point we had

talked about changing the appointments
once we had our fifth counselor on and

counselor Kozlowski has joined us
it's great and we both have we have both
[2:47]
the internal committees the portfolios
as well as the external committees
[2:53]
um
and I know that there's a couple of
[2:55]
changes in the external committee's
right now the East Interlake planning
[3:01]
district that I've been sitting on
um has have asked for a second counselor
[3:06]
not
[3:09]
um
not in case I can't make it but in fact
[3:14]
they want two counselors from each RM or
municipality at the meeting
[3:21]
and so I've asked councilor General and
if she wanted to be a part of that and
[3:25]
she agreed
and there's also the
[3:31]
East Interlake Watershed District
and counselor Jarvis was first assigned
[3:37]
to that
committee and has expressed
[3:43]
that he's no longer interested in that
committee and so I have agreed to go on
[3:49]
that and and actually attended the last
East Interlake Watershed District
[3:53]
committee meeting I think it was last
week
[3:57]
so those two changes already stand
however
[4:01]
um
[4:06]
I would like to see
counselor Kozlowski representing us on
[4:12]
some of the external committees and also
on some of the portfolios so I wanted to
[4:17]
just open it up to discussion right now
we're not going to make any final
[4:21]
decisions until the January meeting
but I wanted to start having some
[4:27]
initial discussions now
one of my thoughts in terms of the
[4:31]
portfolios was after our meeting with
um
[4:36]
Dolores from the MSO she had talked
about whether in fact we needed
[4:41]
portfolios or not
and whether that was
[4:47]
a good use of staff and Council time
if
[4:52]
our staff and managers are meeting with
our CAO every week and keeping her up to
[4:59]
date on what's Happening does it make
sense to ask counselors to also set
[5:04]
aside time for committee meetings to
meet with each of their portfolios
[5:09]
um and so I'm opening that up for
discussion as well whether we should
[5:14]
continue to have those portfolios or not
and if we do then
[5:20]
um how we want to proceed forward
[5:26]
thoughts
[5:31]
do we have to meet that many times with
the ca once a week
[5:36]
we're not maybe once or twice a month
or bring them in here and run a council
[5:42]
um no it's the CAO who meets with her
staff every week and that's important
[5:46]
because the CAO actually is is
a week for the CIO yes
[5:54]
so it's it's been past practice
um initially as I get caught up with a
[5:59]
lot of the files and and past
outstanding items
[6:05]
um I I don't know if every week it will
be required I think if it is at that
[6:10]
point it certainly won't take as long to
to do the refresher as it will right now
[6:17]
so right now it is just getting a lot of
the history so although they're saying
[6:21]
regarding whether it be well three or
well two right there's a lot of history
[6:26]
behind a lot of what's Happening that I
don't have so I appreciate that being
[6:31]
able to have those conversations of
where where we were as to why we're at
[6:36]
where we are and what that plan is but
going forward that weekly meeting
[6:43]
will be to be determined and if it is
it's certainly I don't see it being as
[6:50]
in depth because with email
communication a lot of the time uh it is
[6:54]
just a way of a good follow-up that I
can ensure that there are certain things
[6:59]
on track and sometimes there is the
cross-reference between departments so
[7:03]
if our works or utility was working with
recreation in something or vice versa
[7:08]
the collaboration of having everyone at
one time
[7:13]
feeds off feeds off that as
part of not leaving something left
[7:19]
unturned right so
so I it's a little bit too new so
[7:24]
um right now so I I don't know what that
looks like going forward but that has
[7:28]
been what has happened past practice I'm
finding it beneficial at this point like
[7:33]
I said but what that looks like going
forward uh to be determined
[7:40]
so Mr clarify for concert Kozlowski
we're not attending those meetings
[7:44]
that's not the meetings that's being
referred to as US attending with our
[7:47]
portfolios and I'm I'm going to be
honest I know that the expectation
[7:53]
um uh from Merrick Jackson when these
committees were set was that we meet
[7:57]
monthly with our portfolio so that we
have an opportunity and this was prior
[8:01]
to our discussions with the MSO was that
we would be meeting monthly with our
[8:05]
portfolios
um I won't speak for others but that has
[8:09]
not been happening with me
um
[8:12]
okay they are meeting with the CAO
weekly
[8:17]
met once just initially and have not had
the opportunity so
[8:23]
I'm not sure about the whether it's
necessary with what was said as the
[8:29]
expectation of those committees that
we'd be meeting with the monthly
[8:32]
especially with the meeting with the CIO
and sort of a better understanding from
[8:37]
a concept perspective of what is the
cio's role and what is mine as a
[8:41]
counselor

week so I can't I have to do my via
phone call

so then councilor Jarvis started any of
those committee meetings then

no well they don't take place I was only
the vice guy

so then I guess I would put to counsel
whether it would make sense in fact to
[9:32]
not have the portfolios
if we're not

regular basis

we can't direct any of their work all
the direction comes from the Cao

um the updates come from the CIO and so
then I question what
[9:51]
usefulness it would be for us to have
the portfolios besides taking up staff
[9:55]
time telling us
stuff that that they're already telling
[9:59]
our CIO
so I leave that for people to think
[10:02]
about
and we can make a decision in January
[10:06]
unless people have some ideas some
thoughts now in response
[10:13]
well right now we've had an awful lot of
vehicles even as a council
[10:17]
two three yeah four or five a month
so yeah
[10:22]
and then other things I know
I don't have a problem with uh visiting
[10:29]
this again in the spring
depending and with the flooding and so
[10:34]
on and so forth and all the other stuff
that we had going on so
[10:39]
yeah an idea maybe to have a counselor
present with the CEO and whatever
[10:45]
manager you know I know that might be a
problem maybe night time or whatever
[10:49]
some of us are working in that
just so that the council counselor knows
[10:55]
what's going on and where's these
problems
[10:58]
what what the MSO said though is she
said that some of the portfolios should
[11:02]
stay the bigger portfolios she wasn't
she'd like to finance
[11:05]
she found those portfolios important

I think I think if we have a specific
skill as well

you know in in whatever portfolio we're
[11:17]
managing
helps also uh sometimes the
[11:21]
communication sometimes the
managers feel
[11:26]
less threatened to open up to council
than they do the CEO and we bring

forward their questions too
there's a lot said about having
[11:34]
portfolios
so
[11:37]
I I and another thing I mean
you know without portfolios it was it
[11:43]
was discussed with previous Council that
we would all have to know a little bit
[11:46]
about everything as well
and and that makes it tougher
[11:52]
well I mean part of
part of the issue for me is
[11:58]
staff shouldn't be going to counselors
staff should be going to their boss
[12:02]
which is a CEO yeah sometimes they don't
though they're not comfortable right but
[12:07]
then that's but then that's between the
CAO and the staff person to work out
[12:10]
because I'm just letting you know what
happened yeah no I know you know I know
[12:14]
but I'm just saying that puts the
counselor in a pretty awkward position
[12:18]
because the counselor can't direct we
don't can't tell them what you do can't
[12:22]
do any of those kinds of things and so
but we can bring that concern forward to
[12:26]
this year
[12:29]
I mean they're going to call us
regardless but I'm just saying if they
[12:33]
feel comfortable with that particular
portfolio
[12:36]
they meet very not question to council
they make it has happened before
[12:46]

fairness to our new CIO that's a fine
line we need to walk
[12:58]

I understand that staff may have had
[13:01]
issues in the past but I just don't
I think we need to work on moving
[13:06]
forward
um and not be putting ourselves in
[13:11]
between our staff and our CIO
um
[13:16]
staff are gonna we have managers that
if it's a manager they need to learn to
[13:21]
have a level of comfort and if we are
running interference we're not helping
[13:26]
with the fostering a healthy work
environment
[13:30]

another form of communication for them

emergency situation and you're going
through phone numbers you know yeah you

seriously an emergency like if somebody

somebody says look we're on fire or
something like that then you might want
[14:27]
to but under every other Condition it's
like excuse me but we have somebody that
[14:31]
you speak to that's right and what I
don't want to happen because you know
[14:35]
because I I mean I I walk a lot and I
bump into Tim I bumped into Tyler the
[14:39]
other day and we talk Golf and things
but like I don't want people to say that
[14:43]
they can't talk to me you know what I
mean like if I go walking by Tyler that
[14:46]
I want people people say well you know
because I always Tyler and I've talked
[14:50]
for years because I know
yeah I mean I just I worry that maybe
[14:55]
that would take place yeah this isn't
about not being able to talk I mean when

I got into Joe where I run into Tim I
was like hey how are the kids how was

the wife you know those kinds of things
this is about them calling us on Council

business and right I just wanted that
character yeah that's why I want to make
[15:10]
sure because I've never received any of
those calls right but I bump into people
[15:14]
all the time yeah but if I were to get a
call from any of the managers for sure I
[15:18]
would say why are you calling me about
this you need to talk to the school yeah
[15:21]
but back to the emergency thing I mean
if somebody's phoning Me Maybe they've
[15:24]
tried sharing and they can't get a hold
of her maybe they've tried unique and
[15:27]
they're just going through it because
they've got a problem and they're
[15:29]
starting to go through a phone directory
right but that's the extraordinary right
[15:33]
so we've got to make sure that we're
being able to differentiate that okay so
[15:37]
be prepared for our January Cal meeting
to make a decision on this and if in
[15:44]
fact
um
[15:46]
we decide to
um continue to have portfolios then I'll
[15:53]
spend some time thinking about who will
be in charge of what portfolios and will
[15:58]
bring Council Kozlowski into the mix
[16:03]
do we need a resolution after the
Eastern planning district that's where
[16:06]
we're going to move into now uh the
external committees
[16:12]
um
and so I guess the conversation needs to
[16:16]
be and the consideration needs to be for
everybody here is anybody who is
[16:20]
currently on an external committee that
is not working for them or isn't in a
[16:27]
time when you can attend whatever those
kinds of things please let us know and
[16:31]
also Council kislovski if you have
particular external committees that you
[16:35]
would be interested in sitting on like
for example we have a Winnipeg Beach
[16:39]
Legion
um
[16:41]
if not you is it what's up you weren't
on the legion were you I think I was
[16:55]
uh if in fact you're interested in being
the council liaison with the Winnipeg
[17:00]
Beach Legion that would make sense if
there are other ones that also make
[17:03]
sense to you please come prepared to the
genuine meeting to have that
[17:07]
conversation okay sure okay and other
people whichever external committees
[17:11]
you're on if some are not working out
not the right time whatever please
[17:16]

come to our January meeting prepared to
[17:20]
talk about your involvement on external
committees cancer Gendron we have a
[17:26]
jumping ahead a little bit into
correspondence or something
[17:30]
's Resource Council saying they're not
aware of
[17:33]
is uh representing the town on the
um
[17:38]
it was my understanding that contact
information went up from the office
[17:42]
asked about that at the time I guess
apparently it hasn't okay so
[17:48]
um if
and I I my suggestion would be that not
[17:53]
just the changes be notified of who is
but probably everybody be notified
[17:58]
that was going to be my next suggestion
because yes because we also had a
[18:01]
comment from Interlake tourist
associations
[18:05]
um without any representation here and
so it sounds like they don't know who
[18:08]
who the rep is either counselor who you
wanted to say that's what I was going to
[18:12]
say because again you know I'm on a
couple of these committees and I've
[18:16]
heard nothing from them or about them
okay and so that's telling me that maybe
[18:21]
they don't know that we're appointing
people back in August okay okay
[18:29]
okay so in the interim we're not going
to pass this resolution until the
[18:34]
January cow meeting after we've all had
a chance to consider and think about
[18:38]
so can we bring this forward to the
January meeting in the interim um I will
[18:45]
be doing the East until like Watershed
district and the East Interlake planning
[18:49]
district until that happens
[18:54]
comments and we're not voting on this

meeting that it was usually the first
meeting of each month when the reports

putting on us as an addition I didn't
think of it was a value without being

have no authority to charge the employee

is is stating they are responsible for

um you know the series of this offenses
are going to be any repercussions or any
[24:34]
further training or safety training or
so I I have met with one of the
[24:39]
employees that I have not met with the
employee who was driving at the time as
[24:43]
they are off on leave uh the
circumstance I believe is clear in the
[24:47]
report it was at a time of an emergent
sewer break and at the time of driving
[24:54]
albeit uh not appropriate behavior
looking at the severity eyes were taken
[25:00]
off the road to be looking at the ditch
area and it was just unnoticed so it's
[25:06]
clearly clearly not an excuse that is
what happened it was under extraordinary
[25:12]
circumstances as the severity of the
sewage in the close proximity to the
[25:17]
lake was a great concern

's gonna pay for it
so that

so so that is a discussion to be had I I
know that when we we look through that
[25:42]
looking at having some sort of policy
um in place
[25:48]
being an a unionized work environment if
we look at passing a policy where the
[25:54]
driver of a vehicle who's incurred a
ticket the expectation is for that
[25:58]
driver to pay that expense I do expect
there to be some level of Union
[26:03]
involvement unless it's clearly
identified in the collective bargaining
[26:07]
unit agreement as well
something that can be looked at I do not
[26:12]
have past history as to whether or not
how many instances have occurred
[26:18]
so this is the first one I am aware of I
did sit down with the individual at
[26:23]
length discussing the situation and as I
stated upon the return of the other
[26:30]
employee we'll be doing
similar to council General
[26:35]
um
uh first off thank you very much for the
[26:39]
report as an explanation as to what was
involved leading up to it and just for
[26:45]
clarification if an individual receives
a ticket in their own names so if
[26:49]
they're pulled over for speeding that is
not on us because it's in their name
[26:52]
correct that's correct okay it is only
when
[26:57]
um like the cameras on the bus or red
light cameras in the city or anything we
[27:02]
as a town have a responsibility to pay
the ticket because it's in our name
[27:06]
correct okay and and we currently do not
have a policy that allows us to take and
[27:12]
I and I do know
um
[27:15]
some person experience a little bit of
my discussion with you it it is you're
[27:20]
very strict on what you can deduct from
an individual's payroll and what you
[27:23]
cannot correct so you do not have the
authority to even be deductiveness off
[27:29]
the individual's page I do not and
without a policy you didn't really have
[27:32]
any other choice but to pay the ticket
so it's on Console to be making a policy
[27:37]
in order if we feel as a group that we
do not want to be responsible for
[27:42]
tickets and individuals get correct okay
that being said we can looking at
[27:47]
Council creating that policy because it
is dealing with deductions from an
[27:52]
employee the collective bargaining unit
would need to be notified of that policy
[27:57]
as well okay
I just want to say you know

the the offense is significant you know
driving by a school bus when they're not
[28:07]
supposed to be stopping
um
[28:10]
it was good to see you know kids weren't
being discharged nobody wasn't any kind
[28:15]
of media threat and I certainly
understand that they're driving a lot of
[28:18]
money they just because they had a super
break
[28:22]
um well it's unfortunate that occurred
I also think that unless we continue to
[28:28]
get these kinds of tickets or complaints
I'm not sure if something that we have
[28:32]
to add on this might be a one-time only
and I I trust our CEO has had very
[28:39]
significant conversations with the
people who were involved I think that if
[28:43]
we
haven't have a second situation and
[28:48]
certainly we might be needing to have a
very different discussion Council yeah I
[28:52]
agree with you I think I think it would
be a different discussion though if a
[28:54]
kid was ran over so I think maybe if our
employees were a little more
[28:58]
you know if there was a financial
penalty to their your
[29:03]
to their driving or something you know
maybe they would have been paying a
[29:06]
little more
the kids could have been offloading and
[29:09]
if he's looking in the ditches
and didn't see a school bus at the
[29:13]
lights kids could have just as well been
in the Front Street so
[29:16]
I think it's important that we tackle
this now and not wait for another
[29:19]
incident Council Jarvis I agree and I'll
use the example what if it did the
[29:24]
school bus driver and there's been kids
on the school bus and he just went
[29:27]
through a stop sign yeah I mean like
right now we have a situation where he's
[29:31]
looking at a ditch and there's a school
bus with the lights on and we drive past
[29:35]
the school bus and as you said luckily
nobody was hurt
[29:39]
but the last time we're wrong you're
supposed to be in complete control of
[29:42]
your vehicle at all times whether that
bus could have been parked in the middle
[29:44]
of the road if he'd hit the bus he was
at fault
[29:48]
where we have to look at and like Gary
said we have to have some sort of a plan
[29:52]
if a child had been hit heaven forbid
if you're having a different
[29:57]
conversation right now so what kind of
plan are you suggesting counselors yeah
[30:01]
we I'm not sure what is involved so I
think maybe in the future we should have
[30:06]
a look at it because we have employees
that drive vehicles and if they're
[30:10]
heaven forbid but if you're running
through stop signs and you're blown past
[30:13]
school buses with the lights on then
maybe we need to look at a policy that
[30:16]
says
hey

we have a situation even in the middle
of the Summer where there's kids walking
[30:23]
everywhere around here
and if you're looking at the ditch and
[30:26]
something all you need is a
five-year-old and bolt that between two
[30:29]
cars and no problem okay
well maybe it's just more of a having to
[30:33]
take a defensive driving course or
something
[30:37]
because I don't know I agree but I'm not
saying that we let the guy about Scott
[30:42]
free I'm just saying that you know
there's something that maybe wouldn't
[30:44]
get a look at we have people driving
vehicles
[30:50]
um
[30:52]
my understanding from reading the report
as the discussion has happened and the
[30:55]
serious discussion has happened
um
[30:59]
the CEO is responsible for the staff the
CIO has policies regarding uh when if
[31:08]
and when the CIO feels there's a need
for a written warning to be placed on an
[31:12]
employee's file
the CAO has that ability to do so if the
[31:18]
CIO in discussions
um feels that
[31:22]
I mean as she said she doesn't know if
this is the first offense or not but if
[31:27]
this is the first offense and the Santa
was dealing with a second offense in
[31:31]
three months I would assume that the CIA
would be dealing with it appropriately
[31:35]
according to the situation that had as
opposed to having to have a separate
[31:39]
policy
councilor well I just want to say on
[31:43]
record that I think something should be
done now because if we don't and this
[31:45]
event does happen
I don't think our CEO wants to be
[31:49]
responsible for it either I think we
need to like that's a that's if it was
[31:53]
just driving if it was a small offense
like again like speeding or whatever
[31:56]
else but somebody blowing through a
flashing lights on a school bus that's
[32:00]
that's as bad as it gets
would you suggest that we do counselor
[32:05]
well I suggest that the person needs a
little refresher course
[32:09]
or a defensive driving force or maybe if
they if they can't follow the rules
[32:14]
and they're too distracted by a flashing
lights on a school bus maybe they
[32:17]
shouldn't be driving our vehicles
because it's our liability
[32:21]
yeah they're they're in charge of that

this person's not paying the fine and

there's no demand so there's really no
other than the conversation that took

the passenger the driver is on leave

currently and I have not been able to
have that conversation with the driver

costs are then covered through the DFA
program once approved

and so in order to collect that data and

food carts is within the downtown area

at what that pilot project looked like

there's there's a few issues is a is is
there sufficient data to see that there
[1:02:39]
is there is an impact B it allows for
Council and staff to take a look at the
[1:02:45]
other possible impacts that having a
food cart in the vicinity
[1:02:51]
um
can have that that we may not have
[1:02:54]
thought about right is when we look at
that and then B take a look at some of
[1:02:58]
those impacts and bring that forward to
discussion uh normally a food cart
[1:03:03]
vending uh is not lumped in with another
bylaw it does have its own specific
[1:03:08]
bylaw and so my recommendation moving
forward would be to be removing that out
[1:03:13]

there's other things so that it also

gives Council the freedom to take a look

restaurant site that can provide a

the food carts you know available within
the downtown area

because again
we can all know that after six o'clock

or seven o'clock sometimes there's
nowhere to get a meal or a quick bite

during bands or
with the exception of boardwalkings

maybe something we can sort of push out
a little further on

for food carts because well I I think

we're going to get into a really bad
situation if we allow food carts there

the problem is that and and they're

right if we need separate legislation
for it is that as we discussed

previously that you know there has to be
some sort of concern for sanitation from

washrooms for seating areas for garbage

we have to have criteria that these
people have to

to adhere to and it's not so much that
the other businesses aren't complacent

it's that we all have to fall under the
same guidelines and right now we have
[1:05:09]
seem to have separate guidelines for

suggesting in terms of this this
particular resolution

who's asking us permission to have a
food right at the farmer's market

there do they have garbage receptacles
do they have picnic tables you know what
[1:05:40]
I mean a we we get that already there
are people just walking along in the
[1:05:45]
discs are in poutine containers and all
kinds of stuff like I think from our
[1:05:49]
standpoint is that you know trying to
solve maybe a concern that somebody
[1:05:53]
doesn't have a meal or they can't take a
break and so on and so forth I mean we
[1:05:59]
create another problem
so is your suggestion
[1:06:05]
like again having an expanded one or is
your concern just with the farmer's
[1:06:09]
market so
um well they just with the farm well
[1:06:13]
with the Farmers Market at person
because we talked about putting a an
[1:06:16]
area where all the food carts and all
the common food trucks or whatever would
[1:06:20]

um my fear is and they had mentioned
[1:06:24]
about Winnipeg and and I'm familiar with
Winnipeg is that you're given an area
[1:06:28]
right but you just can't just
indiscriminately put a food cart

somewhere

these things that have been raised by

councilman Jarvis and Concert Hall
are things that will be taken into

consideration right now we are looking
at preventing a food cart at the Farmers

to as a pilot project to see how does it
[1:06:55]
go how is it receive what are the things
we need to consider moving forward and
[1:07:00]
let's say based on it we decide that yes
we're going to move forward and expand
[1:07:05]
the use of food carts
what things have we learned and are
[1:07:09]
learning from the food cart at the
farmers market as far as
[1:07:14]
things we need to consider as far as
washrooms and receptacles this is the I
[1:07:19]
mean these are the individuals running
the farmers market who are are making
[1:07:25]
this request for at their Farmers Market
well we know they have I mean they
[1:07:29]
already have portable washrooms there
and they have uh you know they have
[1:07:34]
little seating areas for people there so
this is just authorizing
[1:07:40]
the CEO to implement the pilot project
is what we're looking at here councilor
[1:07:46]
again I would rather than just seeing a
pile of projects I'd like to see an
[1:07:50]
expanded uh throughout the town
because we're not going to get a full
[1:07:55]
Taste of what's happening in the Farmers
Market oh it's going to affect the rest
[1:07:58]
of town well it would it would seem to
me that before we do that we might want
[1:08:03]
to do a bit more homework however that's
more pointful
[1:08:07]
pardon me that's my point I think we
need to look at this a little better
[1:08:11]
than just
you know have a pilot project thrown out
[1:08:14]
there I think we need to sort of look at
this a little better

just at the farmer's market well I think

to clarify my position on it um we had

this I thought we had discussed a lot of
this stuff with reference and and that's
[1:08:53]
maybe where I'm confused is it about
having food trucks Etc and what I don't
[1:08:58]
want to get in you know every time I
have a farmer's market or a special
[1:09:02]
event and even like a harvest fest where
we have things that all of a sudden
[1:09:06]
there's a different set of rules for
these where you're able to have food
[1:09:10]
carts in the Farmers Market I think we
need to look at it as a talents if
[1:09:14]
you're going to let some of these people
in
[1:09:16]
um they have to as I've mentioned before
their criteria has to meet that there's
[1:09:19]
Health standards there's all kinds of
things safety and so on and so forth
[1:09:24]
that these people out and I don't want
to Forfeit
[1:09:27]
that um and I don't know if
responsibilities right because they're
[1:09:31]
within we've given them permission to do
that and I want to make sure that all of
[1:09:36]
the checkpoints are are looked after
right and Council Jarvis we have had
[1:09:40]
this conversation before and I think
that the conversation has sort of gone
[1:09:43]
in circles in this similar way that is
happening tonight and I think that
[1:09:48]
um some discussion was had about the
fact that every food cart would have to
[1:09:52]
be licensed and if they're licensed that
means that they're insured and so that's
[1:09:55]
already taken care of in terms of health
concerns and all those kinds of things
[1:09:59]
we've always gotten stuck on should we
let one in and use as a pilot project
[1:10:05]
should we just open it up completely
before we open it up completely should
[1:10:08]
we be sitting and talking to the other
businesses in town what should we do
[1:10:12]
and we've gone in circles around that
with no decision being made and so
[1:10:20]
um I think this was the opportunity when
someone approached our CEO saying could
[1:10:24]
we have a food cart next year so not
saying next weekend they're saying next
[1:10:29]
year could we have a food cart
available at the farmer's market now we
[1:10:34]
might want to expand that to include
other things
[1:10:38]
um at some point we're not creating
policy here we're we're saying either
[1:10:43]
yes or no to this food cart at the food
truck and at the at the Starbucks market
[1:10:49]
and if this Council thinks it's
important that we look at food trucks
[1:10:55]
downtown Winnipeg Beach for 2023 before
doing this pilot project we can
[1:11:00]
certainly put that on an agenda and have
a full discussion about that and ask our
[1:11:04]
CEO to come up with policy and those
kinds of things that doesn't prohibit us
[1:11:09]
voting on this right now
um
[1:11:13]
those are my just my thoughts right now
counselor who will and then councilor

I think we need to but I I do think we
[1:11:20]
need to look at the town as a whole
before we agree to this that's my
[1:11:24]

so so just a point of clarification for
[1:11:28]
myself when we're looking at the town of
a whole how will that inform this
[1:11:32]
decision about this food card well I I
can't agree on this yet unless we do it
[1:11:36]
as a as a town thing I understand that
this is for the farmer's market but this
[1:11:40]
opens up other doors I think we have to
have further discussions Council General
[1:11:45]
um so
um I don't know I I sorry I'm just a
[1:11:50]
little not clear on what was discussed
about this with this Council and what
[1:11:55]
was discussed about this before this
farmer's market request came to the
[1:11:59]
previous Council and they chose to table
that didn't want to make a decision and
[1:12:03]
tabled it for the new Council so I'm not
sure if this Council has seen this
[1:12:07]
farmer's market request but it was put
in quite some time ago
[1:12:12]
um my question is if we go with this
um pilot project for the farmers market
[1:12:18]
we're not limiting ourselves to that
early if we have time for additional
[1:12:23]
discussion to to test it out in other
areas can we do that as well or are we
[1:12:29]
limiting ourselves because I certainly
Council holds making some really good
[1:12:33]
points about we've discussed this before
about other areas are we limiting
[1:12:37]
ourselves to Justice or can we do other
um testing or or whatever to determine
[1:12:44]
whether or not we can do it downtown as
well so that that option is available
[1:12:49]
when we look at the way that this is
reading now in reference to that
[1:12:53]
particular location and that location
only at this time it prohibits it
[1:12:58]
prohibits from anyone else saying well
you've allowed that this it's not as if
[1:13:03]
you're changing your legislation the
current legislation still is intact
[1:13:08]
whereas food vendors are still
authorized under bylaw
[1:13:13]
15-2015 provide with you know with
providing that the owner operating
[1:13:18]
additional Food Service establishment so
that that existing legislation is in
[1:13:24]
existence this resolution does not amend
that legislation this is just allowing
[1:13:30]
for a basically a one-year one this is
not allowing that farmers market on a
[1:13:37]
continual basis to continue to operate
this is just in order to a get the
[1:13:44]
resident feedback as to whether or not
food cart vendors is something that they
[1:13:50]
want within the community if there is
another opportunity to have
[1:13:54]
um so the ideal with this as a pilot
project is it's consistent
[1:13:59]
so we know that that it's there every
every weekend it's not sporadic so it's
[1:14:05]
easy to
to monitor to some extent if there is
[1:14:10]
another option to be looking at after
hours food cart if if a lot of
[1:14:14]
challenges do not surface and a lot of
perceptions are debunked at that point
[1:14:21]
because there is some sensitivity with
with this and if some of those concerns
[1:14:27]
are alleviated and it seems to be
working really well expanding for a
[1:14:32]
downtown area what does that look like
at any time Council can deliberate and
[1:14:36]
look at what can be permitted and what
cannot be permitted and adjust
[1:14:40]
legislation accordingly if there is the
opportunity for a downtown after hours
[1:14:47]
vendor as well as to further expand
within this option before permanently
[1:14:54]
changing legislation 100 Council can
enter into okay so we're not limiting
[1:14:59]
ourselves to just this correct could
after further discussion decide okay and
[1:15:04]
maybe do we'd like to Pilot food vendors
on handstand nights and see how that
[1:15:08]
goes before we change the legislation
correct okay we had food vendors
[1:15:14]
knocking at our door yes we have had
food vendors in the past yes as well as
[1:15:20]
as well as the public the questions
um councilor Jarvis and I
[1:15:26]
it's not that we're I'm not against food
carts and I'm not against food trucks
[1:15:31]
I'm not against any of those things but
my concern is always being who controls
[1:15:36]
it now do we control it or do we by when
I say as a pilot project do we give it
[1:15:41]
to the farmers market because there's a
there's an awful lot of criteria there's
[1:15:45]
an awful lot of standards and rules and
regulations and policies and procedures
[1:15:49]
that apply to these things
um and are we going to be able to have
[1:15:53]
input into that it's one thing to have a
pilot project and say okay you can go
[1:15:56]
ahead and do that but if we have if we
stand back and then we watch things
[1:15:59]
happen and they shouldn't happen that
way how do we how do we interact and do
[1:16:03]
that correct so so this resolution is
just authorizing the CEO to move forward
[1:16:08]
to create that level of agreement with
that organization and so when we look at
[1:16:14]
the looking at other past legislation
and bylaws that other communities have
[1:16:20]
governed food cart vendors proof of
insurance all of those things would be
[1:16:24]
part uh and parcel as to the agreement
that must be provided and so at that
[1:16:29]
point it is it's not as simple as this
resolution has passed and it's a done
[1:16:34]
deal so now it's then this is initiating
it looking at what that agreement looks
[1:16:38]
like looking at the requirements that
Council wants to have as part of the
[1:16:43]
provisions as part of this project that
still needs to be determined at that
[1:16:48]
point
Castle Hill so in here it doesn't
[1:16:51]
mention excuse me times of operation
does that does this mean that they can
[1:16:56]
only operate while the farmer's market
is open or they can can use those
[1:16:59]
grounds when there is no Farmers Market
happening
[1:17:02]
so it was it was based on the assumption
that when the farmer's market was
[1:17:07]
happening
[1:17:10]
So So currently I can look at changing
as part of the project and that's where
[1:17:15]
again this is just initiating a pilot
project it's not outlining the project
[1:17:20]
itself and so when we look at specifics
such as requirements times of operation
[1:17:27]
that's outlined in the agreement
this is just initiating the fact that
[1:17:33]
it's going forward on on saying yes
we're going to allow this what does this
[1:17:37]
pilot project look like
yeah I I would just like to see it as a
[1:17:40]
whole that's all
[1:17:43]

would like this so that you could move
[1:17:48]
forward with starting to have some
initial discussions uh it's not so much
[1:17:52]
I'm I would like this this is up to the
council to decide if they would like
[1:17:56]
this uh this is an option for Council to
look at having a food cart

um operating without the current
provisions of bylaw 15-2015 without
[1:18:09]
permanently changing legislation
Council General I promised my last
[1:18:15]
comments okay I think this is a nice
controllable manner in which
[1:18:20]
um gives us an opportunity to
um look at a what's important to us for
[1:18:26]
requirements b
um testing them out testing the waters
[1:18:32]
on what we're looking for again in a
controllable manner so that if at the
[1:18:38]
end of the pilot or even maybe part way
through the pilot if it's very
[1:18:42]
successful we want to start looking at
changing we have
[1:18:47]
um some good groundwork to help us
change our legislation if that's the
[1:18:51]
road we're going in as opposed to
spreading it all out and while these are
[1:18:57]
the issues here and those are the issues
there and and then we're just I Envision
[1:19:01]
us having to look at so much and and and
not being able to maintain our focus and
[1:19:08]
change that we may want to see happen
not happening because we've not done an
[1:19:14]
in-depth look that's manageable
initially well one of the things that
[1:19:18]
occurs to me that if if this happens
um NFR CAO can figure out a policy with
[1:19:26]
them policies and procedures and what
they would have to follow and what that
[1:19:29]
would look like then we would have a
template with which we could be sitting
[1:19:33]
down with our local businesses and
saying
[1:19:36]
we're thinking about getting food carts
in here and these are the policies and
[1:19:39]
procedures they would have to follow so
that we're not just going to that empty
[1:19:42]
hand and saying well we're not quite
sure how they would run it but they
[1:19:45]
would run and and what the policies
would be comfortable
[1:19:51]
again this is for the farmer's market
we're not going to have a whole lot of
[1:19:54]
Leverage here once we agree with this
too
[1:19:57]
because it's if we agree with food carts
it's the farmer's market food carts have
[1:20:01]
nothing to do with the town
[1:20:04]
what kind of Leverage do we have if
something's going selfish there's a
[1:20:08]
bunch of complaints from the from the
local business owners like
[1:20:14]
we don't have a whole lot of uh
rent here to sink our teeth to do if
[1:20:18]
something's not going right
so that's where it would be when you're
[1:20:22]
looking for the grit that would be
identified in the agreement that would
[1:20:27]
need to be signed by this as a pilot
project the agreement
[1:20:34]
in order to say these are our
expectations this is if if there is x
[1:20:40]
amount of uh or problematic let's say
with litter you could have a provision
[1:20:44]
within that agreement that if there is a
significant increase in litter uh that
[1:20:50]
the amendment can be terminated it will
no longer be permitted for the rest of
[1:20:53]
the season that should have been put on
the table before like you know included
[1:20:58]
in a resolution
too early
[1:21:02]
um and I just wanted
clarify what you're saying because it
[1:21:06]
and like Gene this would be the last
thing I said I'd say um we are going to
[1:21:11]
establish the criteria for the farmers
market for their food vendor like we're
[1:21:17]
going to say here is what our pilot
project will include this you need to
[1:21:20]
have this this so we're going to
establish that criteria that's correct
[1:21:24]
otherwise they don't get a food card
correct okay but I just wanted I yeah
[1:21:29]
because and again that was my fear is
that you know if we pass I don't like
[1:21:34]
the 2015 bylaw any more than anybody
else and I think sometimes the badger
[1:21:40]
the local businesses
they're not against food carts either
[1:21:44]
but we want to make sure that we're all
played by the same rules if you're
[1:21:47]
allowed to you know take a penalty and
I'm not allowed to take a penalty then
[1:21:51]
it's two different sets of rules correct
and that's why that's why the food cart
[1:21:56]
vendors generally have their own bylaw
itself that clearly outlines and it can
[1:22:02]
be as specific as each municipality
chooses well they mentioned one thing
[1:22:05]
about the city of Winnipeg in a game
I've mentioned before the city of
[1:22:08]
Winnipeg has a whole different ballgame
including common laws and everything
[1:22:12]
your carts have to go where they tell
you to go the criteria is crippling as
[1:22:18]
well as the costs so right now as part
of through this the way that legislation
[1:22:23]
is written food cart vendor would be
subject to the 75 Dollar
[1:22:28]
business license that that every other
business is so in the city of Winnipeg
[1:22:32]
to operate a food cart at a specific
location that the city has identified
[1:22:37]
those costs to have that through the
season can range anywhere between 2500
[1:22:41]
and 3
[1:22:44]
but there's also things where you have
to bring your cart to their
[1:22:49]
parking lot and they they store it for
you and they check all that the city of
[1:22:53]
Winnipeg does that has nothing to do
with the farmer's market okay correct
[1:22:57]
and so that's where when we look at how
in-depth legislation goes without really
[1:23:01]
just
stepping a little bit into to what what
[1:23:07]
is valuable we are not the city of
Winnipeg and so those rules and
[1:23:11]
regulations may not fit here and so it's
what is the fit here is the so when we
[1:23:16]
look at the downtown area is part of
that bylaw saying you know what a food
[1:23:21]
cart is permitted after hours at do and
then do those locations still need to
[1:23:26]
require
um portable washrooms like and so
[1:23:29]
there's lots to think about before
really actually sitting down and writing
[1:23:33]
formal legislation that's just going to
be permitted and once it's permitted any
[1:23:39]
how many are permitted so there's lots
of things for Council to consider when
[1:23:43]
looking at this and so this is a way to
address from what I understand and
[1:23:48]
identified meat where there has been
several requests being being made in a
[1:23:52]
controlled environment where we can
monitor some of the problem areas
[1:23:59]
with minimal impact two legis
legislation and therefore
[1:24:06]
minimizing any risk of well if they are
allowed why can't I because it's
[1:24:11]
specifically outlined by a signed pot
like agreement under a pilot Project
[1:24:15]
without change of legislation Council
yeah I just want to report on this one
[1:24:20]

so is it possible then as a way of
starting that
[1:24:30]

our CAO could bring to us the outline of

like this like in an open Forum Maybe
[1:26:21]
so so when we looked at at this
particular things it's my understanding
[1:26:26]
that the businesses that were impacted
were the downtown area and because this
[1:26:30]
location is not within that downtown
area the intent is offering this locate
[1:26:36]
this pilot project one vendor only not
in the downtown area to open those
[1:26:42]
discussions for changing permanently
changing legislation and therefore
[1:26:48]
involving local businesses

process I think would be meeting with

the with the local businesses
um having some discussion with them
[1:27:41]
about some of the concerns about not
having access to food and coffee and

um did your evenings or Sunday

afternoons those kinds of things

and having a full discussion about food
vendors

councilor Jarvis is it possible to have
this um
[1:28:01]
what you described with the resolution
in within the next 30 to 60 days at the
[1:28:06]
next meeting or the second next meeting
uh absolutely yeah so that we can yeah
[1:28:13]
the way you just read the resolution if
example in January through week January
[1:28:18]
we have this ready to discuss it but I I
and I think we can probably get a few
[1:28:23]
business people involved in it if you
want to and heaven forbid that I've said
[1:28:26]
the word special meeting but um if you
want to get some sort of a meeting
[1:28:29]
together with three or four people then
and get them to establish criteria
[1:28:36]
well we're talking about two different
things

yeah right but what I'm saying is that
is this is about putting together policy
[1:28:46]
policies and plans for a food cart at
the farmer's market where you know
[1:28:52]

once we take a look at some of those
[1:28:55]
preliminary policies and procedures then
having a fuller discussion about

what we want to do with downtown
Winnipeg Beach and that would include

talking to restaurants and business
owners down here no I understand okay so

my question is once we agree to this are
we saying to the farmer's market they

can have we are saying our CEO can put
together a policy and procedure that

you'll bring back to council
we're going to establish correct here

project and things that are going to be

and the whole idea behind a pilot
project is you learn from it and you

learn things that you have in there

might try something and then fall off
the cliff and that's what I think just

what I think we need to do is again get
the businesses involved before because
[1:30:49]
they might come up with some really good
ideas as well that we can

put into this pilot project before we
I'm just saying it's middle of winter

time nobody it might be the time to do
it so it would seem to me that we are

going around the circles and sort of
saying the same thing over and over
