-term actions we could take to
[1:03:49] advance toward the goals uh or even
[1:03:52] something you know longer term uh not
[1:03:56] not necessarily a a concrete goal but
[1:03:59] something we're always you know working
[1:04:00] toward. So just just yes would like to
[1:04:05] uh you know remind people to take a look
[1:04:07] at that hopefully come prepared at the
[1:04:10] next briefing.
[1:04:12] » Great. Thank you president.
[1:04:14] » Yeah. Yeah. Just to real quick follow up
[1:04:17] that those those initial goals
[1:04:21] uh have goal stated goal and then
[1:04:25] objectives with most of which are more
[1:04:28] general rather than specific action
[1:04:31] items.
[1:04:33] So maybe we also look to see whether
[1:04:36] there's any specific action items that
[1:04:39] we think maybe we're not doing that we
[1:04:42] want to do versus that six new goal that
[1:04:46] I was proposing that I also added at the
[1:04:50] end of that email that doesn't has that
[1:04:54] has the goal doesn't have the objectives
[1:04:56] but does have a list of potential action
[1:04:59] items just just FYI. So when you look at
[1:05:02] it, you know,
[1:05:06] what's there?
[1:05:09] » Okay. Thank you.
[1:05:11] » Anything else?
[1:05:12] » Oh,
[1:05:14] one of the the first things I brought up
[1:05:16] uh when I when I joined uh council was
[1:05:19] that, you know, some of the information
[1:05:21] on our website was a little dated. Like
[1:05:23] for instance, the road map was 2022. Uh
[1:05:26] I've been looking around. It looks
[1:05:28] great. A lot of the stuff has been
[1:05:29] updated. It's current. Um if that's
[1:05:31] Sherry that's the individual departments
[1:05:34] uh it's it's fantastic to have you know
[1:05:37] [laughter]
[1:05:40] it's Sherry
[1:05:43] to be able to go to our site and get
[1:05:45] information
[1:05:47] so I just wanted to make sure to address
[1:05:49] that was something I said earlier this
[1:05:51] year so circling back around uh it's
[1:05:54] it's nice to to have that uh usefulness
[1:05:58] » Thank you and thank Mr. That's great.
[1:06:01] Appreciate that very much.
[1:06:03] » All right. Do I have a motion to
[1:06:05] adjourn? [clears throat]
[1:06:06] » So moved. Second.
[1:06:08] » Okay. We have a motion to pass the
[1:06:09] presence by Mr. Richmond.
[1:06:12] » Miss David.
[1:06:12] » Yes. Mrs. Irish.
[1:06:14] » Yes. Mr.
[1:06:15] » Yes.
[1:06:15] » Mr. Mik.
[1:06:16] » Yes.
[1:06:17] » Mr. Richmond.
[1:06:18] » Yes.
[1:06:18] » Mr. Bington.
[1:06:19] » Yes.
[1:06:20] » Non non meeting item. Mana
[1:06:24] bread.
[1:06:25] » Oh no. That's what that is.
[1:06:28] » All right.
[1:06:33] Yeah, feel free to take
[1:06:36] down there too. Nice. Thank you.
[1:06:39] » I've had it before.
