Good evening everyone. Welcome to the

board of supervisors first meeting of
[0:10]
the year. Please rise.

Believe it or not, I don't think we had
[0:37]
any executive sessions, [laughter]
[0:41]
but a few few announcements. I did want
[0:43]
to start off with some good news. Uh we
[0:46]
just received the grant money uh which
[0:49]
which Jim Wendlegas was helpful in
[0:52]
requesting when he was manager for the
[0:54]
LSA grant. That's the local share grant
[0:57]
uh which comes from the gaming money and
[0:59]
we received $120,000
[1:02]
for the compact track loader and $64,000
[1:06]
for the police vehicle. So So that's
[1:08]
terrific. Um, this evening's meeting is
[1:12]
being recorded for rebroadcast
[1:17]
and also wanted to just wish everyone a
[1:19]
happy new year and remind you you're
[1:22]
want to dispose of your trees. We're
[1:24]
accepting them right out front here.
[1:25]
Just no tinsel. So, we're going to move
[1:29]
right on to public comment. Does anyone

Open Space Review Board. There are two
[1:49]
new positions that are being added to
[1:51]
this committee.

Um,

both of the positions are spouses of uh
[1:57]
of current supervisors. Um, there's
[2:00]
quite a few that they're on. My question
[2:02]
is I saw that there's some vacancies.
[2:04]
Um, is was that intentional? because I
[2:06]
know I talked to somebody who was not
[2:08]
reappointed who was looking to get
[2:09]
reappointed on a committee and was not.
[2:11]
» Okay. Well, would you like me to explain
[2:13]
what

» Sure. So, uh, we actually have merged
[2:18]
the trails committee into the open space
[2:22]
committee.
[2:24]
So, it's not so much of an appointment
[2:26]
as they were moved there and eliminated
[2:29]
a committee entirely.

applied for other positions on other
[2:36]
committees that didn't get filled but
[2:37]
have vacancies,

» I'm not aware of anyone but one person

who I did talk to about it already being

full at open space but to please come.

» It wasn't open space. It was a different
[2:45]
committee, but I can have them contact

you. I know I know Whitney had had was

kind of wondering why she didn't get
[2:50]
appointed back to traffic safety.

heard from me today that said that uh

that I said, "Oh, she's not coming back.

of a new position. It's called the storm

happens to be happens to be the same

this new position being added?

» The township engineer traditionally is
[3:25]
the storm water enforcement officer. uh
[3:28]
the township engineer takes the lead on
[3:30]
all the applications made under our
[3:32]
storm water ordinance. Uh so uh he is
[3:35]
appointed to that position.

» So so LTL will no longer be in that
[3:39]
position of doing storm water.

» We did replace them as our township
[3:44]
bench.

» Um there's a new $75 BM registration fee

that's indicated in the fee schedule. uh

who's going to be contacting all the

fees or is that going to be up to the

residents to identify and alert the
[4:02]
township
[4:06]

Uh, when the manager was

job out here. I totally agree with that.

When the manager was hired, it was noted

that he would be taking over as zoning

officer for the township. It was
[4:55]
something that the board had had
[4:56]
stressed. Um, now it appears that uh
[4:59]
that's now being slid over to the
[5:01]
previous permit clerk who he said is uh
[5:03]
the director now zoning. [snorts] Um but
[5:05]
now we have two assistants which are
[5:07]
going to be the township manager and
[5:10]
that other firm as a backup. So um how
[5:14]
did this come about when I thought that
[5:15]
the manager was going to be the zoning
[5:18]
officer?

Jason's position was promoted and it's
[5:22]
as part of his new [clears throat] job
[5:23]
description.

» So, you're having that portion taken
[5:25]
away and Jason's going to be doing that
[5:26]
part of the job.

drastically reduced overall and that's

that's basically from an analysis to
[5:56]
find that we were overcharging our
[5:58]
residents.

provision that the um

the board super shall appoint three

members of the space review board to
[8:32]
serve on the trail committee
[8:33]
implementation subcommittee. So the
[8:36]
trail committee as um madame chairperson
[8:39]
has said uh is being folded into the
[8:42]
open space review board and um the
[8:45]
supervisors will choose the members of
[8:48]
that uh subcommittee that are part of
[8:50]
the open space review board.

for municipalities prior to adoption the

fee schedule. We take a look at the uh
[14:13]
proposed fees relative to uh the cost
[14:16]
that the township incurs uh to process
[14:19]
individual permits and other approvals
[14:22]
and make adjustments where necessary. As
[14:26]
the chair noted a few moments ago,
[14:28]
generally uh there has been a decrease
[14:31]
uh to several of the fees uh that are
[14:35]
proposed this year relative to the fee
[14:37]
that was charged in 2025. Uh there are a
[14:41]
couple of new fees added uh to the
[14:43]
schedule uh including uh underground
[14:46]
storage tanks um which was uh left off
[14:50]
uh the schedule in past years. Uh the
[14:54]
escros that are required to be posted
[14:56]
with land developments uh have uh have
[14:59]
been revised as well. Uh generally up uh
[15:02]
and in [snorts] several instances we
[15:04]
have consolidated
[15:06]
uh fees that are charged uh we had mult
[15:09]
multiple instances of multiple fees
[15:11]
charged for the same approval. Uh and
[15:13]
that has been streamlined so folks are
[15:15]
paying uh one fee instead of uh more
[15:19]
than one fee. Uh we can review uh any of
[15:23]
the uh
[15:25]
fees if folks want to discuss
[15:29]
but I believe all are self-explanatory
[15:31]
as to what permits uh require what fees
[15:34]
and escros as needed.

to be revenue neutral because two are
[19:20]
going up a little, one's going down.

» As I noted, accessory uses
[19:28]
um that increased from $100 to $125.
[19:33]
However, again, the cost of construction
[19:35]
fee, which is normally the bigger fee
[19:37]
that the resident pays, decreases from
[19:41]
1.5 to 1.25.
[19:44]
Zoning permits increase from 300 to 310.
[19:47]
Driveway permits increase from 300 to
[19:50]
310. And those are the only other
[19:52]
changes on page two. On page three,
[19:56]
non-residential fundaments decreases
[19:59]
from $1,500
[20:02]
to $1,250.
[20:04]
New accessory structures, nonresidential
[20:08]
decreases because the township was
[20:10]
charging two fees, a $300 review fee and
[20:13]
a $100 two-hour administrative fee. Uh
[20:18]
that is the example of the combination
[20:19]
of fees. The new fee is 350. The old fee
[20:22]
was 4, the new fee is 350. The very same
[20:25]
thing with the next one, alterations.
[20:28]
The new fee is 550. The ch township was
[20:31]
charging two fees totaling 600 last
[20:33]
year.
[20:34]
» Solar generator, mechanical, HBAC per
[20:37]
unit. Same thing. We're going from $600
[20:40]
to $550. Fire suppression systems, same
[20:44]
thing here. We're going from 500 to 450.
[20:48]
Electrical fee, same. were decreasing
[20:51]
from 400 to 350.

Um, under electrical 2 that adopted last
[20:57]
year had a permit issued for new service
[21:01]
at $0.
[21:03]
I think that was a typo. So, we
[21:05]
calculated the appropriate fee in that
[21:06]
$600. I can't tell you what the fee was
[21:08]
last year because the fee schedule
[21:10]
listed zero. Plumbing fee decreases from
[21:14]
$400 to $450 to
[21:18]
» 350. I'm sorry.
[21:20]
swimming pools, uh, accessory recreation
[21:22]
uses. These are for non-residential
[21:24]
properties decreases from 600 to 550.
[21:27]
» Can I just interrupt for a sec? Yeah.

» What's a nonresidential?
[21:31]
» If a if an HOA wants to put a swimming
[21:34]
pool in a clubhouse, if um, you know, if
[21:37]
if if a recreational use wants to do
[21:39]
something like that. So, not common, but
[21:41]
you want to make sure you have something
[21:43]
there in the event. Yeah. What if
[21:45]
somebody I mean not to get into this but
[21:49]
just off the top of my head thinking
[21:50]
about it. So we have a famous infamous
[21:53]
place happening up the road here
[21:56]
where a guy from California comes in and
[21:58]
develops a property. Is that considered
[22:00]
residential?
[22:02]
» That's considered accessory because the
[22:04]
bed and breakfast is accessory to the
[22:05]
residential use there.
[22:06]
» Okay.

» If there wasn't a residential use there,
[22:08]
if it was just a like a hotel, that's
[22:10]
certainly commercial and this would
[22:12]
attach. I guess my real question is if
[22:13]
somebody has two homes and they live in
[22:15]
Oklahoma but own a property here, are
[22:17]
they residential or non the house is
[22:19]
residential but they're not residential.
[22:21]
» Well, you talk about residency and
[22:23]
residential which are two different
[22:25]
not whether they have multiple homes.
[22:27]

» If they're using it as a home, it's a
[22:30]
home. That's

» Okay. Uh zoning permit for
[22:34]
non-residential just like the one for

residential increasing from $300 to 310.

Driveway permits. That was really odd.
[22:42]
Uh the township last year uh was
[22:44]
charging $2,500 for a driveway permit. I
[22:48]
can't imagine why. The new fee is $310
[22:51]
and we're requiring an escrow in the
[22:53]
event that something's needed from the
[22:54]
county traffic engineer. The person
[22:56]
applying for the permit will pay the
[22:58]
actual cost and not a penny more. Uh but
[23:01]
that $2,500 fee wasn't appropriate. A
[23:04]
reinspection fee uh increased from $200
[23:07]
to $250.
[23:09]
And that's it for page four.
[23:14]
Page five, the bridge weight limit. We
[23:16]
had charged $1,000
[23:19]
uh last year proposed 300 with that
[23:21]
escrow. Again, I don't know the thinking
[23:24]
behind last year's uh number, but it
[23:26]
just it doesn't make sense. uh
[23:29]
demolition permit uh increasing from
[23:31]
$200 to $300 for residential,
[23:35]
decreasing from $500 to uh $300 for
[23:39]
non-residential. There's really no
[23:41]
difference in the service we provide
[23:43]
with those two uses. And so they're the
[23:45]
uh they're the same. There is an
[23:47]
additional escrow there needed again to
[23:49]
pay any actual cost that we incur in uh
[23:52]
in doing that. Uh but that is just to
[23:54]
reimburse ourselves for our consultants
[23:56]
work if any. uh the balance of escros of
[23:59]
course are returned to folks in full. Uh
[24:02]
further down on page five you see the
[24:04]
two new additions above ground storage
[24:05]
tank and below ground storage tank.
[24:08]
Those are new uh as was noted earlier.
[24:11]
Uh two down from there the bed and
[24:12]
breakfast registration fee. Uh that was
[24:15]
omitted on past year's uh fee schedules.
[24:18]
We've made the correction here. Uh
[24:20]
special events fees uh for temporary uh
[24:24]
fee temporary special events up to seven

And there are many folks that have to do
[25:19]
this. We're decreasing that fee from
[25:21]
$1,000
[25:23]
to $450.
[25:26]
for the storm water management
[25:28]
application non-simplified the bigger
[25:30]
things we're decreasing that from $3500
[25:33]
to $750
[25:38]
subdivision and land development
[25:39]
approvals application fee base fees have
[25:42]
been consolidated so the numbers there
[25:44]
if we look at it kind of like apples to
[25:46]
oranges but uh generally they're going
[25:49]
down in fact I don't know any of the
[25:52]
small subdivision fees or land
[25:54]
development fees that we charged are
[25:55]
going up. We adjusted escros where
[25:58]
appropriate, but again, that's not a
[25:59]
fee. Those things are posted to
[26:01]
reimburse the township for actual
[26:03]
expenses. And what we don't get uh what
[26:06]
we get reimbursed for is the actual cost
[26:09]
to um for our consultants to provide
[26:11]
that service.
[26:14]
Uh we'll go now. No other changes until

you get down to page seven.

Zoning hearing board and other appeals.

I don't know how much time the township
[26:27]
previous managers township secretary
[26:29]
spent uh looking at the zoning hearing
[26:31]
board fees, the UCCC fees, uh board of
[26:34]
appeal fees, conditional use fees. Um
[26:37]
but that we can charge is set by state
[26:39]
law in specific the municipalities
[26:41]
planning code. If you open up that state
[26:43]
law that says municipalities, you have
[26:45]
the right, sole right to write the laws,
[26:49]
but the cost if somebody wants to
[26:52]
challenge the laws, ask for a variance,
[26:53]
ask for a special exception to defend
[26:56]
that solicitor bills and so forth,
[26:58]
that's your burden, [clears throat]
[26:59]
» Right? In exchange for giving you the
[27:01]
right to write the rules, the cost to
[27:04]
defend the rules is yours. Uh, and the
[27:07]
board and the uh planning code is very
[27:09]
specific. uh we can include in the cost
[27:12]
that we charge to people that go to the
[27:13]
zoning hearing board to go to the UCCC
[27:15]
board of appeals to go to the board of
[27:17]
supervisors when it's in a quasi
[27:19]
judicial uh proceeding like a
[27:21]
conditional use application one half of
[27:24]
the court reporters appearance fee. we
[27:26]
can uh require somebody to pay us the
[27:29]
cost of the legal fee, the mailings that
[27:31]
are sent to neighbors, the physical
[27:33]
posting of the property, stipens that
[27:35]
are paid to the zoning hearing board, if
[27:37]
any, we do and certain administrative
[27:39]
expenses. So, uh when you take a look at
[27:42]
these uh filing fees, they're uh they're
[27:45]
decreasing um for uh residential and for
[27:49]
non-residential applications to the uh
[27:51]
to the zoning hearing board. Um and we
[27:54]
have added the fee to readvertise and
[27:58]
rightsize those in case uh the zoning
[28:02]
hearing board and board has to meet
[28:03]
again at a future meeting with public
[28:06]
notice required.
[28:08]
So for example uh the township fee
[28:10]
schedule if I'm recalling at $3,000 fee
[28:13]
for nonresidential
[28:15]
applications to the zoning hearing board
[28:17]
that goes down uh to uh to $1,600.
[28:20]
Actually, I understand correct the
[28:21]
residential goes up a 100 uh from six
[28:24]
from 1,500 to $1,600.
[28:28]
And again, that is taking a look at our
[28:29]
actual expenses permitted by law that
[28:32]
can be given to uh to a person to pay.
[28:35]
And those are uh those are good numbers.
[28:38]
Um at the bottom of page seven, an
[28:40]
application to amend the zoning
[28:42]
ordinance or zoning map. We didn't have
[28:43]
anything of the fee schedule last year,
[28:46]
so we had to make sure that that was
[28:47]
added. zoning officer determination
[28:50]
letter. Uh that is likewise uh new for
[28:53]
folks that want an official zoning
[28:55]
determination. Uh if they uh if they
[28:58]
request that the fee is $130. And then
[29:02]
lastly on page eight
[29:05]
um one new fee and one lower fee. Copy
[29:10]
fees uh decreased. We had a fee in there
[29:13]
for color copies which uh the law didn't
[29:15]
permit. Uh and frankly was much greater
[29:18]
than what we were charging. Uh so that
[29:20]
is now black or white or copy is 25
[29:23]
cents uh a copy. We pay about one and a
[29:27]
half pennies for black and white and
[29:28]
about 5 12 pennies for um per color. Um
[29:33]
and then of course the the paper and the
[29:35]
and and the toner and so forth. Um the
[29:38]
finance department there is a uh new
[29:40]
charge there uh an escrow release fee of
[29:43]
6750.
[29:45]
Uh the parks department community garden
[29:48]
this is one of those consolidations
[29:51]
uh for township residents uh last year
[29:54]
for the two plots 20x 10 and 20 by 20.
[29:57]
Um, [clears throat] the township, if you
[29:59]
include the $50 equipment fee that was
[30:02]
part of the fee schedule, is going from
[30:04]
$85 to $75 for a 20x10 plot and from $95
[30:10]
to $85 for township residents for a 20x
[30:13]
20 plot. Uh, similar decrease for
[30:15]
non-residents. Um, I'm sorry, it's an
[30:18]
increase for non-residents. uh those uh
[30:21]
those numbers are going from 105 to 115
[30:26]
and uh 115 to 125. And just as a note,
[30:30]
we did some numbers uh took into
[30:32]
consideration our true cost to maintain
[30:35]
that facility. Uh and it averages about
[30:38]
$176
[30:39]
a plot. So we we made that a little
[30:42]
adjustment to the non-residents. Um, and
[30:44]
we break that down residents and
[30:45]
non-residents because the residents of
[30:47]
our community are paying to us some
[30:49]
additional tax dollars. There should be
[30:50]
some consideration given to those folks
[30:52]
by way of a lower fee.

more service this year as well as you're

changing?

we do is we ask the uh the permit uh

director to take a look and try to um

anticipate any questions that people may

ask. better be a little proactive in

giving people information instead of
[31:45]
having done that and say well what
[31:46]
happens when or if so those things are
[31:49]
included here. So looking over
[31:51]
everything uh there's just a handful
[31:54]
that have increased and that number is
[31:55]
modest. The majority of of fees that
[31:58]
have changed uh have been lowered.

So you guys are taking escros for site

development, home improvements, whatever
[44:30]
it is. Who's managing and controlling
[44:33]
and overseeing the return of the escros
[44:35]
and the inspections that are required to
[44:37]
get escros returned?

» So for certain projects, not all, but
[44:43]
for certain projects,
[44:45]
» Let's say site development just

» Say a subdivision plan. So the uh the
[44:50]
property owner, the owner and equity
[44:52]
developer will post an escrow with the
[44:54]
township. Part of that agreement is uh
[44:56]
posting a certain amount and agreeing to
[44:58]
replenish the escrow when the balance
[45:00]
falls to a certain amount uh usually uh
[45:03]
50%. Uh when the township receives uh an
[45:06]
invoice for uh charges uh for a project,
[45:11]
um those invoices are reviewed uh and
[45:14]
approved for payment by me. The township
[45:16]
pays the township's consultant. The
[45:19]
finance director then makes the entry
[45:21]
into the escrow account or the escrow uh
[45:25]
party and sends to the escrow party uh a
[45:28]
copy of the invoice for their review so
[45:30]
they know what was deducted from their
[45:32]
account. And if they have any questions,
[45:34]
that's the opportunity to ask, well,
[45:35]
what's this charge of that charge? Uh
[45:37]
the township charges the actual fee that
[45:39]
we pay. So we pay our consultants and we
[45:42]
reimburse ourselves. We don't ask our
[45:43]
consultants to go out and chase those
[45:45]
dollars. That's the purpose.
[45:46]

but who oversees the inspections that
[45:51]
are done through the escrow. So,

reviewed and that would fall to the

construction of the street, the
[46:48]
subgrade, the um material used, the
[46:52]
binder coat, the wear course on the
[46:54]
black top. Who inspects that before they
[46:57]
give the escrow money back?

» It' be generally the township engineer.

» So if that wasn't done and the money was
[47:03]
returned, whose responsibility does that
[47:05]
fall under? who was the negligent party
[47:07]
there that did not give the proper
[47:09]
inspection.

contact with with Jason in our office.

there's actually uh line items on the
[47:35]
escros for a wear course, a binder
[47:40]
course, a subgrade. So those things
[47:43]
should have all been inspected before
[47:45]
the money was returned.

goes back how many years? It's not it's

not a recent

» More than 10 years. Okay.

» Well, development hasn't been done yet.

posted. a certain type of escrow would

have been posted when the subdivision
[48:04]
was proposed. A different type of
[48:06]
security and improvement security would

have been posted in advance of uh the uh
[48:11]
the work on the road. Um Jason's
[48:14]
reviewed this and he spoke to me about
[48:16]
it briefly and all of those escrow
[48:18]
dollars have been released. I think he
[48:20]
told you there's there's nothing that we
[48:22]
have.

» The problem is is the require the
[48:24]
township requirements were never met.

So, who inspected that and signed off on
[48:29]
releasing the funds when it hasn't been
[48:32]

» Now, to fix the street, it's going to be

over $200,000 and there's five houses on
[48:38]
the street.

» So, I mean, who pays for that? Like,
[48:44]
shouldn't the builder have paid it? He
[48:45]
was obligated to fulfill that uh
[48:48]
standard set forth by the township and
[48:51]
agreed upon.

all the facts in front of us.
