[0:03]
good
evening I'd like to
[0:08]
call July 11 Town council meeting for
[0:14]
order the first thing I'd like to do
is amend the
[0:22]
agenda I'd like to take the two closed
session items the first one consultation
[0:28]
with the town attorney to relating to
actual litigation name com of the town
[0:33]
of
Washington and the second one
[0:36]
consultation with the town attorney
regarding a provision of legal advice
[0:39]
namely legal options related to
potential zoning violations and I'd like
[0:44]
to move them up to open session old
[0:53]
business does that need a motion to
amend the agenda or just a consensus
[0:58]
consensus
[1:03]
okay so we'll move that up and now we'll
go back to the agenda minutes of March
[1:12]
14th has everybody had a chance to riew
[1:23]
minutes appoint
[1:40]
next to treasur
[1:45]
report thank
you total Consolidated ACC count of
[1:49]
Washington as of 630 2016
47481
[1:55]
and4 during that same time washingt
water
[2:00]
assets were
16789 and the waste water was
[2:06]
$1,246
60 washingt Waterworks June usage we
[2:11]
pump 1,1
140,00 gallons backwash 39,200 leaving
[2:17]
us 1,
10,500 gallons billable we build
[2:25]
88632 gallons leaving us 282
6,000 Gall treated not yet fil however
[2:34]
we did sell
48,000 worth
[2:39]
of gallons 48 48,000
gallons water non meter so our actual
[2:48]
gallons treat
[2:52]
notable actually
[2:57]
24, we s sell water to pool companies
and that sort of thing they the met so
[3:04]
keep separate track of that income for
June 2016 for the town of Washington was
[3:13]
$3,313 uh for the Washington Water Works
it was $
[3:18]
7,224 75 and the Wastewater income was
[3:25]
$1,575 that's $720 over there is the
noner water
[3:33]
48,000 attach are the bills we the
additional bills we paid um one uh
[3:39]
correction on the Waterworks account the
very last night of the rural development
[3:45]
Administration that's our regular loan
payment it's actually
[3:50]
$2,117 not
8,000 so the total is not
[3:55]
14465 47 it's 8,582
[4:02]
what was the replacement for
8,000
[4:07]
8,178 that every right I don't know why
QuickBooks
[4:19]
change worked in our favor yeah save
like
[4:24]
$6,000 and and the only other really
unusual thing I think on the general
[4:28]
account
[4:32]
for
fory comes in just roll
[4:39]
back not really anything spent just
hold
[4:56]
and cross
[5:12]
it's really not a question very so much
um settlement on Hall is when start this
[5:18]
coming Friday 12:30 and then the
proceeds from sale will go into um
[5:26]
accounts I'm going to pay off the Deb
two two
[5:31]
obligations Sun Trust
also bridge loan from un correct and
[5:38]
then the expenses survey cost
[5:53]
amount it's kind of kind Tok for
[6:06]
LG see I knew it was coming soon I
just
[6:23]
snight I'm move AC treas report
amended All In
[6:36]
Planning Commission
report we met the joint
[6:42]
session
on special meeting uh with Council and
[6:48]
then our next meeting is in two weeks on
the
[6:53]
2 normally at 7:00 and our Planning
Commission will be the review of the
[7:00]
comprehensive plan and one of the items
may be to move the Avon ball goals and
[7:09]
implementation out into a more
historical portion of the comp plan
[7:14]
rather than the goals and
[7:20]
objectives the
[7:24]
ARB is there anything to report on the
there's no meeting coming up this week
[7:31]
and your
annual report is attached in the
[7:38]
Pack Mr Bennett you have
[7:43]
anything okay moving on to Old
business the first order moved up from
[7:50]
Clos session
is discussion of the actual litigation
[7:56]
namely con versus the town of Washington
[8:08]
okay so are we going to resume after yes
this old business is discussed there's
[8:15]
no close session tonight we just going
to do this issue of old business and the
[8:20]
next issue is going to be the zon
violation issue I would think 5 minutes
[8:36]
after maybe take care of my origin
business at home um do we need any why
[8:42]
would you switch them there's no vote on
the uh zoning issue why you just
[8:47]
switch I think it's going to be very
timely so okay all right well I will
[8:52]
refuse my
[8:58]
[Applause]
okay with that
[9:02]
does Mr
Bennett VI
[9:07]
mayor Mr
conik submitted to the Town Council a
[9:15]
proposed settlement agreement Mutual
release and then there recites that
[9:20]
there was pending litigation between the
town and Mr conic which the time was on
[9:26]
appeal to
petition for
[9:31]
appeal petition for ciary to the
Virginia Supreme Court after that
[9:38]
proposed agreement was submitted by Mr
con the court in fact
[9:46]
Deni and resolve resolving the matter of
the time period fortition for rearing by
[9:54]
the court is also expired
[9:59]
if it hurt your ears
[Music]
[10:02]
look no no it hurt go like
[10:08]
this um has also
expired so so the matter of kic versus
[10:15]
the town of Washington is in fact
resolved as a legal matter at this
[10:21]
time um the agreement reing that that
was the matter in
[10:26]
controversy um that
the proposed
[10:33]
agreement
compromise
[10:39]
ination that's good to
[10:43]
hear so my suggestion would be for
Council to consider just take some sort
[10:51]
of action to get it off the agenda that
uh the Town Council declines
[10:59]
take any action on proposed the settl
agreement proposed by Mr Con on the
[11:05]
grounds that it's
[11:10]
now any discussion it's my understanding
that all outstanding issues um time for
[11:17]
appeal having passed without any um
subsequent notice to us the town
[11:23]
of Courts picking up any of the appeals
the appeal time for the suprem cour
[11:29]
having in my understanding pass um these
issues are now not only behind us but
[11:36]
dead we go the time for appealing
decisions having run the decisions
[11:43]
themselves haven't been entered so um
based on uh council's U report it would
[11:51]
seem to be there's nothing to act on as
all outstanding litigation is now over
[11:56]
so it would be nonsensical to entertain
any kind of a motion to accept a
[12:01]
proposal to settle something that is no
longer alive so it all being mov I don't
[12:08]
think any action this evening is
necessary and our minutes
[12:14]
note report and I think we can simply
move on it's matter not behind
[12:22]
us I don't believe do does anybody see
anything to the cont so
[12:30]
he wanted us to settle and we he gave us
an offer and we responded and this would
[12:37]
be
resp this is our
[12:43]
response there's no
reason to settle anything it's my
[12:48]
understanding because there's nothing to
settle is that
[12:51]
correct is that okay there's nothing The
Settle so the proposed AG recites the
[12:59]
the Supreme Court that would be
dismissed that's all behind everybody
[13:05]
now because the Supreme Court fact
dismissed the appeal so well so at this
[13:11]
point the town is going to take no
action no further no action
[13:16]
on Mr con if there's no motion there's
no action so
[13:22]
okay moving on to the next agenda item
[13:39]
so the next agenda item is
a matter regarding potential zoning
[13:44]
violations again
Mr um this is this is an issue that's
[13:51]
been discussed in some
detail by Council after the last meeting
[14:00]
took uh certain steps that uh in
relations to some of the matters that
[14:08]
were
expressed those matters have not been
[14:12]
resolved this time and
my feeling about the matter would be it
[14:18]
would be appropriate for Council just to
pass over this and set over for the next
[14:24]
meeting um to allow
[14:29]
longer period of
time sufficient period of time
[14:33]
for the current concerns of council to
be addressed in one fashion or another
[14:40]
and you're addressing this in your
capacity as owning
[14:44]
administrator I can
address statute that
[14:53]
says okay so also on this one um
no action needs to be taken at this
[15:01]
point no I think we would have to move
to hold it over to next month's
[15:05]
agenda that correct this stay on the
agenda it's still on the
[15:13]
agenda I would Town Council we table
this for this evening's discussion but
[15:18]
it over to next month's
[15:25]
agenda okay
[15:31]
uh there being no new business I'll move
right on to the uh public
[15:36]
forum I'll open the public forum if
anybody has any comments observations
[15:41]
concerns
[15:45]
issues
[15:50]
yes
anything if there's nothing I'll um
[15:56]
close the public for I everybody coming
out for that um next and last would be
[16:14]
ajour all in favor ofour say I meeting
